to commence work on the said building, or purchase materials
for the same in consideration of the making of the said contract with
King Construction Company
and the further consideration of One Dollar, to King Construction Company
paid by
Arlin D., Karla D., & Rick L. Wadel
, it is agreed that no lien shall be filed against the building by the
contractor, or any sub-contractor, nor by any of the material men or workmen or any other person for any labor, or
materials purchased for the erection of said building, the right to file such liens being expressly waived.

LEGAL DESCRIPTION
ALL the certain tract of real estate lying and being situate in the Township of
Southarnpton, County of Cumberland and Commonwealth of Pennsylvania,
bounded and described as follows:
BEGINNING at a stone in the middle of the public road at the point where a
private road belonging to the land herein described meets the said public road;
thence with the Southeastern edge of the middle of the said public road, North
thirty-six and three fourths (36 3/4) degrees West, forty-three and nine tenths
(43.9) perches to a stake in the said public road at a school house lot; thence
with the said school house lot, North forty-four (44) degrees East, five and three
tenths (5.3) perches to a stone; thence North sixty-six and one fourth (66 1/4)
degrees East, thirty-four and one tenth (34.1) perches to a stake; thence North
seventeen and one fourth (17 1/4) degrees East, sixty-five (65) perches to a pine
stump at land now or formerly of Christian Long's heirs, thence by lands of
Christian Long's heirs; North thirty-two (32) degrees East, one hundred three and
five tenths (103.5) perches to a stake; thence with same lands, North forty-eight
(48) degrees East, thirty-seven and six tenths (37.6) perches to a post; thence
South fifty (50) degrees forty (40) minutes East, one hundred thirty-five and six
tenths (135.6) perches to a post; thence with land now or formerly of Samuel
Baker's heirs, South fifty-five and one fourth (55 1/4) degrees West, one
hundred eighteen and two tenths (118.2) perches to a stone at corner of a
private road; thence South sixty-three and one fourth (63 1/4) degrees West,
forty-six (46) perches to a stone, being the private road first heretofore
mentioned to a stone on the edge of the said private road; thence South fifty-five
(55) degrees fifty (50) minutes West, forty-six and nine tenths (46.9) perches to
a stone in the middle of the public road, being the point and place of
BEGINNING.
CONTAINING one hundred sixteen (116) acres and one hundred thirty-one (131)
perches, as per survey of S.J. Tritt, made December 20, 1984, and shown by a
draft from which this description is taken.
TOGETHER with a right-of-way leading to and from the above-described
premises from public road known as designated as Route 21006 as described in,
and UNDER AND SUBJECT TO, the provisions of certain Deed of Right-of-Way
dated August 18, 1965, and recorded in Cumberland County Miscellaneous Book
171, Page 95, which is included herein by reference.
BEING THE SAME premises which ARLlN D. WADEL and KARLA D. WADEL
by deed dated the 30th day of December, 1999, recorded in the office of the
Recorder of Deeds of Cumberland County in Deed Book Volume 214, Page 133,
granted and conveyed to ARLlN D. WADEL, KARLA D. WADEL and RICK L.
WADEL, the MORTGAGORS herein,
This DDrtgage has been executed by Rick L. Wadel to grant and
convey the property described herein as collateral security for
and in consideration of monies advanced, or to be advanced, by
the mortgage to Arlin & Karla Wadel, borrower(s), and evidenced
by a note or notes executed, or to be executed, by said borrower (s).
A default by the said borrower (s) in the repayment of such DDnies
advanced, or to be advanced, shall constitute a default hereunder and
shall subject the within described property to all rights and
remedies available to the DDrtgagee as provided for herein.

1. 1.0 acres conveyed to Thomas L Koser and Martha J. Koser, husband and wife, by deed
dated October 27, 1987, and recorded in Cumberland County Deed Book "A", Volume 33, at
Page 160.
2. 1.176 acres conveyed to Eber K. Leisher and Tammy J. Leisher, husband and wife, by deed
dated July 15, 1988, and recorded in Cumberland County Deed Book "L", Volume 33, at Page
845.
3. .970 acres conveyed to Kurt A. Frey and Dorothy A. Frey, husband and wife, by deed dated
July 28, 1988, and recorded in Cumberland County Deed Book "M", Volume 33, at Page 329.
4. .982 acres known as Lot # 4 on a Subdivision Plan prepared by John R Kissinger, RS.,
dated May 4, 1989, to be conveyed to Stewart M. Rockwell and Frances R Rockwell.
