STIPULATION AGAINST LIENS
THIS AGREEMENT made the 7th day of February, 2000, by and between KOSTY AK
HOME BUILDERS, hereinafter referred to as Contractor, and BRADLEY W. KOSTY AK and
BARBARA A. KOSTY AK, hereinafter referred to as Owner, whereby the former undertook and
agreed to erect and construct a custom built home on that certain lot of ground situate at Lot No. 91,
Indian Hills-Section 2, South Middleton Township, Cumberland County, Pennsylvania, more fully
described in Exhibit "A" attached hereto and made a part hereof.
NOW THEREFORE, WITNESSETH: That the said Contractor, for and in consideration of
the sum of ($1.00) Dollar to Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the ,agreement aforesaid, for themselves
and their subcontractors, and all parties acting through or under them, covenant and agree that no
mechanic's liens or claims shall be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on account of any work done or materials
furnished by them or any of them under said contract or otherwise, for, towards, in, or about the
erection and construction of the said buildings on the lot above described, and the said Contractor,
for themselves, their subcontractors and others under them hereby expressly waive and relinquish
the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any
of them, and agree that this instrument, waiving the right of lien, shall be an independent covenant.

BEGINNING at a point along the western right of way line of Poplar Drive (50 feet right of way)
at the dividing line between Lot No. 91 and Lot No. 92 of the afore-mentioned subdivision plan;
thence along said western right of way line of Poplar Drive on a curve to the right having a radius
of 175.00 feet and an arc length of 18.65 feet to a point; thence along said right of way South 14
degrees 09 minutes 56 seconds West a distance of78.62 feetto a point; thence continuing along said
right of way on a curve to the left having a radius of225.00 feet and an arc length of 15.54 feet to
a point at the dividing line between Lot No. 90 and Lot No. 91; thence along said dividing line South
86 degrees 41 minutes 44 seconds West a distance of142.12 feet to a point; thence North 10 degrees
12 minutes 20 seconds East a distance of 111.09 feet to a point at the dividing line between Lot No.
91 and Lot No. 92; thence along said dividing line North 86 degrees 41 minutes 44 seconds East a
distance of 148.56 feet to a point along the western right of way line of Poplar Drive (50 feet right
of way), the point and place of BEGINNING.
CONTAINING 15,722.11 square feet.
LOT No. 91 is subject to all associated rights and provisions of a 30 feet wide Storm Drainage
Easement
LOT No. 91 is subject to all applicable notations and conditions set forth by final subdivision plan
approval ofIndian Hills, Section No. II.
