COMPLAINT
1. Plaintiff is Harris Savings Bank, a Pennsylvania state-chartered savings
bank, with its principal office at 235 N. Second Street, P.O. Box 1711, Harrisburg,
Pennsylvania 17105.
2. Defendant Angela M. Clouse, is an adult individual living and residing at
15 Winchester Gardens, Carlisle, Pennsylvania 17013.
3. Defendant Harry S. Miller, Jr., is an adult individual living and residing at
6 Oak Hill Road, Carlisle, Pennsylvania 17013.
4. Defendants, as buyer, entered into a Pennsylvania Motor Vehicle
Installment Sale Contract with West Shore KIA, as seller, respecting a 1999 Kia Sephia
Sdn, VIN #KNAFB1216X5758614. A true and correct copy of the said Pennsylvania
Motor Vehicle Installment Sale Contract is attached hereto, made a part hereof and
marked Exhibit A.

5. The Contract was subsequently assi ned to Plaintiff.
6. Defendants defaulted in their obligati ns under the Contract, and the
Vehicle was repossessed.
7. On December 6, 1999, Plaintiff sold t e Vehicle, leaving a deficiency
balance owing in the amount of $8,676.77.
8. Despite Plaintiff's repeated demands, Defendants have failed and refused
and continue to fail and refuse to pay the current b lance owed to Plaintiff under the
Contract.
WHEREFORE, Plaintiff demands judgment gainst Defendants in the sum of

1. Admitted.
2. Admitted in that Angela Smith was known as Angela M. Clouse.
3. Admitted that he is Harry S. Miller, Jr. living at 6 Oak Hill Road, Carlisle,
Pennsylvania, and also that he is the grandfather of Angela M. Clouse, now Angela
Smith.
4. Denied that Harry S. Miller was a buyer that entered into a Pennsylvania
Motor Vehicle Installment Sale Contract with West Shore Kia. Admitted that Harry S.
Miller signed the contract to assist his granddaughter in the purchase of the 1999 Kia
Sephia Sedan.
5. After reasonable investigation he is without knowledge or information
sufficient to form a belief as to the truth of the averment.
6. Denied that Harry S. Miller was the buyer of the vehicle and that he
defaulted under the contract as he was unaware that his granddaughter, who was the
buyer, was not making payments. The averments in Paragraph 4 are incorporated herein.
7. Denied after reasonable investigation the party is without knowledge or
information sufficient to form a belief as to the truth of the averment.

8. Defendant Harry S. Miller, Jr. was not a buyer and is not obligated to
make any payment to plaintiff. The averments in Paragraph 4 are incorporated herein.
WHEREFORE, defendant Harry S. Miller, Jr. requests the Court to dismiss the
complaint against him.
NEW MATTER
Paragraphs I thru 8 are included herein and made a part hereof.
9. Defendant accompanied his granddaughter to the dealership as she
intended to buy a car which she did.
10. Defendant did not know that he was listed as the buyer on the Installment
Contract and had no intention to become the owner.
II. Defendant placed his signature where he was told to sign by the sales person.
WHEREFORE, defendant Harry S. Miller, Jr. did not own the vehicle and is not
liable for any deficiency after resale and requests the Court to enter judgment in the favor
of defendant and against the plaintiff and to dismiss the complaint against him.
COUNTERCLAIM
Paragraphs I through II are incorporated herein.
12. Plaintiff was required on a default to dispose of secured property in a
commercially reasonable manner.
13. The cash price of the new '99 Kia Sephia Sedan, serial number
KNAFBl216Y5758614 on February II, 1999 was $14,969.

14. The new '99 Kia Sephia Sedan was sold for $6,292.33 on December 6, 1999.
