PETITION FOR CUSTODY
AND NOW, this ~ day of February 2000, comes the Petitioner, Cathy E. Fry, by her
attorneys, Irwin, McKnight and Hughes, and presents the following Petition for Custody.
I.
The petitioner is Cathy E. Fry, an adult individual who resides at 333 Old Mill Road,
Carlisle, Cumberland County, Pennsylvania 17013.
2.
The respondent, David A. Heinbaugh, Jr., is an adult individual whose address and
residence are unknown.
3.
The respondent, Crystal D. Angle, is an adult individual who resides at 1870 Black Gap
Road, Fayetteville, Pennsylvania 17222.

The respondent is Michelle 1. Newbold, an adult individual residing III 41
Winchester Gardens, Carlisle, Cumberland County, Pennsylvania 17013.

The respondents are the natural parents and aunt of Shadeaux Marie Heinbaugh, born
August 8, 1993, age six (6) years, and Tyler Adam Heinbaugh, born June 15, 1994, age five (5)
years.

The petitioner, Cathy E. Fry, is the natural grandmother of the children, Shadeaux Marie
Heinbaugh and Tyler Adam Heinbaugh.

The children currently attend the Plainfield Elementary School in the Big Spring School
District.
8.
Plainfield Elementary School Principal, Mrs. Tritt, contacted Cumberland County
Children and Youth Services on Monday, January 31, 2000, and informed Children and Youth
Services that the children have been abandoned by their natural parents and were left with
petitioner's daughter, Michelle 1. Newbold, 41 Winchester Gardens, Carlisle, Pennsylvania.

Respondent, Michelle L. Newbold cannot physically care for the children and desires that
they be able to stay with Petitioner. The children are currently residing with Petitioner, Cathy
Fry. A copy of a letter from Michelle L. Newbold dated February 2, 2000, is attached as Exhibit
"A" and is incorporated herein by reference thereto.

The children have both lived with the Petitioner, Cathy Fry, for different and numerous
periods of time in their lives since birth.
11.
The whereabouts of the Respondent, David Heinbaugh, are unknown to the Petitioner, his
children or the school district.
12.
Respondent, Crystal D. Angle, has informed the school district that she no longer has a
permanent residence within the school district.
13.
The petitioner believes and avers that it is within the best interests of the minor children
that the petitioner be granted primary physical and legal custody of her grandchildren, Shadeaux

Marie Heinbaugh and Tyler Adam Heinbaugh, until further Order of Court. This Petition is
supported by the Cumberland County Children and Youth Services, Carlisle, Pennsylvania.

The best interests of the children requires that the court grant the petitioner's request as
set forth above.
WHEREFORE, petitioner respectfully seeks the entry of an Order of Court seeking
primary physical custody of the children.

1993, age six (6) years, and Tyler Adam Heinbaugh, born June 15,1994, age five (5) years.

The petitioner, Cathy E. Fry, is the natural grandmother of the children, Shadeaux Marie
Heinbaugh and Tyler Adam Heinbaugh.

The children currently attend the Plainfield Elementary School in the Big Spring School
District.
7.
Plainfield Elementary School Principal, Mrs. Tritt, contacted Cumberland County
Children and Youth Services on Monday, January 31, 2000, and informed Children and Youth
Services that the children have been abandoned by their natural parents and are currently staying
with petitioner's daughter, Michelle L. Newbold, 41 Winchester Gardens, Carlisle, Pennsylvania.
8.
The petitioner believes and avers that it is within the best interests of the minor children
that the petitioner be granted primary physical and legal custody of her grandchildren, Shadeaux
Marie Heinbaugh and Tyler Adam Heinbaugh, until further Order of Court. This Petition is
supported by the Cumberland County Children and Youth Services, Carlisle, Pennsylvania.

The petitioner believes and avers that it is within the best interests of the minor children
that the petitioner be granted primary physical and legal custody of her grandchildren, Shadeaux
Marie Heinbaugh and Tyler Adam Heinbaugh, until further Order of Court. This Petition is
supported by the Cumberland County Children and Youth Services, Carlisle, Pennsylvania.

Respondent, Michelle L. Newbold cannot physically care for the children and desires that
they be able to stay with Petitioner. Therefore, the children are currently residing with Petitioner,
Cathy Fry. A copy of a letter from Michelle L. Newbold dated February 2, 2000, is attached as
Exhibit "c" and is incorporated herein by reference thereto.

The Respondents have abandoned the children to the care of Petitioner at various times in
the past. The children have both lived with the Petitioner, Cathy Fry, for different and numerous
periods of time in their lives since birth.

Petitioner has filed a Petition for Custody on or about February 8, 2000, in which she is
requesting that this Honorable Court grant her full custody of the above-referenced children.

During the 1998-1999 school year Frankford Elementary School Principal, Mr.
Underkoffler, wrote two letters to the natural parents regarding the head lice and the problem
with truancy. Shadeaux was removed from the enrollment at Frankford Elementary School on
March 3,1999. Both children returned to Frankford Elementary at the beginning of the 1999-
2000 school year, during this school year the children were removed from Frankford and placed
into Plainfield Elementary still within the Big Spring School District. Due to the parents lack of
stability and the school district's desire for the children to have stability the school has agreed to
allow the children to remain within the Plainfield Elementary School District as long as
transportation is provided for them. Please see a copy of the letters from Mr. Underkoffler
attached to a letter from Cheryl Tritt dated February 3, 2000, which is attached as Exhibit "A"
and is incorporated herein by reference thereto. Also, a copy of a letter from the guidance
counselor for Plainfield Elementary School dated February 3, 2000, is attached as Exhibit "B"
and is incorporated herein by reference thereto.

The petitioner believes and avers that it is within the best interests of the minor children
that the petitioner be granted primary physical and legal custody of her grandchildren, Shadeaux

The Honorable Judge Edgar Bailey:
The purpose of this letter is to share my observations and concerns (as building principal)
about Shadeaux and Tyler Heinbaugh.
Shadeaux was enrolled in kindergarten at Frankford Elementary School (Big Spring
School District) during the 1998 - 1999 school year. There were recurring problems with
head lice; and according to the principal at Frankford (Mr. Gerald UnderkoIDer),
Shadeaux's parents were not cooperative in dealing with the problem. In fact, David
Heinbaugh and Crystal Angle blamed the school for the problem, and on or about
February 10, 1999, they stopped sending her to school. Please note the two (2) attached
letters from Mr. UnderkoIDer to Shadeaux's parents, in which Mr. UnderkoIDer tried to
meet with the parents and get Shadeaux back into school. Eventually she was withdrawn
from the school's enrollment on March 3, 1999, because Mr. Heinbaugh and Ms. Angle
did not respond to Mr. UnderkoIDer's communication. In addition, attendance records at
Frankford show that Shadeaux missed 12 days of school between August 31,1998, and
February 10, 1999 (when the extended absence started).
Shadeaux returned to Frankford at the beginning of the 1999 - 2000 school year, enrolled
in First Gr~de. Tyler was enrolled in Kindergarten. At this time both children were now
living with their paternal grandmother, Cathy Heinbaugh Fry. The teacher and principal
at Frankford indicated that they saw an improvement in Shadeaux's physical condition
while she was with her grandmother. From her improved cleanliness and clothing, it was
obvious to the staff at Frankford that she and Tyler were being cared for appropriately.
Also, attendance records indicate that Shadeaux missed only one day of school between
August 20, 1999, and November 4, 1999 (when she was living with Cathy Fry), During
this same period, Tyler missed only two days of school.
On November 4, 1999, Shadeaux and Tyler were withdrawn from Frankford and enrolled
at Plainfield because they were now living with their father, who was residing with his
father and stepmother (Mr. and Mrs. David Heinbaugh, Sr.). Their residence is in the
Plainfield attendance area (still the Big Spring School District). It was during this stay
with their father that Shadeaux reported to her teacher that she and Tyler had been left
alone. Upon further investigation, I learned that Shadeaux and Tyler had been sleeping in
a travel trailer with their father and his IS-year old girlfriend. (The travel trailer was
parked beside the home of David Heinbaugh, Sr.) When they woke up in the morning,
their father and his girlfriend were not there. They knocked on the door at the house, but
apparently no one heard them so they went back into the travel trailer. Later they learned
that their father had left them to take his girlfriend to school. Shadeaux indicated to me
that this was a frightening experience for her.

Over Christmas 1999, David, Jr, moved from his father's house and took the children
with him. We learned after Christmas that David, Crystal and the children were living in
the Frankford attendance area with a friend. Because we wanted the children's
educational environment to remain stable, we informed David, Jr. that the children could
continue to attend Plainfield if he would provide their transportation to and from school.
Since Christmas; the children have remained enrolled at Plainfield, with their aunt,
Michelle Newbold, a primary means of transportation.
On Monday, January 31, 1999, Michelle Newbold called Plainfield to tell us that she
would not be able to bring the children from her home in Carlisle, due to the two-hour
delay and poor driving conditions. She also indicated that the children had been with her
since Friday, January 28, and that she had not heard from her brother David, Jr. since
Thursday, January 27. She had no idea where he was. This presented another concern
because I then learned that David, Crystal, and the children were no longer living with
their friend in the Frankford area. They had been evicted from that home" My concern
then was the residence of Shadeaux and Tyler. In order for them to continue attending
school in the Big Spring School District, the children must have a residence within the
District. As of this date, the children are residing with their grandmother, Cathy Fry,
which is within the Big Spring School District,
It is important for Shadeaux and Tyler to have the consistency provided by attending the
same school, instead of being moved from home to home and from school to school.
While they have been here at Plainfield, we have noticed some learning difficulties. In
an attempt to address these difficulties, David and Crystal were asked to meet with us on
Thursday, January 13, 2000. They were reminded about this meeting by both classroom
teachers, by the Instructional Support teacher, and by a reminder letter. They did not
attend this meeting nor did they call to give any explanation for their absence from the
meeting.
We believe that it is in the best interests of both children to continue attending Plainfield.
As with all children, they need a stable home environment, where they are cared for and
where they feel secure. Shadeaux has indicated to her teacher that she wants to stay with
"Grandma Cathy" and that she would feel bad about going with her mother and father.
I realize that this is a fairly long report of the school's knowledge of the situation. If
there are any parts that are not clear, please feel free to call me at Plainfield.

Dear Mr. Heinbaugh, Ms. Angle,
This letter is being sent to you in reference to your daughter, Shadeaux Heinbaugh. Our records
indic:ate that Shadeaux bas been absent from school since February 10, 1999. We are concerned about her
extended absence - and would encowage you to begin to send her to school.
I am aware that a misunderstanding occurred regarding the district's head lice policy. I have
spoken with both of you regarding such - and have communicated that the district HAS a 'no head-lice'
policy. We do NOT have a 'no oit' policy (as several neighboring districts have) - but it is our policy to
communicate with parents when we find what appears to be 'new' nits - or an increased number of oits.
The latter was the case with your daughter - which resulted in the s"hP1inIillg of a meeting (2116/99) with
Ms. Angle, your daughter, Shadeaux, and our school nurse, Mrs. Weigle - in an effon to resolve the
misunderstanding. Unfortunately - Ms. Angle and Sbadeaux did not come to the meeting - and after I
called the house, I was informed that they were unable to attend. I have since spoken with Mr. Heinbaugh
and a~ encowaged a newly scheduled meeting to discuss the misunderstandin I also ellCOUlaged
Sbadeaux's prompt return to school. To date. ShAMn'Y continues to be absent from school - and I bave
not heard from either Mr. Heinbaugh or Ms. Angle. (Last messages left on 2/23/99)
There is no question in my mind that Sbadeaux belongs in school - and should continue attending
the Kindergarten class at Frankford Elementary. Extended absences reduce the opportunity for a student to
develop academically and socially - and only reduce the chance for the student to be promoted to the next
grade. If ShI'tf.....,y absences continue, I will unfortunately be required to curtail her enrollment in our
district This is certainly NOT wbat I want for Sbadeaux.
I am requesting that you EITHER call me to further discuss any concerns you may bave - OR
begin sending Sbadeaux to school no later than Wednesday, March 3, 1999 - or she will be withdrawn from
our enrollment as of that date. I trust that you will not choose to allow this to happen. I may be reached
between the hours of 8 AM through 4:30 PM at the Frankford School (776.2025) or the Mifflin School
(776-2030).

Dear Mr. Heinbaugh and Ms. Angle,
This letter is being sent in an effort to communicate action taken by the Frankford Elementary
School. Referring to my letter (dated 2/24/99), I received no contact by you to discuss concerns which
you may have had - and as of March 3, 1999 - your daughter remained absent from our school. Your
daughter, Shadeaux Heinbaugh, was therefore withdrawn from our enrollment --effective to February
10 (date after her last day in attendance).
Our school librarian has brought to my attention that Shadeaux has a library book in her
possession which is now overdue. The title of the book is Y oulll Soon Grow into them. Titch. We are
requesting that this book either be brought to the school by a member of the family - or sent to school
with a neighbor or friend (perhaps Matthew Mixell). The book needs to be returned to be available for
other students to read and enjoy. Thank you for your attention to this matter.
As mentioned in my last letter, extended absence reduces the opportunity for a student to
develop academically and socially - and reduces the likelihood that they be promoted to the next
grade. It is my recommendation at this time, since Shaddeaux is not in attendance to complete her year
in Kindergarten, that it is her best interest to spend another year in kindergarten (I 999-2000). It is
hoped that this additional year will provide the time to grow and develop and thus build a stronger
foundation for success in future years.

The Honorable Judge Edgar Bailey,
lam writing concerning my recollections/impressions offactors affecting the
lives of Tyler and Shadeaux Heinbaugh. I am an elementary guidance counselor serving
both Frankford and Plainfield Elementary schools, the schools Tyler and Shadeaux have
attended during the 1999-00 school year. I have been employed by public schools and/or
mental health agencies for 18 years. Tyler is currently in kindergarten and Shadeaux is in
1" grade, These students were brought to my attention for counseling purposes on
September 2, 1999 by their paternal grandmother Cathy Fry. They attended Frankford
Elementary at the time. Mrs. Fry expressed concern regarding their adjustment to school
as well as their ability to cope appropriately with factors related to their past home
environment instabilities. According to conversations with Mrs. Fry, as well as multiple
interviews with the children, issues related to fears of abandonment, anger towards
parents and exposure to high risk adult behaviors unfolded. Tyler and Shadeaux present
as being under deep emotional distress due to their past environmental instability. Mrs,
Fry has followed my suggestions closely and the children were making progress toward
proper emotional adjustment up until their biological parents became involved in
November of 1999,
1'1 November of 1999, David Heinbaugh Jr., (the biological father) took Tyler and
Shadeaux to live with him and his father and step-mother. This necessitated changing
schools from Frankford to Plainfield. Since altering their living arrangements, the
children have related to me one bizarre story after another, On the surface, these stories
appeared to be tall tales. Upon further investigation however, bits and pieces were
confirmed. These stories represent a child's skewed perception and poor judgement at
best on the part of the adults involved, It should be noted that while living with their
grandmother Cathy Fry, no such incidents were reported to me by the children or anyone
else.
Since the above mentioned move, Tyler Heinbaugh has reported to me that he
doesn't care where he lives because he's not afraid of anybody, Shadeaux has repeatedly

and consistently stated that she wants to live with grandma Cathy because she is nice and
she feels safe there, While this is not the typical conversation a school counselor has with
students, it is usually, all Tyler and Shadeaux want to talk about as they are at times
consumed by it.
I have spoken extensively with David Heinbaugh Jr. and Crystal Angle, the
biological parents. Both parents were polite and expressed support for the children to
continue seeing me. The parents have related the following statements to me in
describing their current life situations. David Heinbauigh stated to me that he and Crystal
would be moving in with a friend and that they would "probably build an addition on to
the house and then there would be enough room for everybody". Ms, Angle confided to
me that David had been recently living with a 15 year old female in a camper, but that
since CCC& Y told him to break up that relationship, she was confident that he would and
that "everything will be fine now for me to take him back",
Regarding school/home communication, David Heinbaugh Jr. was encouraged by
me to keep informed with the teacher on a monthly basis, He was informed of the
children's lack of academic preparedness and their need for close parental supervision of
homework to insure academic success. To this date, neither parent has contacted the

STIPULATION AND AGREEMENT

THIS STIPULATION AND AGREEMENT entered into this ~ day of March,
2000, by and between Cathy E. Fry ("Grandmother") and David A. Heinbaugh, Jr. and Crystal D.
Angle ( "Parents").
NOW THIS AGREEMENT WITNESSETH THAT:
WHEREAS, Parents are the natural parents of Shadeaux Marie Heinbaugh, born August
8,1993, and Tyler Adam Heinbaugh, born June 15, 1994; and
WHEREAS, Grandmother desires to continue primary custody of the minor children,
Shadeaux Marie Heinbaugh and Tyler Adam Heinbaugh; and
WHEREAS, Parents desire that Grandmother be the primary care giver and custodian for
the minor children, Shadeaux Marie Heinbaugh and Tyler Adam Heinbaugh at least until the end
of 1999-2000 academic year; and
WHEREAS, Grandmother and Parents desire to enter into an agreement regarding
custody relative to the minor children, Shadeaux Marie Heinbaugh and Tyler Adam Heinbaugh,
to be in effect hereafter and until altered by subsequent order of court; and

WHEREAS, Grandmother and Parents desire to confirm their agreement relative to
custody of the minor children and execute a Stipulation and Agreement to effect the same.
NOW, THEREFORE, in consideration of the mutual covenants, promises and
agreements as hereinafter set forth, and intending to be legally bound, the parties hereto agree as
follows:
1.
The parties shall have joint legal custody of the children,
2.
Grandmother, Cathy E. Fry, shall have primary physical custody of the minor children,
Shadeaux Marie Heinbaugh and Tyler Adam Heinbaugh. At no time shall Cathy Fry permit
Christopher Heinbaugh to be in the company of the minor children.
3,
Parents, David A Heinbaugh, Jr. and Crystal D. Angle, shall have partial physical
custody of the minor children during a regular four (4) week cycle as follows:
a. Every first and third weekend, beginning at 6:00 p.m. Friday through 6:00
p.m. Sunday;
b. Every fourth weekend from 3 :00 p.m. Saturday through 6:00 p.m. Sunday;
c. One weekday each week, from the end of each child's school day until
8:00 p,m. It is anticipated that this day shall correspond, to the extent
possible, to a day off in the parents' work schedules,
d. A schedule of custody over holidays will be as mutually agreed between
the parties;

e, At such other times as the parties have mutually agreed to in advance.

If, during Parents' periods of partial physical custody, Parents are unable to directly care
for the minor children and must make arrangements for a babysitter or other competent adult to
care for the children for any length of time, then in that event the Grandmother shall have the
right of first refusal to provide care for the children and the Parents shall make reasonable efforts
to contact Grandmother and make the children available for the Grandmother to care for the
children during this time.
And, Grandmother shall have a similar duty during her periods of primary physical
custody to give the Parents a similar right of first refusal.

The place of all custody exchanges shall be the Uni-Mart in Plainfield, Cumberland
County, Pennsylvania.
6.
The parties agree to share in the transportation of the minor children.
7.
The parties will keep each other advised immediately relative to any emergencies
concerning the children and shall further take any necessary steps to ensure that the health,
welfare and well being ofthe children are protected.
8.
All parties shall have reasonable telephone contact with the children during periods when
the children are not in the custody ofthat party,

9.
Any modification or waiver of any of the provisions of this Agreement shall be effected
only with the mutual consent of all parties.
10,
The parties agree that in making this Agreement there has been no fraud, concealment,
overreaching, coercion or other unfair dealing on the part of the other, and all parties understand
the terms of this Agreement.
11.
The parties desire that this Agreement be made an Order of Court through the Court of
Common Pleas of Cumberland County and further acknowledge that the Court of Common Pleas
of Cumberland County has jurisdiction over the issue of custody of the minor children and shall
retain such jurisdiction should circumstances change and either party desire and require further
modification of said Order,
IN WITNESS WHEREOF, the parties hereto, intending to be legally bound by the
terms hereof, set forth their hands and seals the day and year first written above,
