ACTION TO OBTAIN JUDGMENT UPON MECHANICS' LIEN CLAIM
AND NOW, comes the Plaintiff, Middletown Lumber, Inc., by and through its
attorneys, Jonathan M. Crist, Esq., and Latsha Davis & Yohe, P.C, who, pursuant to
Pennsylvania Rule of Civil Procedure 1651, et seq., files the following Complaint to
foreclose a Mechanics' Lien of which the following is a statement:
1. Plaintiff is Middletown Lumber, Inc., a corporation organized and existing
under the laws of the Commonwealth of Pennsylvania, with a mailing address of P.O.
Box 304, Middletown, Pennsylvania 17057.
2. Defendants are Michael Scott Vencil and Nancy White Vencil, who are the
resident owners of the real property located at 3 Latchgate Lane, Mechanicsburg,
Pennsylvania 17055, which is the subject of the Mechanics' Lien Claim filed by the
Plaintiff.

3. The Mechanics' Lien Claim was filed by Plaintiff as subcontractor -
materialman to Harry G. Minnick, Jr., tf a Minnick Construction, 5217 Deerfield
Avenue, Mechanicsburg, Pennsylvania 17055.
4. A copy of the Mechanics' Lien Claim docketed to number 2000-782 MLD,
as filed in the Prothonotary's Office of the Court of Common Pleas of Cumberland
County is attached hereto as Exhibit" A".
WHEREFORE, Plaintiff, Middletown Lumber, Inc., demands judgment against
the Defendants, Michael Scott Vencil and Nancy White Vencil in the sum of One
Thousand Two Hundred Fifteen and 77/100 Dollars ($1,215.77) plus applicable interest
and costs of this action.

MECHANIC'S LIEN CLAIM
L Claimant is Middletown Lumber, Inc., Brown and Clinton Streets, P.O.
Box 304, Middletown, Pennsylvania 17057, who asserts this Claim as 'Subcontractor
Materialman.
2. The Owner, or reputed Owners, are Michael Scott Vencil and Nancy
White Vencil, 3 Latchgate Lane, Mechanicsburg, Pennsylvania 17055.
3. Claimant supplied Sikkens Cetol stain on November 2, 1999; November 4,
1999 and November 12, 1999, which was applied upon a new attached garage and
storage room addition at 3 Latchgate Lane, Mechanicsburg, Pennsylvania 17055.
4. Claimant provided the materials to or at the request of Harry G. Minnich,
Jr., t/a Minnich Construction, 5217 Deerfield Avenue, Mechanicsburg, Pennsylvania
17055, who, at the time said materials were supplied, was acting as the general
contractor under contract with the Owner or Reputed Owners, Michael Scott Vencil and
Nancy White Vencil, for the construction of the aforesaid attached garage and storage
room addition.
5. The amount claimed to be due is One Thousand Two Hundred Fifteen
and 77/100 ($1,215.77) Dollars in accordance with the invoices attached hereto as
Exhibit" A" incorporated herein by reference.
6. Claimant gave Formal Notice to the Owner of its Intention To File
Mechanic's Lien, which was served on the Owner on January 5, 2000, by certified mail,
return receipt requested. A copy of the Formal Notice of Intention To File Mechanic's
Lien is attached hereto as Exhibit "B". The receipt for certified mail and accompanying
executed certified mail receipt card are attached as Exhibit "C". A written
acknowledgment of receipt of the Notice of Intent To File Mechanic's Lien signed by the

hereto as Exhibit "D".
7. The address of the property which is to be subject to the lien is 3 Latchgate

This correspondence is in response to your Notice ofIntent to file a mechanics
lien on behalf of Middletown Lumber, notwithstanding the documentation that we
provided you in our prior correspondence of December 16, 1999. As that documentation
showed, the outstanding monies are owed by the general contractor, Harry G. Minnick
Jr., and not us, the homeowners; but, still you persist in pursuing us.
Accordingly, should you file a mechanics lien, please be assured that we will
move promptly, through counsel, to have the lien stricken; and, we will seek counsel fees

I, Edward M. Costik, verify that I am the President of Middletown Lumber, Inc.,
and authorized to take this Verification on it's behalf. The above MECHANIC'S LIEN
CLAIM is based upon information which we have furnished to our counsel and
information which has been gathered by our counsel in preparation of this matter. The
language of the MECHANIC'S LIEN CLAIM is that of counsel and not of us. I have
read the MECHANIC'S LIEN CLAIM and to the extent that the MECHANIC'S LIEN
CLAIM is based upon information which we have given to our counsel, it is true and
correct to the best of my knowledge, information, and belief. To the extent that the
content of the MECHANIC'S LIEN CLAIM is that of counsel, we have relied upon
counsel in making this verification. I hereby acknowledge that the facts set forth in the

3. Claimant supplied Sikkens Cetol stain on November 2,1999; November 4,
1999 and November 12, 1999, which was applied upon a new attached garage and
storage room addition at 3 Latchgate Lane, Mechanicsburg, Pennsylvania 17055.
4. Claimant provided the materials to or at the request of Harry G. Minnich,
Jr., t/a Minnich Construction, 5217 Deerfield Avenue, Mechanicsburg, Pennsylvania
17055, who, at the time said materials were supplied, was acting as the general
contractor under contract with the Owner or Reputed Owners,.Miehael Scott Vencil and
Nancy White Vencil, for the construction of the aforesaid attached garage and storage
room addition.
5. The amount claimed to be due is One Thousand Two Hundred Fifteen

AND NOW, comes the Defendants/Owners, Michael Scott Vencil and Nancy White
Vencil, pro se parties, responding to Plaintiff's Action To Obtain Judgement Upon Mechanics'
Lien Claim, and requesting that said Action and Claim be denied.

NEW MATTER
1. Defendants have heretofore responded to Plaintiff's correspondence of December

7,1999 relative to Plaintiff instituting proceedings with regard to a mechanic's
lien claim against Defendants. Whereby, Defendants answered and presented
relevant documentation, attached hereto as Exhibit "I", to show that:
a. Defendants entered into an agreement with Harry G. Minnick
Jr./Minnick Construction (General Contractor) on September 16,1999
to construct a garage addition on Defendants' property, a copy of the
construction agreement is attached hereto as Exhibit "2".
b. Minnick Construction was terminated on November 19,1999, due to
unworkmanlike performance, incompetence, and waste.
c. Defendants paid Minnick Construction for all materials and labor
provided through their termination. To which, a sizeable down
payment prior to starting construction, equaling 1/3 % of the total
contract price (check #205 dated September 18, 1999 for $9,000.00)
was required by, and paid to, Minnick Construction to cover all
materials, inclusive of products (stain) provided by Plaintiff.
Furthermore, a payment of $9,000.00 (check #210 dated October
8,1999) was made to Minnick Construction to cover all labor provided
through their termination. However, Minnick Construction did not
provide the Defendants with all products and services for which they
were paid.
d. Accordingly, the products in dispute were contracted by Minnick
Construction, and received by Defendants prior to Minnick
Construction's termination.
e. Moreover, disputed amounts reflected in Plaintiffs invoice show a
charge for four gallons of stain (#009) not received by Defendants. As
does Plaintiffs invoice (attached to their December 7, 1999
correspondence) not reflect a credit for nine gallons of stain returned
to the Plaintiff.
As such, Plaintiff has been repeatedly informed of this fact (the
Defendants' correspondence of December 16, 1999, etc.), but Plaintiff
refuses to adjust invoice accordingly (from $1,215.77 to $1,078.93).
5. Consequently, Defendants have sustained undue costs resulting from Minnick
Construction's inferior work product, and subsequent actions. Whereby, said
costs to complete the garage addition, and make repairs to Minnick
Construction's inferior work currently exceed $ 41,000.00, well beyond the
price quoted in Defendants' contract ($27,000.00). Accordingly, it would be
of further injury to the Defendants to incur legal fees and costs to answer this
matter, and or be forced to pay for products previously paid for by Defendants

6. And notwithstanding that Defendants have had a long standing history with
Plaintiff; of faithfully paying for all products provided by Plaintiff. Whereby,
the Defendants are deeply troubled with Plaintiff's recent mishandling of this
matter; and Plaintiff's persistence in harassing Defendants for monies owed
on said products, previously paid for by the Defendants, and contracted by
Minnick Construction.
WHEREFORE, the Defendants respectfully request that this Honorable Court strike
(deny) the Plaintiff's Mechanics' Lien and Action to Obtain Judgment, deny Plaintiff's request
for fees; OR in the alternative, grant Defendants legal fees and costs, and grant a jury trial.

Dear Mr. Y ohe:
This letter is response to your correspondence dated December 7, 1999, in which you
allege that we owe your client one thousand ninety-three dollars and eight cents ($1,593.08) for
Si~k~ns stain, even though your client was informed by both the general contractor, Harry
Mmmck, and myself. that the costs of this stain was to be borne by Minnick Construction.
Mr. Minnick's counsel's allegation that "an agreement" exits between I and Mr. Minnick,
to the effect I would take responsibility "for obtaining the stain and staining the cedar siding" is
untrue. To the contrary, Mr. Minnick received a sizeable down payment to pay for all materials,
inclusive of the stain; and, further it was his responsibility, in accordance with our contract, to do
the staining.

With regard to the allowance that his counsel alluded to, this amount is the amount that
Mr. Minnick stated he would deduct for materials and labor, if the homeowner opted to do the
staining. In lieu of the fact that the allowance was unusually low, we opted not to stain the
project ourselves. This fact is evidenced in the enclosed pertinent pages from the contract.
Due to Mr. Minnick's repeated mistakes and gross mismanagement of the project, as even
your client attested on several occasions; he was dismissed, even though he did not perform all of
the services, nor provide all of the materials that he was paid for. When Mr. Minnick was
dismissed on November 19, 1999, I informed your client of such.
It should further be noted that your client's invoice is in error. On November 11, 1999.
nine (9) gallons of stain were returned and the credit for such is not reflected in the final invoice.
In addition, your client's invoice reflects that eight (8) gallons of#009 were received, when in fact
only four (4) gallons were received. Therefore, the' adjusted amount should be one thousand
seventy-eight dollars and ninety-three cents [($1,078.93) plus tax, if applicable], and not one
thousand five hundred ninety-three dollars and eight cents ($1,593.08), that is owed by Minnick
Construction.

Also enclosed. see my paid receipt for a gallon of stain that I received from your client
during the construction. Note that I was !charged forty three dollars and ninety-five ($43.95) per
gallon upon receipt. and not the contract0(price of thirty nine doll~rs and fifty-five cents
($39.55), which was to be charged to th~col)!ractor. The fact that: I paid for this stain further
demonstrates that your client was fully cqg~i~ant that I was not responsible for the stain in

Dear Ms. VendI:
This office represents Middletown Lumber Company. We understand that you contracted
with Harry G. Minnich, Inc. regarding a garage addition. As part of this contract, there was a
contract allowance of $2,200 representing stain and labor for staining of cedar siding to be placed
on the garage addition. In our discussions with Mr. Minnich's attorney, Keith Brenneman, we
have been advised that there was an agreement between you and Mr. Minnich that you would
taken responsibility for obtaining the stain and staining the cedar siding. It is our further
understanding that you obtained the various shades of stain from Middletown Lumber. We were
further advised that you were made aware of Middletown Lumber's policy on the return of
unopened and unused stain for credit.
We have been advised that Mr. Minich has not received any payment from you for
providing materials or services with respect to the staining of the cedar siding. As such, it is our
position that you were responsible for the cost of the stain. Enclosed is an invoice from
Middletown Lumber as to this cost.
Unless you notify us within thirty (30) days after receipt of this letter that you dispute the
validity of this debt or any portion thereof, we will assume that this debt is valid and demand
immediate payment. If you notifyus in writing within thirty (30) days after the receipt of the
notice that you dispute the debt or any portion thereof, we will obtain verification of the debt and
mail same to you. Any information that you provide will be used in the collection of the debt. If
payment is not received, Middletown Lumber may institute legal proceedings to collect the
balance due.
