A review of the pleadings as a whole in the instant case reveals that Defendant has failed to sustain his burden of presenting facts, which contradict the elements of Plaintiffs claim. Defendant's general denial of the amounts due and the default should be viewed as admissions by tllis Honorable Court. III. ATrORNRYFFRS AND r:OSTS ARF. RRASONART.R As to tlle attomey fees recited in paragraph six of tlle Complaint, it should be noted tllat paragraph seventeen of the Mortgage clearly indicates tllat Defendant is liable for a reasonable attomey commission, costs of suit, and costs of title evidence if Defendant defaults on the loan. The attomey fee claimed in Plaintiffs complaint is less tlmn five percent of tlle principal balance due on the loan. \Vhen Plaintiff was preparing its foreclosure Complaint, it could not know how much thc attomey fces and costs would be upon completion of tlle foredosure action. Plaintiff could not know whetller tllC Defendant would contest tlle case and, if so, how extensively. Accordingly, Plaintiff used Pennsylvania case law as a guide. Plaintifl. estimated an attomey fec of less tlml livc percent of IllC principal balance. Importantly, Plaintiff clearly outlined how Delendant could avoid paying PlaintiIrs allorney fees in tlIe Notice of Intention to Foreclose Mortgage, which was mailed to Defendant. Defendant, however, failed to take tlIe necessary affmnative steps to cure tlIe delinquency, but rather has opted to litigate, which has resulted in more attorney fees. Additionally, Plaintilf submits that tlIe amount demanded for costs of suit and title search in Plaintiffs Complaint is neither excessive nor unreasonable. Moreover, the reasonableness of allorney lees does not create a genuine issue of material fact, which precludes the entry of summary judgment. (emphasis added.) 41 P.S. S403(a). Section 403(a) applies only to residential mortgages.
