COMPLAINT
1. The plaintiffs, Thomas and Helene Gyimesi, are adult individuals
residing at 814 Erford Road, Camp Hill, Cumberland County, Pennsylvania.
2. The defendant, Barclay White Incorporated, is a corporation with a
place of business at 4999 Louise Drive, Suite 201, Mechanicsburg, Cumberland
County, Pennsylvania.
3. The plaintiffs at all times relevant hereto were the owners and
possessors of the property listed in paragraph 1. The defendant at all times
relevant hereto was the engineer in charge of a construction project on a piece of
property in the immediate vicinity of the plaintiffs.
4. On or about early August, 1999, the plaintiffs suffered water
damages to their property at 814 Erford Road, when defendant failed to control
run-off water from its construction project at West Creek Hills Elementary School
in the East Pennsboro Area School District.
5. The defendant had a duty to maintain the construction project in
such a manner as to avoid water damage to plaintiffs' property.
6. The conduct of the defendant caused an increased flow of water
onto the property of the plaintiffs.
7. As a result of the nuisance created by the defendant, the plaintiffs
suffered property damage in the amount of $4,744.80.
WHEREFORE, it is prayed that judgment be entered in favor of the
plaintiffs and against the defendant in the amount of $4,744.80 plus costs, for a
total of $4,840.30, an amount requiring compulsory referral to arbitration under
the Local Rules of Court.
