NOW THEREFOR$. THIS AGREEMENT WITNESSETH: That the said Contractor,for 4IId in consideration of

acknowledged, and the further consideration mentioned ill, the agreement aforesaid, for themselves and their
subcontractors. and all parties acting through or under th-em, covenant -and agree 'that no mechanic's liens or claims
shall be filed or maintained by them or any of them against the said buildings and the lot of ground appurtenant
thereto for or on account of allY work dOlle or material$; furnished by them or any of them under said contract or

ALL THAT CERTAIN tract of land situated in the Borough of Carlisle, Cumber-
land County, PA being The Highlands, Phase 3, Lot No. 66, as shown on a plan
entitled "The Highlands Final Subdivision Plan, Phase 3, Section One~ dated
January 21, 1997, by PennTerra Engineering, Inc., State College, PA, recorded
in Plan Book 79, Page 103, being bounded and described as follows:
BEGINNING at an iron pin, being a southerly comer of lands owned now or
formerly by Michael J. & Barbara C. Breen (D.B. 35- T -39) and lying in a northerly
right-of-way line of Shannon Lane (60 foot right-of-way); thence along said right-
of-way, South 85 degrees 42 minutes 00 seconds West, 22.71 feet to a point;
thence continui~galong said right-of-way, a/ong a curve to the right, having a
chord bearin,!, of South 87 degrees 51 minutes 07 seconds West, a chord
distance of 31.02 feet, a radius of 413.07 feet, and an arc distance of 31.03 feet
