RUBIN, individually and t/a LANATA, INC., t/d/b/a MIDAS AUTO SYSTEMS EXPERTS, NO. 2000 - CML Defendants JURY TRIAL DEMANDED COMPLAINT AND NOW, comes Plaintiff, Robert M. Clarke, by and through his attorneys, MARTS ON DEARDORFF WILLIAMS & OTTO, and avers as follows: 1. Robert M. Clarke (hereinafter "Plaintiff"), is an adult individual residing at 590 Baltimore Pike, Mt. Holly Springs, Cumberland County, Pennsylvania 17065. 2. Lanata, Inc., (hereinafter "Lanata"), is a Pennsylvania corporation with its principal place of business located at 1952 East Third Street, Williamsport, Pennsylvania 17701. 3. Lanata reguIar1y trades and conducts business in Cumberland County as "Midas Auto Systems Experts,"located at 4909 Carlisle Pike, Mechanicsburg, Cumberland County, Pennsylvania 17055 (hereinafter "Midas"). 4. Daniel E. Rubin is an adult individual believed to be residing at 1005 Washington BouIevard, Williamsport, Pennsylvania, 17701. He serves as Chief Executive Officer and Secretary of Lanata. 5. James E, Rubin is an adult individual believed to be residing at 313 Shanelly Drive, Port Matilda, Pennsylvania, 16870. He serves in the capacity of Executive Vice-President and Treasurer ofLanata. 6. In or about January, 1997, Plaintiff was hired by Defendants as a manager of Midas in Mechanicsburg. 7. As a condition of his employment, Plaintiff was required to own and store at Midas various personal tools necessary to perform his job duties. "0 _ -~_ ,-j,_ 8. On or about June 11, 1998, a theft occurred at Midas during which Plaintiff had a majority of his personal tools stolen. A true and accurate copy of the Police Report is attached as Exhibit "A." The perpetrator was never found or apprehended. 9. Defendants, through Daniel E. Rubin, offered to replace Plaintiff's tools through a piecemeal arrangement with a "Snap-On" brand tool dealer, pursuant to which Plaintiff was permitted to order replacement tools over a period of time from a Snap-On salesman, who would be paid from the Midas cash register at a rate of $75.00 per week. 10. Plaintiff accepted Defendants' offer and in return, agreed not to institute civil proceedings against Defendants to recover his stolen tools. COUNT I BREACH OF CONTRACT 11. Paragraphs 1 through 10 are incorporated herein by reference as if set forth in their entirety. 12. Pursuant to the parties' oral agreement, Plaintiff ordered replacement tools from a "Snap-On" salesman through an account opened for Midas. A true and accurate copy of the "Snap- On"/Midas Account is attached hereto as Exhibit "B." 13. As of November 17, 1998, Plaintiff had ordered and received various replacement tools, which had been paid for by Midas. 14. Defendants ceased paying for Plaintiff's replacement tools on or about November 17, 1998, at which time Plaintiff ceased ordering from the "Snap-On" salesman. 15. On or about November 8, 1998, Defendants terminated Plaintiffs employment with Midas. 16. On or about November 17, 1998, Defendants stopped making payment on the "Snap- On" account with and refused to replace any more of Plaintiff's stolen tools. 17. The value of Plaintiffs un-replaced stolen tools is $4,850.05. plus $291.00 in Pennsylvania sales tax, forthe sum of $5, 141.05. A true and accurate summary of the replacement costs is attached hereto as Exhibit "C." 18. By failing to continue making payment and otherwise failing to reimburse Plaintiff for the value of his stolen tools, Defendants have breached the parties' oral agreement. '" .' 19. As a direct and proximate result of Defendants' breach of the parties' agreement, Plaintiff has suffered an economic loss of $5, 141.05. WHEREFORE, based upon the foregoing, P1aintiffrespectfuI1y demands judgment in his favor for the amount of $5,141.05, together with interest thereon and costs, and any other remedy this Court may deem appropriate.
