COMPLAINT
The Plaintiff, NORANDEX, INC., by its attorneys, KNUPP, KODAK & IMBLUM, P.c., brings this action of Assumpsit against
the Defendant to recover the sum of NINE IHOUSAND, EIGHT HUNDRED NINETY-SEVEN DOLLARS AND FOURTEEN CENTS
($9,897,14), along with interest thereon at the rate of one and one-half (I \1,%) percent per month from June 23, 1999, upon a cause of action
of which the following is a statement:
1. The Plaintiff, NORANDEX, INC., is a corporation organized and existing under the laws of the State of Ohio, having
its principal office and place of business at 8450 South Bedford Road, Macedonia, Ohio 44056.
2. The Defendant, WILLIAM S. BOISVERT, an adult individual, is trading and doing business as SHOWCASE CUSTOM
BUILDERS and has an office and place of business at 219 East Main Street, Mechanicsburg, Cumberland County, Pennsylvania 17055.
3. On the dates, in the amounts, and for the prices set forth in a true and correct copy of the Plaintiffs books of original entry
hereto attached, made a part hereof and marked Exhibit "A", Plaintiff, at the special instance and oral request of the Defendant, sold and
delivered goods, Wares and merchandise of the kind and description set forth on said Exhibit to the total amount of EIGHT THOUSAND,
THREE HUNDRED SIXTY -EIGHT DOLLARS AND FIFTY CENTS ($8,368.50).
4. The prices charged for said goods, wares and merchandise were just and reasonable, were the legal and market prices
therefor and were the prices which the Defendant orally promised and agreed to pay Plaintiff therefor.

5. Defendant become entitled to certain credits against the charges aforementioned, as more particularly shown on Exhibit
"B" attached hereto and made a part hereof, to the total amount of ONE HUNDRED TWENTY DOLLARS AND EIGHTY.EIGHT
CENTS ($120.88).
6. The balance due and owing by Defendant to Plaintiff is the sum of EIGHT THOUSAND, TWO HUNDRED FORTY-
SEVEN DOLLARS AND SIXTY-TWO CENTS ($8,247.62), as appears by the Statement of Account hereto attached, made a part hereof
and marked as Exhibit "B".
7. On or about January 21,1998, in order to induce Plaintiff to extend credit to him, Defendant did complete and execute
Plaintiffs Credit Application. A true and correct copy of said Credit Application is attached hereto, marked as Exhibit "C" and made a
part hereof.
8. Due to Defendant's default in payment of the monies due and owing to Plaintiff, and pursuant to the terms and conditions
of the Credit Application executed by Defendant and herein referenced as Exhibit "C", Defendant is further liable to Plaintiff for collection
and legal fees in the amount of ONE THOUSAND, SIX HUNDRED FORTY-NINE DOLLARS AND FIFTY-TWO CENTS ($1,649.52).
9. Tot total indebtedness due and owing by Defendant to Plaintiff is the sum of NINE THOUSAND, EIGHT HUNDRED
NINETY-SEVEN DOLLARS AND FOURTEEN CENTS ($9,897.14).
10. As further evidence of Defendant's indebtedness to Plaintiff, Defendant did execute an Individual Personal Guarantee
on or aboutJanuary 21,1998. A true and correct copy of said Individual Personal Guarantee is attached hereto as a portion of Plaintiffs
Exhibit "C" and made a part hereof.
II. Plaintiff has frequently demanded payment from Defendant of said amount due and owing as aforesaid, but Defendant
has refused and neglected and still refuses and neglects to pay said amount of any part thereof.

WHEREFORE, Plaintiff brings this suit to recover from Defendant the sum of NINE THOUSAND, EIGHT HUNDRED
NINETY -SEVEN DOLLARS AND FOURTEEN CENTS ($9.897.14), together with interest thereon at the rate of one and one-half (1 \1,%)
percent per month from June 23, 1999.
