COMPLAINT IN EJECTMENT
1. Plaintiff, Chase Bank of Texas flk/a Texas Commerce Bank, N.A. as
Custodian ("Plaintiff'), is a corporation with its principal place of business located at
Post Office Box 121549, Fort Worth, Texas 76121-1549.
2. Defendants are Joseph C. Carminati and any and all unknown occupants
residing at 67 Spring Road, Carlisle, Pennsylvania 17013 (collectively, "Defendants"),
which property is more fully described in the legal description attached hereto and
marked as Exhibit "A" (the "Premises").

3. The Sheriff of Cumberland County, Pennsylvania (the "Sheriff') sold the
Premises to Plaintiff at Sheriffs sale after due advertisement and according to law on or
about December 8, 1999.
4. The Sheriffs sale was authorized by virtue of a Writ of Execution issued to
satisfy a Judgment of Mortgage Foreclosure which was entered in a foreclosure action
entitle(;lChase Bank of Texas flkla Texas Commerce Bank. N.A. as Custodian vs.
JosephC. Carminati, No. 99-2839 in the Court of Common Pleas of Cumberland
County, Pennsylvania. Joseph C. Carminati was the sole record owner of the Premises
immediately prior to sale by the Sheriff.
5. The Sheriffs deed conveying ownership of the Premises to Plaintiff was
recorded in the Office of the Recorder of Deeds of Cumberland County in Book 213,
Page 909 on December 23, 1999.
6. Having acquired title by virtue of the Sheriffs sale on December 8,1999,
Plaintiff is now the record owner of the Premises where Defendants reside and
therefore, has a right to immediate possession of the Premises.
7. Defendants Joseph C. Carminati and/or any and all unknown occupants,
upon information and belief, are occupying the Premises, have no valid legal right to
possession of the Premises and are in possession without rig ht and claim of title.
8. Plaintiff has the right to immediate possession of the Premises to the
exclusion of each and all of Defendants.

WHEREFORE, Plaintiff seeks judgment against each and all of Defendants in
ejectment for immediate possession of the Premises, issuance of a Writ of Possession,
costs and such other relief as the Court deems appropriate or necessary.

Cumberland, State of Pennsylvania, bounded and described as follows, to wit:
BEGINNING at the Southwest corner of lot of ground formerly of John B.
Beidler, now of Mrs. Mary Oiler; thence by lot of the said Mrs. Mary Oiler, south
sixty-five (65) degrees East Thirty-one (31) feet Eleven (11) inches to a post;
thence by the same South Fifty-one (51) degrees East Sixty-three (63) feet Two
(2) inches to a post; thence by the same South Forty-one (41) degrees East

3. The Sheriff of Cumberland County, Pennsylvania (the "Sheriff") sold the
Premises to Plaintiff at Sheriff's sale after due advertisement and according to law on or
about December 8, 1999.
4. The Sheriff's sale was authorized by virtue of a Writ of Execution issued to
satisfy a Judgment of Mortgage Foreclosure which was entered in a foreclosure action
entitled Chase Bank of Texas f/k1a Texas Commerce Bank. NA as Custodian vs.
Joseph C. Carminati, No. 99-2839 in the Court of Common Pleas of Cumberland
County, Pennsylvania. Joseph C. Carminati was the sole record owner of the Premises
immediately prior to sale by the Sheriff.
5. The Sheriff's deed conveying ownership of the Premises to Plaintiff was
recorded in the Office of the Recorder of Deeds of Cumberland County in Book 213,
Page 909 on December 23, 1999.
6. Having. acquired title by virtue of the Sheriff's sale on December 8, 1999,
