COMPLAINT
The Plaintiffs, MAN M. DU and DEENA M. DU, his wife, by
their Attorney, Gregory R. Reed, Esquire, make the following
Complaint:
1. Plaintiffs, MAN M. DU and DEENA M. DU, (hereinafter
referred to as ~Plaintiffs") are husband and wife and adult
individuals residing at 302 South Market Street, Apt. 2,
Mechanicsburg, Cumberland County, Pennsylvania 17055.
2. Defendant, MAXINE S. GROUP, (hereinafter referred to as
~Group") is an adult individual residing at 647 Park Ridge Drive,
Mechanicsburg, Cumberland County, pennsylvania 17055.
3. Defendant, CTX MORTGAGE COMPANY, (hereinafter referred
to as ~CTX") is a corporation with an office located at 3
Crossgate Drive, l't Floor, Mechanicsburg, Cumberland County,
Pennsylvania 17055.
4. At all times relevant to this Complaint, Grace Dietrich
(hereinafter referred to as ~Dietrich") was an employee of CTX
and acted in the capacity of her employment.

5. On or about October 28, 1999, Group entered into a sales
agreement with Plaintiffs obligating Group to sell to Plaintiffs
real estate in the Ashcombe Products Company Development situate
at 647 Park Ridge Drive, Upper Allen Township, Cumberland County
(a copy of said agreement being attached hereto, marked Exhibit
"A" and incorporated herein by reference) .
6. Paragraph six (6) of said agreement provided, in part,
that the contract is contingent upon Plaintiffs obtaining a FHA
guaranteed mortgage no later than November 12, 1999.
7. On or about November 6, 1999 Plaintiffs applied for a
FHA mortgage with Dietrich and CTX.
8. Plaintiffs were first time homebuyers, ignorant of FHA
financing requirements, so that they relied totally on Dietrich
and CTX.
9. On or about November 19, 1999 Plaintiffs, their realtor
and their counsel were advised by Dietrich that no home in the
Ashcombe Products Company is eligible for a FHA mortgage.
10. On November 19, 1999 Plaintiffs' counsel faxed a letter
to Group's real estate agent, a copy of said letter being
attached hereto, marked Exhibit "BN and incorporated herein by
reference, advising him of the inability of the Plaintiffs to
obtain a FHA mortgage and requesting the return of the One
Thousand and 00/100 ($1,000.00) Dollars deposit money.
11. On or about December 10, 1999, after Plaintiffs acted
in reliance upon Dietrich's assertion that Plaintiffs could not

obtain a FHA mortgage, Dietrich advised Plaintiffs that she was
in error and that they could obtain a FHA mortgage.

12. Paragraphs 1 through 11 inclusive of this Complaint are
incorporated herein by reference.
13. Plaintiffs entitlement to a return of the deposit
monies and a release from the contract is clear and not in
dispute.
14. Nevertheless, Group, after repeated demands, has
unreasonably refused to authorize the return of Plaintiffs
deposit monies and release Plaintiffs from the contract.
15. On or about November 20, 1999 Group placed subject real
estate back on the market, returned it to "multi-list"
advertising and made it available for sale while refusing to
authorize the return of Plaintiffs' One Thousand and 00/100
($1,000.00) Dollars deposit and insisting that the aforesaid
contract was in force and binding on Plaintiffs.
16. Plaintiffs, since November 20, 1999, have desired to
enter into other contracts to purchase real estate but, because
of Group's refusal to authorize the return of the deposit monies
and release Plaintiffs from said contract, have been unable to do
so.
17. Plaintiffs have unnecessarily and as a direct result of
the inconsistent, contradictory, confusing and deceptive conduct

of Group incurred the cost of a title search, an appraisal fee
and attorney's fees which, to date total One Thousand Five
Hundred and 00/100 ($1,500.00) Dollars.
18. Group's continual refusal, in view of the clear,
unfulfilled contingency in the contract, to release Plaintiffs
from the contract in question and authorize the return of the
deposit monies is vexatious, unreasonable and obdurate behavior.
WHEREFORE, Plaintiffs bring this suit to recover from Group
the sum of Two Thousand Five Hundred and 00/100 ($2,500.00)
Dollars together with the cost of this suit, treble damages and
continuing attor~ey's fees.

19. Paragraphs 1 through 18 inclusive of this Complaint are
incorporated herein by reference.
20. Dietrich and CTX knew or should have known on or before
November 12, 1999 whether the subject property would be approved
for a FHA mortgage.
21. Dietrich held herself and her employer out to be
experts in the field of FHA mortgage financing.
22. Dietrich mislead, deceived and misinformed Plaintiffs
by advising them that they could not obtain a FHA mortgage when
they could have obtained a FHA mortgage.
23. Dietrich, knowing that Plaintiffs were relying upon
her, failed to investigate, inquire into and/or research, on a

timely basis, whether Plaintiffs could obtain FHA financing for
the purchase of the home in question.
24. In reliance upon Dietrich, Plaintiffs concluded they
could not obtain FHA financing and thus voided the contract and
demanded a return of their $1,000.00 deposit.
25. Dietrich and CTX used unfair and deceptive acts or
practices as defined in the Unfair Trade Practice and Consumer
Protection Law (hereinafter referred to as "UTPCPL"), 73 Pa.
C.S.A. ~ 201-4 and ~ 201-2(4) (vii), (ix) , (xvi) and (xxii).
26. Plaintiffs have unnecessarily and as a direct result of
the confusing and deceptive conduct of Dietrich and CTX incurred
the cost of a title search, an appraisal fee and attorney's fees
which, to date, total One Thousand Five Hundred and 00/100
($1,500.00) Dollars.
WHEREFORE, Plaintiffs bring this suit to recover from CTX
the sum of Two Thousand Five Hundred and 00/100 ($2,500.00)
Dollars along with the cost of this suit, treble damages and
continuing attorney's fees due to the fraudulent, deceptive,
vexatious, unreasonable and obdurate nature of Defendants'
conduct.

Dear Mr. Voigt:
Please be advised that I represent Man and Deena Du in the above referred to transaction.
On or about October 28, 1999 my clients provided you with a One Thousand and 00/100
($1,000.00) Dollar deposit on the contract.
Paragraph six (6) of the contract provides that the contract is contingent upon Buyers
obtaining a FHA Mortgage. The Buyers had quickly applied for the mortgage but were
eventually advised that the Association is not approved by FHA. As such, the Buyers cannot
obtain an FHA Mortgage.
I have spoken with you and a representative of CTX Mortgage. Both of you confirm the
Buyers inability to obtain an FHA Mortgage.
I understand that you have been advised by the Buyers that they do not intend to proceed
further with the contract. Please consider this a formal notice of the Buyers inability to proceed
with this contract.
Please return the Buyers One Thousand and 00/100 ($1,000.00) Dollars deposit
immediately. Do not mail it. Advise my office of its availability and my clients will pick up the
check and sign the Release. It is very important that this matter be addressed immediately.

PRELIMINARY OBJECTIONS OF DEFENDANT MAXINE S.
GROUP TO PLAINTIFFS' COMPLAINT
AND NOW comes Defendant MAXINE S. GROUP, by and through her attorneys, Irwin,
McKnight & Hughes, and makes the following Preliminary Objections to Plaintiffs' Complaint,
and in support thereof avers the following:
I. Preliminary Objeetion Raising Existenee of Arbitration Agreement Pursuant to Pa.
R. Civ. P. 1028(a)(6).
1. Plaintiffs, in their Complaint filed on or about February 15, 2000, seek damages
from Defendant Maxine S. Group (hereinafter "Group") for alleged breach of a written
Agreement of Sale with Plaintiffs, dated October 28, 1999, for the sale of property located at 647
Park Ridge Drive, Mechanicsburg, Upper Allen Township, Cumberland County, Pennsylvania
(see count I of Plaintiffs' Complaint).
2. Plaintiffs have asserted that they suffered harm because Defendant Group has not
released Plaintiffs from the Agreement of Sale and returned their deposit monies.
3. Plaintiffs attached to their Complaint as Exhibit "A" a copy of the written
Agreement of Sale between the parties dated October 28, 1999.
4. Paragraph Thirty (30) of said Agreement of Sale provides for mandatory
arbitration of all disputes arising under the contract.
5. Specifically, Section A of Paragraph Thirty (30) of the Agreement of Sale, as
elected by both Plaintiffs and Defendant Group, provides that: "Buyer and Seller will try to
resolve any dispute or claim that may arise from this Agreement of Sale through mediation, in
accordance with the Rules and Procedures of the Home SellerslHome Buyers Dispute Resolution
System. Any agreement reached through a mediation conference and signed by the parties will
be binding."
6. Plaintiffs have not demanded arbitration in accordance with the arbitration
provision of the Agreement of Sale, but instead commenced this action.
7. Defendant Group has, at all relevant times, been willing to arbitrate the dispute
which is the subject of this action.
8. Plaintiffs have breached the arbitration provision of the parties' Agreement of
Sale as elected by them, by commencing this action instead of submitting the dispute which is
the subject of this action to arbitration.
9. This Court has authority to compel arbitration and stay judicial proceedings
pursuant to 42 Pa. Cons. Stat. S 7304 (a) and (d).

WHEREFORE, Defendant Maxine S. Group respectfully requests this Honorable Court
to grant her Preliminary Objection and enter an order pursuant to Pa.R.Civ.P. 1028 (a)(6)
compelling Plaintiffs to submit the dispute which is the subject of this action to arbitration in
accordance with the arbitration provision of the parties' Agreement of Sale and staying all
proceedings in this action pending arbitration.
II. Preliminary Objeetion in the Nature of a Demqrrer pqrsuantto Pa. R. Civ. P.
1028(a)(4).
10. In Count I of the Complaint, Plaintiffs seek damages from Defendant Maxine S.
Group (hereinafter "Group") for alleged breach of a written Agreement of Sale with Plaintiffs,
dated October 28,1999, for the sale of property located at 647 Park Ridge Drive, Mechanicsburg,
Upper Allen Township, Cumberland County, Pennsylvania.
11. Plaintiffs have asserted that they suffered harm because Defendant Group has not
released Plaintiffs from the Agreement of Sale and returned their deposit monies.
12. In the wherefore clause following Count I, Plaintiffs request, among other
damages, costs of suit, treble damages and attorney's fees.
13. Plaintiffs do not allege in their Complaint against Defendant Group any actions or
violations of law by her justifying or supporting the recovery of costs of suit, treble damages and
attorney's fees.

14. Defendant Group preliminarily objects to Plaintiffs' Complaint on the grounds
that Plaintiffs have failed to plead any facts in their Complaint supporting the recovery of costs
of suit, treble damages and attoruey's fees.
WHEREFORE, Defendant Group respectfully requests this Honorable Court to grant
her Preliminary Objection in the nature of a demurrer and dismiss the claims in Plaintiffs'
Complaint against Defendant Group seeking recovery of costs of suit, treble damages, and
attorney's fees for failure to state causes of action upon which such relief may be granted.
