STIPULATION AGAINST LIENS
THIS AGREEMENT made the of January, 2000, by and
between J&M BUILDING CONTRACTORS,
AND
DAVID B. CLOUSER and SHARON L. CLOUSER, hereinafter referred to as
Owner, whereby the former undertook and agreed to erect and
construct a single family dwelling on that certain lot of grounci
situate in
Lot No. 37, Simmons Road, Lisburn Meadows Estates - North, PhasE~
I, Plan Book 77, Page 37, Monroe Township, Cumberland County
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for and in consideration of the sum of ($1.00) Dollar
to contractor in hand paid by Owner, the receipt whereof is
hereby acknowledged, and the further consideration mentioned in
the agreement aforesaid, for themselves and their subcontractor!!,
and all parties acting through or under them, covenant and agreE~
that no mechanic's liens or claims shall be filed or maintained
by them or any of them against the said buildings and the lot of
ground appurtenant thereto for or on account of any work done or
materials furnished by them or any of them under said contract or
otherwise, for, towards, in, or about the erection and
construction of the said buildings on the lot above described,
and the said Contractor, for themselves, their subcontractors and
others under them hereby expressly waive and relinquish the right
to have, file, and maintain any mechanic's liens or claims
against the said buildings or any of them, and agree that this
instrument, waiving the right of lien, shall be an independent
covenant.

Cumberland County, Pennsylvania, and more particularly
indentified as follows:
BEGINNING at a point on the western side of Simmons Road 1133
feet wide right-of-way) at the dividing line between Lot No. 37
and Lot No. 38 of the aforementioned subdivision plan; thence
along said Simmons Road South 04 degrees 49 minutes 22 seconds
West, a distance of 51.93 feet to a point; thence continuing
along Simmons Road on a curve to the right having a radius of
283.50 feet and an arc length of 177.69 feet to a point; thence!
continuing South 40 degrees 44 minutes 03 seconds West, 150.48
feet to a point at the dividing line between Lots No. 36 and Lot

UNDER AND SUBJECT, nevertheless, to the conditions,
restrictions and easements as noted on the hereinabove mentione!d
final subdivision plan; and SUBJECT, further to the Declaration of
Protective Covenants, Conditions, Restrictions and Reservations
for Lisburn Meadows Estates - North dated June 15, 1998 and
recorded in the Office of the Recorder of Deeds aforesaid, in
Miscellaneous Book 582, Page 936, including but not limited to
All drainage easements and detention basins applicable to the
herein described lot and detailed on said final subdivision plan.
BEING PART OF THE SAME PREMISES which Kronenberg and Group, a
partnership consisting of William M. Kronenberg, Donald A. Group,
Donald A. Group, Jr., and Tony D. Group, by deed to be recorded
simultaneously herewith in the Cumberland County Recorder of De!eds
