3. On 9/15/95 NATHAN K. AND AMY E. MCNAUGHTON made, executed and
delivered a mortgage upon the premises hereinafter described to SOVEREIGN BANK
which mortgage is recorded in the Office of the Recorder of CUMBERLAND County, in
Mortgage Book No. 1282, Page 879. By Assignment of Mortgage dated 9/28/95 the
mortgage was assigned to PLAINTIFF which Assignment is recorded in Assignment of
Mortgage Miscellaneous Book No. 511, Page 550.
4. The premises subject to said mortgage is described as attached.
5. The mortgage is in default because monthly payments of principal and interest upon said
mortgage due 10/1/99 and each month thereafter are due and unpaid, and by the terms of
said mortgage, upon default in such payments for a period of one month, the entire
principal balance and all interest due thereon are collectible forthwith.

7. The attorney's fees set forth above are in conformity with the Mortgage documents and
Pennsylvania Law, and will be collected in the event of a third party purchaser at
Sheriffs Sale. If the Mortgage is reinstated prior to the Sale, reasonable attorney's fees
wiIl be charged.
8. This action does not come under Act 6 of 1974 because the original mortgage amount
exceeds $50,000.00.
9. Plaintiff hereby releases AMY E. MCNAUGHTON from liability for the debt secured by
the mortgage.
WHEREFORE, PLAINTIFF demands an in = Judgment against the Defendant(s) in the sum of
$94,538.12, together with interest from 2/1/00 at the rate of$19.09 per diem to the date of

011 September 15, 1995 Defendant, Natilan K. McNaughton and, executed a Promissory Note in
l,wor of Plaintill's predecessor in interest, Sovereign Bank, in tile principal sum of $90A40.00, said sum being
payable in equal, consecutive, monthly instalhnents of principal and interest of approximately $663.62. On
tile same date, Delendant made, executed and delivered a Mortgage on the property at 4190 Kittatinny Drive,
Mechanicsburg, PA 17055 (hereinafter ti,e "Property"), as collateral for the Promissory Note. The Mortgage
has been assigIlerlto PlaintilT, as is addressed in PlaintiJTs attached Motion.
Defcnd:mt defaulted under the Mortgage and Note by failing to make payments due October I, 1999
and each month thereaIler. By the express terms of tile Mortgage, upon default in such payments for a period
of one mOl1th, the entire debt is immediately collectible.
011 December 5, 1999, due to Defendant's default, Plaintill'mailed Delendant notice of its intention
to foreclose on ti,e Mortgage by certified mail to Defendant at his last known address. Defend:mt, however,

Because Defenchmt Jailed to take the necessary affirmative steps to cure the delinquency, PlaintiJI was
left wilh no allemative bulla foredose in order to recover its Uljjust financial losses. Accordingly, the present
action was libl 011 February 24, 2000. To date, Defendant has not brought the account current.

than general denials and demand lor proof. Defendant generally denies the amount due nnder the Mortgage
without reference to what he believes to be the correct amount due, or reference to any good reason to believe
that the amount sought is erroneous.
Unquestionably, Defendant kno~vs specifically what payments he made on dIe Mortgage.
Accordingly, because Defendant is charged widl having snfficient knowledge upon which to base a specific
denial widl respect to d,e avennents contained in paragraphs five and six of dIe Complaint, a general denial is

case. The Court held that the mortgagors' general denials in their answers to the Complaint must be

Court reasoned that the only persons with knowledge of the amount due, besides the mortgage company,
would be the mortgagors. Therefore, if detcndant mortgagors do not plead specilic facts in response to the
allegations in the Complaint regarding the detault and the amount due, the defendants are deemed to have

In determining if an answer is a general denial, the Court must examine the pleadings as a whole.
r:nmmw hy Prp"tP. "'pP. at 61, 587 A.2d 357, 360 (1991). A review of the pleadings as a whole in the instant
case reveals that Defendant has failed to sustain his burden of presenting facts, which contradict the elements
of Plaintiffs claim. Defendant's general denial of the amounts due and the default should be viewed as
admissions by tllis Honorable Court.

As to tlle attomey fees recited in paragraph six of tlle Complaint, it should be noted tllat paragraph
seventeen of the Mortgage clearly indicates tllat Defendant is liable for a reasonable attomey commission,
costs of suit, and costs of title evidence if Defendant defaults on the loan. The attomey fee claimed in
Plaintiffs complaint is less tlmn five percent of tlle principal balance due on the loan. \Vhen Plaintiff was
preparing its foreclosure Complaint, it could not know how much thc attomey fces and costs would be upon
completion of tlle foredosure action. Plaintiff could not know whetller tllC Defendant would contest tlle case
and, if so, how extensively. Accordingly, Plaintiff used Pennsylvania case law as a guide. Plaintifl. estimated an
attomey fec of less tlml livc percent of IllC principal balance.

As a general rule, attorney fees, which are reasonable will be pennitted by the Court. A requested fee
of live percent of the outst;U1ding principal balance has been granted by the Court. Pennsylvania Courts have
long and repeatedly concluded that such a 5% provision is reasonable and enforceable. R()hlno.:()t1 v T 110mio.:,

It is importmIt to note that the attorney fees called for in the Mortgage are mmed by the mortgagee,
not the attorney. They are not limited to the actual allorney fees but cover also the extra charges made

Court cited Eetner in conflTIl1ing tlIat an attorney fee of ten percent included in the judgment in a mortgage

Importantly, Plaintiff clearly outlined how Delendant could avoid paying PlaintiIrs allorney fees in tlIe
Notice of Intention to Foreclose Mortgage, which was mailed to Defendant. Defendant, however, failed to
take tlIe necessary affmnative steps to cure tlIe delinquency, but rather has opted to litigate, which has resulted
in more attorney fees. Additionally, Plaintilf submits that tlIe amount demanded for costs of suit and title
search in Plaintiffs Complaint is neither excessive nor unreasonable.
Moreover, the reasonableness of allorney lees does not create a genuine issue of material fact, which

Defendant executed the Mortgage knowing that he would be responsible for the payments. Defendant has
admitted the existence of the mortgage in his Answer to the Complaint. PlaintilT has provided an affidavit that
Defendant is in debult and set forth the amount owed by Defendant. Therefore, Plaintiff maintains that it has
produced suflicient evidence to establish a prima facie case for mortgage foreclosure. Once Plaintiff has
satisfied its burden, Defendant has a responsibility to demonstrate facts, which would create a genuine issue for
trial. EhaII, supra. Defendant has failed to sustain his burden of presenting faels, which would contradict the
clements of Plain tilTs claim.
Plaintiff respectfully submits that the allegations of the Complaint are, in fact, uncontroverted.
Defendant has had use of the Property rent-free at PlaintilTs expense long enough. Defendant's Answer has
been interposed for the purpose of delay only. Plaintiif requesL' that its Motion be granted so that it can
recover the uqjust financial losses it has incurred to date.

Plaintiff s Motion for Summary Judgment
Factual Summary: On September 15, 1995, Defendant executed a Promissory Note in
the principal sum of$90,440.00 and executed a Mortgage on the
property at 4190 Kittatinny Drive, Mechanicsburg, P A 17055 as
collateral for the Promissory Note. Defendant defaulted under the
Mortgage and Note by failing to make payments due October 1,
1999 and each month thereafter. On December 5, 1999 Plaintiff
mailed Defendant notice of its intention to foreclose on the
Mortgage. Defendant failed to cure the default and this suit was
filed on February 24,2000.
Issue:
Plaintiff's Argument:
(1)
Whether Defendant's general denials in its Answer to
Plaintiff's Complaint should be viewed as admissions by
the court, therefore warranting the grant of the Motion for
Summary Judgment?
Whether the attorney fees and costs requested by Plaintiff
are reasonable and should therefore be awarded?
(2)
(1) Defendant knows specifically what payments he
made on the Mortgage; therefore, his general denial
is insufficient to raise a genuine issue of fact. His
general denials must be deemed admissions.
(2) Plaintiff claims that the Mortgage clearly indicates
that Defendant is liable for a reasonable attorney
commission, costs of suit, and costs of title
evidence if Defendant defaults on the loan. In
addition, Defendant failed to take the necessary
steps to cure his delinquency thereby choosing to
litigate, resulting in increased attorney fees.
Plaintiff cites caselaw to support his contention that
the requested attorney fees and costs are reasonable.
Finally, the reasonableness of attorney fees does not
create a genuine issue of material fact.

Plaintiff respectfully requests that the Court enter an Order granting summary judgment in its
favor in the above-captioned matter and in support thereof avers as follows:
I. There are no material issues offact.
2. Plaintiff is seeking only an in rem judgment in this mortgage foreclosure action.
3. Defendant, Nathan K. McNaughton, has fIled an Answer to the Complaint in which he has
effectively admitted all of the allegations of the Complaint, as is further addressed in Plaintiff's attached Brief.
4. In his Answer, Defendant improperly denies paragraphs fIve and six of the Complaint, which
aver the default and the amounts due on the Mortgage. True and correct copies of Plaintiff's Mortgage
Foreclosure Complaint and Defendant's Answer are attached hereto, incOlporated herein by reference, and
marked as Exhibits C and D, respectively.

5. Defendant has failed to sustain his burden of presenting facts, which contradict the averments
of Plailltifl's Complaint.
6. Defendant admitted in paragraph three of his Answer that he executed the Mortgage and that
the Mortgage has been assigned to PlaintiIf. True and correct copies of the Mortgage and Note are attached
hereto, made part hereof, and marked Exhibits A and AI, respectively.
7. "The Mortgage is due for the October I, 1999 payment, a period in excess of seven months.
An Affidavit confirming the default and the amount of the debt is attached hereto, incorporated herein by
reference, and marked as Exhibit B.
8. Defendant has admitted that the notice provisions of Act 6 of 1974 do not apply to this case.
9. Defendant is not eligible for the Homeowners' Emergency Mortgage Assistance Program, Act
91 of 1983, because the Mortgage is insured by the Federal Housing Authority. 35 P.S. SI680.401c(a)(3).
Nevertheless, Plaintiff sent Defendant notice pursuant to Act 91 of 1983. True and correct copies of the
Notice of Homeowner's Emergency Mortgage Assistance Program is attached hereto, made part hereof, and
marked as Exhibit E.
10. Defendant has the right to reinstate the loan up until one hour before a scheduled Sheriffs
Sale.
WHEREFORE, Plailltiff respectfully requests that an in = judgment be entered in its favor for the
amount due plus interest and costs as prayed for in the Complaint, for foreclosure and sale of the mortgaged
property.

Defendant did not take the necessary affirmative steps to avoid foreclosure.
8. Plaintiff did not provide notice under Act 91 of 1983 to Defendant because the subject
mortgage is insured by the Federal Housing Administration.
