Dear Ms. Calkin and Mr. Galitsky:
Judith Calkin, Attorney for Plaintiff, signed the certification document regarding
discovery on October 4, 2001. Mr. Galitsky has not returned the certification document.
I am going to proceed, however, on the basis that discovery is complete and that we will
not be dealing with any discovery issues at the time of the pre-hearing conference.
This action was commenced by the filing of a divorce complaint on February 23,
2000. The complaint raised grounds for divorce of irretrievable breakdown of the
marriage. No economic claims were raised in the complaint.
On December 12, 2000, the Plaintiff filed an amended complaint raising the
economic claim of equitable distribution; on June 11,2001, the Plaintiff filed another
amended complaint averring that the parties separated May 1999, a period in excess of
two years. The divorce, therefore, can conclude under Section 3301(d).
Attorney Calkin filed a pretrial statement on behalf of the Plaintiff along with an
inventory and appraisement and income and expense statement in September 2001. Mr.
Galitsky has filed no documents in this action.
In accordance with P.R.C.P. 1920.33(b) I am directing Mr. Galitsky to file a
pretrial statement on or before Friday, January 4, 2002. Upon receipt of his pretrial

statement, I will immediately schedule a pre-hearing conference with his wife's counsel

PETITION FOR SPECIAL RELIEF
1. Plaintiff is MARY JANE GALITSKY, who resides at 615
Market Street, 1st Floor, New Cumberland, Cumberland County,
Pennsylvania.
2. Defendant is JOEL A. GALITSKY who resides at 713
Market Street, New Cumberland, Cumberland County, Pennsylvania.
3. Plaintiff and Defendant were married on March 15,
1986.
4. The parties have two (2) minor children both of whom
reside with plaintiff.
5. In May, 1999, plaintiff and the minor children left
the marital home located at 713 Market Street, New Cumberland,
Cumberland County, Pennsylvania.
6. Plaintiff filed for divorce to the above-captioned
date and term on February 25, 1999.
7. Plaintiff filed an amended divorce complaint to
include a request for equitable distribution of marital property.
8. Defendant has refused to enter into negotiations
concerning this matter.
9. Defendant has maintained sole possession and use of
the marital home.
10. On March 5, 2001, plaintiff received a notice from
Atlantic Mortgage and Investment Corporation which said the

mortgage had not been paid for over three (3) months. A copy is
attached hereto and marked Exhibit "A".
11. A previous petition on the non-payment of the
mortgage was heard by this Honorable Court in January 8, 2001.
Attached and marked Exhibit "B".
12. Petitioner has expended $600.00 in attorney's fees
in the first and second actions and requests that Respondent be
directed to pay this amount.
13. If there is a foreclosure, plaintiff I S credit record
will be adversely effected, and the marital estate will be
substantially diminished.
WHEREFORE, it is respectfully requested that defendant
be ordered to promptly bring the mortgage up to date or, in the
alternative, that the house be place on the market for sale and the
proceeds be escrowed pending a final resolution of this matter and
he be directed to pay petitioner's attorney fees in the amount of
$600.00.

1. Plaintiff is MARY JANE GALITSKY, who resides at 615 Market
Street, 1st Floor, New CUmberland, CUmberland County, Pennsylvania.
2. Defendant is JOEL A. GALITSKY who resides at 713 Market
Street, New Cumberland, Cumberland County, Pennsylvania.
3. Plaintiff and Defendant were married on March 15, 1986.
4. The parties have two (2) minor children both of whom
reside with plaintiff.
5. In
, 1999, plaintiff and the minor children left
the marital home located at 713 Market Street, New Cumberland,
Cumberland County, Pennsylvania because defendant refused to leave the
home.
6. Plaintiff filed for divorce to the above-captioned date
and term on February 25, 1999.
7. This date, plaintiff filed an amended divorce complaint to
include a request for equitable distribution of marital property.
8. Defendant has refused to enter into negotiations
concerning this matter.
9. Defendant has maintained sole possession use of the
marital home.

10. On November 24, 2000 plaintiff received a notice from
Atlantic Mortgage and Investment Corporation which said the mortgage had
not been paid since August, 2000. A copy is attached hereto and marked
Exhibit "A".
11. The marital home is a major asset of this marriage.
12. If there is a foreclosure, plaintiff I s credit record will
be adversely effected, and the marital estate will be substantially
diminished.
WHEREFORE, it is respectfully requested that defendant be
ordered to promptly bring the mortgage up to date or, in the
alternative, that the house be placed on the market for sale and the
proceeds be escrowed pending a final resolution of this matter.

OF MARY JANE GALITSKY
Plaintiff, by her attorney, Judith A. Calkin, Esquire
files this pre-trial statement in accordance with Pa.R.C.P.
1920.33 (b) .
1. Marital Assets: The only asset at issue is the
marital home.
2. Exoert Witnesses: None at present.
3. Other Witnesses: None at present.

5. Income Information:
See Income and Expense
Statement. Plaintiff works for the Commonwealth and grosses
approximately $36,796.00 per year. Defendant works for the federal
government.
He has failed to provide any current income
information. At a prior child support conference he made more than
MrS. Galitsky.
6. Exoense Information: See Income and Expense
Statement.
7. Pension Information: The parties have agreed that

each will keep their own pension benefits.
8. Counsel Fees: Because of defendant's continuing
failure to cooperate, counsel fees are requested in the amount of
$1500.00.
9. Tanqible Personal Propertv The parties have
agreed to each keep the items in their individual possession.
10. Proposed Resolution: Mrs. Galitsky is 48 years old;
Mr. Galitsky is 41 years old. They were married in 1986 and
separated over two years ago. The parties have two minor children
who live with Mrs. Galitsky. The parties have agreed to the
distribution of all property except the marital home where Mr.
Galitsky resides. Neither party is in a position to buy the other
out, and because the minor children do not reside there, the
logical solution is to sell the property. The property is worth
approximately $70,000.00 to $80,000.00 and the mortgage principal
is approximately $35,178.08 and the home improvement lien is
approximately $12,500.00. As a consequence, there is very little
equity. Of great concern to Mrs. Galitsky, however, is the fact
that Mr. Galitsky has been inconsistent in making the mortgage
payments This has led to two Petitions for Special Relief.
Because the mortgage and home improvement loans are joint debts she
requests the home be sold. Mr. Galitsky is unrepresented and has
not responded to our offers to sell the home and divide the
proceeds.
