MINNICH tJd/b/a M & M ELECTRIC ASSOCIATES, Defendant. :CIVIL ACTION - LAW COMPLAINT AND NOW, comes the Plaintiff, R. F. FAGER CO.,INC., by and through its Attorneys, KUNDRAT & ASSOCIATES, and states the following cause of action: 1. Plaintiff, R. F. Fager Co., Inc., is a corporation with offices and/or a place of business situate at 2056 State Road, Camp Hill, Cumberland County, Pennsylvania 17011. 2. Defendant, Mark A. Minnich is an adult individual trading and doing business as M & M Electric Associates with offices and/or a place of business situate at 300 Hollar Avenue, Shippensburg, Cumberland County, Pennsylvania. 3. During all relevant times hereto, Defendant conducted business under the name M & M Electric Associates. 4. Plaintiff is, and at all relevant times was, a wholesale distributer of building supplies. 5. Defendant is, and at all relevant times was, a contractor. 6. On or about August I, 1999, Defendant applied to Plaintiff for credit. "-.-.,, " ~ ~ -~"'''',"-,- 7. Between August I, 1999 and December 30,1999, various products, goods, supplies and materials (hereinafter collectively referred to as "products") were ordered by Defendant from Plaintiff. Plaintiff sold and provided the products ordered by Defendant. The invoices are too numerous to be attached hereto, however, invoices, shall, upon request, be supplied to Defendant. 8. The prices charged for the products sold to Defendant as set forth in the invoices were fair, reasonable market prices of the products and the prices that Defendant agreed to pay. 9. Plaintiff has maintained a statement of account keeping an accurate and running account of debits and credits for the products sold to Defendant by Plaintiff. 10. Plaintiff has submitted to Defendant statements of account accurately setting forth all debits and credits for transactions with Defendant, said statements of account showing an amount owing to Plaintiff of $ 12,772.96 and reflecting no payments. A statement dated December 31, 1999, is attached hereto, made a part hereof and marked as Exhibit "A". 11. Despite demand, Defendant has refused to pay the past due balance on the open account of all sums due and owing to Plaintiff. 12. Plaintiff has retained the services of the law firm of KUNDRAT & ASSOCIATES at the rate of$140.00 per hour in the collection ofthe amount due from Defendant. 13. Plaintiff has incurred reasonable attorney's fees from the law firm of KUNDRAT & ASSOCIATES in the collection of the amounts due from Defendant in commencing this action, and shall continue to incur such attorney's fees through the conclusion of the proceedings. 2 J~ I_~.ftl_"'", 14. Any and all conditions precedent to the bringing ofthis action has been performed by Plaintiff. 15. The amount in controversy is within the jurisdictional amount requiring compulsory arbitration. WHEREFORE, Plaintiff, R. F. FAGER CO. respectfully requests that judgment be entered in its behalf and against Defendant, Mark A. Minnich t/d/b/a M & M Electric Associates, in the amount of$12,772.96, interest at the rate of 11/2 % per month from December 31,1999, attorneys fees, plus the costs of this action and such other relief as the court deems just and proper.
