WHEREAS, Carlisle Cement Products Co., Inc. of 510 East North Street, Carlisle, Pennsylvania
17013, is about to enter into a contract with R. S. Mowery & Sons, Inc., of Mechanicsburg,
Pennsylvania, for the construction of an addition and renovation for offices and showroom
located at 510 East North Street, Borough of Carlisle, Cumberland County, Pennsylvania.
NOW, October 18, 2002, at the time of and immediately before the execution of the principal
contract, and before any authority has been given by the said Carlisle Cement Products Co., Inc. to
the said R. S. Mowery & Sons, Inc., to commence work on the said building, or purchase materials
for the same in consideration of the making of the said contract with R. S. Mowery & Sons, Inc.,
and the further consideration of One Dollar to R. S. Mowery & Sons, Inc., paid by Carlisle Cement
Products Co., Inc., it is agreed that no lien shall be filed against the building or property by the
contractor, nor any subcontractor, nor by any of the material men or workmen nor any other person
for any labor, or materials purchased, or extra labor or materials purchased for the completion of
said building, the right to file such liens being expressly waived.
