COMPLAINT - CIVIL ACTION AND NOW, comes the Plaintiff, Ford Motor Credit Company, by its attorneys, Law Offices of Donald S. Mazzotta, P.C., and respectfully presents its complaint in civil action against the Defendants above-named upon a cause of action whereof the following is a statement: 1. Ford Motor Credit Company is a corporation doing business at P.O. Box 6508, Mesa, AZ 85216 and is hereinafter referred to as "Plaintiff." 2. Mark Rundall is an individual residing at 302 3rd Street, Enola, Cumberland County, Pennsylvania, and Lisa Rundall is an indi vidual residing at 8 Dulles Dr #12H, Camp Hill, Cumberland County, pennsyl vania, and both are hereinafter referred to as -k: {, -~. "Defendants." 3. Defendants entered into a written Lease agreement (hereinafter "Lease") for personal property. Defendants agreed to pay Plaintiff under the terms of Lease. A copy of Lease is marked Exhibit "A", attached hereto and made a part hereof. 4. Plaintiff is the holder of Lease and is entitled to payment under the terms thereof. 5. Defendants are in default for failing to pay in accordance with Lease terms, and Plaintiff incurred a loss in the amount of $5,617.35. 6. Plaintiff is entitled to interest at 6.000% per annum. 7. Demand for payment has been made upon Defendants, but Defendants have failed or refused to pay. 8. Under the terms of Agreement, Plaintiff is entitled to reasonable attorney's fees of 20% of the outstanding balance due, in the sum of $1,123.47. WHEREFORE, Plaintiff seeks judgment against Mark Rundall and Lisa Rundall in the amount of $6,740.82 plus interest from December 16, 1998 to date of judgment and costs of suit. RUNDALL, by and through her attorneys, Irwin, McKnight & Hughes, respectfully submits this Brief in Support of her Motion for Summary Judgment pursuant to Pa.R.C.P. No. 1035. I. FACTS Plaintiff, Ford Motor Credit Company, initially filed a civil complaint on or about February 15,2000, against Mark Rundall and Lisa A. Rundall in the Court of Common Pleas of Cumberland County, Pennsylvania. Plaintiffs Complaint alleges that both Defendants entered into and executed a written Motor Vehicle Lease Agreement. (PI. Compl. '\I 3, Ex. "A".) Plaintiffs Complaint further alleges that Defendants defaulted under the terms of said lease agreement by failing to pay in accordance with its terms. (PI. Compl. '\1'\15-8.) On or about April I?, 2000, Defendant Lisa A. Rundall filed an Answer with New :v1atter to Plaintiffs Complaint, including New Matter Pursuant to Fa.R.C.P. No. 2252(d). Defendant " "' ~"","~, Lisa A. Rundall's New Matter averred that she did not sign, execute or otherwise consent to the application of her name to the Motor Vehicle Lease Agreement, but instead that Defendant Mark Rundall unilaterally and intentionally forged her signature. (Def.'s Answer ~~ 12-15, 20-22.) Defendant Mark Rundall did not file a response to said new matter. On or about April 19, 2000, Plaintiff Ford Motor Credit filed a Praecipe for Default Judgment only against Mark Rundall, for the total amount allegedly due under Plaintiffs Complaint. On or about November 16, 2000, Defendant Lisa A. Rundall filed a Request for Admissions to Defendant Mark Rundall, pursuant to Pa.R.C.P. No. 4014. Defendant Mark Rundall was served with said Request for Admissions on November 18,2000, by certified mail. (Def. 's Mot. Summ. J. ~ 6, Ex. "A".) Defendant Mark Rundall failed to admit, deny or otherwise answer said Request for Admissions, within thirty (30) days from receipt thereof. Therefore, said Requests for Admission are deemed admitted by Defendant Mark Rundall pursuant to rule 4014(b) of the Pennsylvania Rules of Civil Procedure. By virtue of his failure to answer, Defendant Mark Rundall has therefore admitted he was employed by the dealership, L.B. Smith Lincoln-Mercury, on October 24, 1996, the date of Plaintiffs Pennsylvania Motor Vehicle Lease Agreement. (Def.'s Mot. Summ. J. ~ 9.) By virtue of his failure to answer, Defendant Mark Rundall further admitted that Lisa A. Rundall was not present when the lease agreement was allegedly executed. (Def.'s Mot. Summ. J. ~ 10.) Defendant Mark Rundall further admitted that his spouse did not sign or execute her nanle to the lease agreement. (Def.'s Mot.Summ. J ~ 11.) Defendant Mark Rundall also admitted that his spouse did not consent to the application of her name to the lease agreement, (Def.'s Mot. Summ. J. ~ 12), nor did she have any knowledge that her name was applied to or placed upon the 2 ~ "~.. lease agreement prior to the service of Plaintiff's Complaint (Def.'s Mot. Summ. J. ~ 13). Finally, Defendant Mark Rundall admitted that he unilaterally and intentionally affixed Lisa A. Rundall's signature upon the lease agreement without her knowledge, consent or consultation. (Def.'sMot. Summ. J. ~ 14.) By virtue of Defendant Mark Rundall's admiss;(.ns in this matter, on or about December 28, 2000, Defendant Lisa A. Rundall filed a Motion for Summary Judgment pursuant to Pa.R.C.P. No. 1035. Plaintiff has already obtained a default judgment against Defendant Mark Rundall, and by his admissions his spouse is entitled to be dismissed as a party to this action. II. QUESTION PRESENTED 1. Whether a genuine issue of material fact exists as to whether Defendant Lisa A. Rundall's husband unilaterally and intentionally forged her signature upon Plaintiff's Motor Vehicle Lease Agreement without her prior knowledge, consent or consultation? Suggested Response: NO 2. Whether a genuine issue of material fact exists as to whether the unauthorized use of Defendant Lisa A. Rundall's signature, capable of producing prejudice to heL precludes the attachment of liability to her under Pennsylvania law? Suggested Response: NO III. ARGUMENT A. Standard of Review. After the relevant pleadings are closed, Pa.R.Civ.P. No. 1035.2 provides that a party may move for summary judgment as a matter of law: 3 L__ ~" -'-."~~>--' (1) whenever there is no genuine issue of any material fact as to a necessary element of the cause of action or defense which could be established by additional discovery or expert report, or (2) if, after the com]1letion of discovery relevant to the motion, including the production of expert reports, an adverse party who will bear the burden of proof at trial has failed to produce evidence of facts essential to the cause of action or defense which in a jury trial would require the issues to be submitted to a jury. See also McCarthv v. Dan Lepore & Sons Co.. Inc., 724 A.2d 938, 940 (Pa. Super. 1998). "A proper grant of summary judgment depends upon an evidentiary record that either (1) shows the material facts are undisputed or (2) contains insufficient evidence of facts to make out a prima facie cause of action or defense and, therefore, there is no issue to be submitted to the jury." Id. at 940. If upon review of the entire record the trial judge determines that there is no genuine issue of material fact, and that the moving party is entitled to a judgment as a matter of law, the entry of summary judgment is warranted. Snyder v. Specialty Glass Products. Inc., 441 Pa. Super 613, 658 A.2d 366, 373 (1995). Applying these standards to Defendant Lisa A. Rundall's Motion for Summary Judgment, it is clear that no genuine issue of material fact exists with regard to the forgery of her name to Plaintiffs Lease Agreement without her knowledge or consent. Through Requests for Admission served upon Defendant Mark Rundall, admission evidence is of record to establish 4 ~" t; that no genuine issues of material fact exist concerning the liability Defendant Lisa A. Rundall. Defendant Lisa A. Rundall is therefore entitled to summary judgment as a matter of law. B. No genuine issue of material fact exists as to whether Defendant Lisa A. Rundall's husband !milaterally and intentionally forged her ,~.ignature upon Plaintiff's Motor Vehicle Lease Agreement without her knowledge, consent or consultation. Pennsylvania Rule of Civil Procedure 4014(b) provides that each matter for which an admission is requested is admitted if the party to whom the requests are directed fails to file a response within thirty (30) days after service. Furthermore, the failure to file a timely response to a request for admissions may entitle the party requesting the admissions to a grant of summary judgment. See 9A Goodrich-Amram 2d ~ 4014(b):2. Defendant Mark Rundall was properly served with Requests for Admission by Defendant Lisa A. Rundall on November 18, 2000. To date, no response has been filed by Defendant Mark Rundall. He has therefore admitted that he was an employee of the dealership, L.B. Smith Lincoln-Mercury, on the date of the Plaintiff's Lease Agreement. He has admitted that Lisa A. Rundall was not present when the Lease Agreement was allegedly signed, nor did she sign or execute her name to the document. Defendant Mark Rundall has also admitted that she did not consent to or have knowledge of the application of her name to the agreement. Instead. Defendant Mark Rundall has admitted that he unilaterally and intentionally affixed Lisa A. Rundall's signature upon the Lease Agreement without her knowledge, consent or consultation. Accordingly, no genuine issue of material fact exists as to Defendant Mark Rundalr3 forgery of his wife's name in this matter. 5 'o-.w.-'.~ ~" lIOIllk"l.< C. No genuine issue of material fact exists as to whether the unauthorized use of Defendant Lisa A. Rundall's signature, capable of producing prejudice to her, precludes the attachment of liability to her under Pennsylvania law. In the case of Mellon Bank v. Holub, 400 Pa. Super. 360, 583 A.2d 1157 (1990), a creditor sought recovery from a spuuse l,mder a loan guaranty. In Holub, The Superior Court affirmed the ultimate decision of the trial court which held that husband had affixed wife's signature to the loan guaranty. In addition, the trial court held that because without the use of her name no liability could attach to the wife, the husband's actions would constitute the crime of forgery. Id. 583 A.2d at 1160. Therefore, unless the wife actually placed her signature on the loan guaranty and agreed to be bound by it, no liability could attach to her. The fact that the wife had executed an earlier commitment letter to sign the loan guaranty did not change the result. Id. at 1160. The Superior Court further rejected the argument that wife was equitably estopped from denying the validity of her signature as a result of her having reaped certain benefits from the creditor's approval of the loan. Id. at 1160-1161. In the instant action, Defendant Mark Rundall has admitted that he unilaterally and intentionally affixed his wife's signature upon the Plaintiff's Lease Agreement without her knowledge, consent or consultation. Without her actual signature on the document, no liability would attach to Defendant Lisa A. Rundall. Defendant Mark Rundall has also admitted that he worked at the dealership at the time and that his wife did not have any knowledge that her name was placed on the lease document prior to the service of Plaintiff's Complaint. Accordingly under the holding in Holub, Defendant Lisa A. Rundall is not equitably estopped from denying 6 , ~"""~;'I liability even though prior to their separation she may have received some small benefit of their family having the use of an additional vehicle. Given the admissions made by Defendant Mark Rundall, the Superior Court's holding in Mellon Bank v. Holub, and the fact that Plaintiff has already obtained a default judgt!1ent against Defendant Mark Rundall in this matter, no genuine issue of material fact exists in this matter regarding any liability of Defendant Lisa A. Rundall. Her Motion for Summary judgment should therefore be granted and she should be removed as a party to this action. IV. CONCLUSION For the reasons set forth above, Defendant Lisa A.
