STIPULATION AGAINST LIENS
WHEREAS, John A. Schmidt and Helene V. Schmidt, his wife, the OWNER of the real estate
described bel~, has or is about to execute a/9ontract with Keeley and Company, whose principal business
address is rt960f. 7(W Meed f/If-/7of"r , Cumberland County, Pennsylvania, to
construct a single family dwelling upon lands situate at 5802 Stephen's Crossing, Hampden Township,
Mechanicsburg, Cumberland County, Pennsylvania, and more particularly bounded and described on Exhibit
"A" attached hereto end made a part hereof; and,
NOW, THEREFORE, this 18'h day of February, 2000, before any authority had been given by Keeley
and Company to commence work on said facilities, or purchase materials for same, in consideration of
making of the above-described Contract with John A. Schmidt and Helene V. Schmidt, his wife, Owner, and
in further consideration of One ($1.00) Dollar paid to the general contractor by John A. Schmidt and Helene
V. Schmidt, his wife, the receipt whereof is hereby acknowledged, it is agreed that no liens or claims shall
be filed or maintained against the Owner's facilities and the land above-described, or upon John A. Schmidt
and Helene V. Schmidt, his wife, the Owner, by the general contractor, or any of its subcontractors, or by
any of the materialmen or workmen, or any other person acting through or under them, for or on account of
any labor, or materials purchased, or extra labor or materials purchased for, towards, in or about the
erection, construction, design and improvement of said facilities, under said contract or otherwise, the right
to have, file and maintain such liens or claims against the facilities, the land above-described, and John A.
Schmidt and Helene V. Schmidt, his wife, the Owner, being hereby expressly waived by the general
contractor for itself, its subcontractors, all materialmen, or workmen and other acting through or under
them.
IN WITNESS WHEREOF, each of the parties by their duly authorized representatives have hereunto
executed the Stipulation Against Liens this 18'h day of February, 2000.

EXHIBIT" A"
ALL THAT CERTAIN tract or parcel of land situate in the Township of
Hampden, County of Cwnberland, and Commonwealth of Pennsylvania, being more
particularly bounded and described as follows, to wit:
BEGINNING at a point on the northern line of Stephen's Crossing at the
dividing line between Lots Nos. 55 and 56 as shown on the hereinafter mentioned Plan of
Lots; thence along the dividing line between Lots Nos. 55 and 56 North 74 degrees 25
minutes 29 seconds East, a distance of 133.47 feet to a point at lands now or formerly of
Joseph B. and Jane W. Brenner; thence along said Brenner lands North 12 degrees 01
minutes 59 seconds East, a distance of 237.69 feet to a point, said point being the
intersecting point between Lots Nos. 55, 51 South 77 degrees 58 minutes 01 seconds
West, a distance of 63.46 feet to a point being the intersecting point of Lots Nos. 51, 54
and 55; thence along the dividing line between Lots Nos. 55 and 54 South 17 degrees 07
minutes 29 seconds West, a distance of 216.58 feet to a point on the line of Stephen's
Crossing; thence along the line of Stephen's Crossing by a curve to the left having a delta
of 57 degrees 18 minutes 00 seconds and a tangent of 38.25 feet, a radius of 70.00 feet an
arc distance of70.01 feet to a point on the northern line of Stephen's Crossing, said point
being the place of BEGINNING.
CONTAINING 29,627.05 square feet, (0.68 acres) more or less
BEING all of Lot No. 55 as shown in the Final Revised Development Plan of
Village of Westover (East Section), recorded in the Office of the Recorder of Deeds of
Cwnberland County in Plan Book 60, Page 74 on April 27, 1990.
TOGETHER with the improvements thereon known and nwnbered as 5802
Stephen's Crossing, Mechanicsburg, Pennsylvania 17055.
UNDER AND SUBJECT, nonetheless, to the restrictions and covenants set
forth in the aforedescribed Final Development Plan and further by those restrictions,
reservations and covenants as set forth in Misc. Book 356, Pages 3 through 8, as though
they were more fully set forth herein and are herein made applicable to and shall run with
the land herein conveyed. .
