NOTICE TO DEFEND
You have been sued in Court. If you wish to defend against the claims set forth

Complaint and Notice are served upon you, by entering a written appearance personally

claims set forth against you. You are warned that if you fail to do so the case may

further notice, for any money claimed in the Complaint or for any other claim or relief

COMPLAINT
2. Plaintiff is a corporation having offices in Short Hills, NJ.
2. Defendant is a corporation having its offices and place of business at 4401
Carlisle Pike, Camp Hill, Cumberland County, Pennsylvania 17011.
3. At the special instance and request of Defendant, Plaintiff sold and
delivered to Defendant certain Goods, Wares, and Merchandise, as is more specifically
shown by Plaintiff's invoices, copies of which are attached hereto, marked Exhibit 11111
collectively, and made a part hereof.
4. Defendant received and accepted the aforementioned goods, wares and
merchandise.
s. The prices charged by Plaintiff were the fair, reasonable, and market prices
that prevailed at the times of the transactions.
6. The prices charged by Plaintiff were the prices that Defendant agreed to
pay.
7. Plaintiff avers that the balance due amounts to $2 ,009.76 I as is more
specifically shown by Plaintiff's Collections Report, a true and correct copy of which
is attached hereto, marked Exhibit "211, and made a part hereof.

8, Plaintiff claims legal interest as damages on the liquidated debt from July
17, 1999.
9. Plaintiff avers that interest amounts to $70.35 to February 17, 2000.
10. Although repeatedly requested to do so by Plaintiff, Defendant has willfully
failed and refused to pay the aforesaid balance, interest, or any part thereof to
Plaintiff.
WHEREFORE, Plaintiff demands Judgment against Defendant in the amount of
$2,080.11, with continuing interest thereon at the rate of 6% per year and costs.

STIPULA'rION OF THE PARTIES FOR SETTLEMENT AND FOR THE ENTRY OF JUDGMENT
IN THE EVENT OF DEFAUL'r
AND NOW comes the Plaintiff, by counsel, and the Defendant, to Stipulate to
Settlement and for the Entry of Judgment in the event of Default, as follows,
1. Defendant admits indebtedness to Plaintiff in the amount of $2,000.00
calculated as follows,
$2,000.00 principal owing as of March 7, 2000.
2. To secure the repayment of said indebtedness, Defendant agrees not to file
an Answer to Plaintiff's Complaint, and to permit Plaintiff to enter Judgment by default
for the full amount of the complaint, $2,080.11 in accordance with the Pennsylvania
Rules of civil Procedure in the event of Defendant's default of the following payment
schedule, giving due credit for any payments made prior to default.

3. Plaintiff agrees not to enter Judgment so long as Defendant causes to be
delivered into the hands of the Plaintiff's counsel the following payment in full by
4:30 P.M. the close of business, on the following dates:

4. Time is of the essence in this agreement and the failure of Defendant to make
any payment to Plaintiff's counsel by the date and time due or within 5 days of the
notification of default from the Plaintiff's attorney shall allow Plaintiff to
immediately enter Judgment by Default against the Defendant for the balance then due,
pursuant to th~ Pennsylvania Rules of Civil Procedure, and to issue Execution thereon
or pursue all other remedies at law or equity to collect the full balance of the
Judgment entered hereunder plus appropriate additional interest and costs.
5. Upon payment of all sums set forth in paragraph 3 above, without delinquency
or default, Plaintiff will mark the docket settled and discontinued within ten (10) days
of receipt of the final payment.
6. No act or omission of the Plaintiff, nor of anyone alleged to be acting on its
behalf, shall ~onstitute a waiver, estoppel, or any other excuse for nonperformance of
any duty undertaken by the Defendant in this Stipulation.
