COMPLAINT
AND NOW, comes the Plaintiffs/Respondents, Vivian Myers, on
behalf of Michael R. Banks, a minor, through their attorneys, the
~aw offices of Patrick F. Lauer, Jr., in the person of Matthew J.
Eshelman, and brings the following complaint in response to a
Notice of Appeal from a District Justice judgment and in support
thereof respectfully avers the following:
1. The Plaintiff/Respondent, Michael R. Banks, a minor, born
January 21, 1983, currently resides at 30 Bobby Jones Drive,
Etters, York County, Pennsylvania 17319 (hereinafter also referred
:to as Michael).

The Defendant/Appellant is Angela L. Banks, the mother of
.
:the Plaintiff/Respondent, who currently resides
at 120 High Street,
:Enola, Cumberland County, Pennsylvania 17025 (hereinafter also
:
'referred to as Mother).
3. Many years ago, Michael opened a savings account at
Members 1st Federal Credit Union in a joint name with his mother. '

Over the years, Michael deposited funds which he received
las birthday gifts, Christmas gifts, and the like into this savings

,account.

5. In or around June 1998, Michael started working at
McDonald's at the age of fifteen, depositing most of his earnings
into the same account.

In December of 1998, when Michael was still fifteen years

of age, he withdrew funds from this savings account in order to
purchase

Michael
a 1992 Toyota Paseo.
The vehicle was titled in Mother's
name only because
was less than sixteen years of age.
8. The current value of the vehicle is $4,800.00.

9. The license plate on the vehicle reads "BANKS14."
10. Moreover, in December of 1997, Michael received a
computer as a Christmas present jointly from his maternal
grandmother, Vivian Myers, and his mother.
11. The value of the computer is $950.00.
12. In December of 1999, when Michael moved from his mother's
residence to live with his father, Albert Banks, Mother refused to
release the vehicle or the computer.
13. District Justice Robert M. Manlove awarded Michael the
amount of $4,885.00, plus $112.40 in costs, for a total judgment of
$4,997.40 on February 17, 2000.
14. Angela Banks, as Mother of the minor, stands in a
position of fiduciary trust with respect to the minor, Michael R.
Banks.
15. Mother would be unjustly and enrich were she permitted to
,retain the Toyota Paseo, the computer, or their equivalent value.

WHEREFORE, the undersigned, Vivian Myers, on behalf of the
minor, Michael R. Banks, respectfully requests that a resulting
