STIPULATION AGAINST LIENS
THIS AGREEMENT made the ~~i7t' day of February, 2000, by and between BASTIAN
-
HOMES, INC., hereinafter referred to as Contractor, and WILLIAM J. SELL, JR. and SUSAN K.
SELL, hereinafter referred to as Owner, whereby the former undertook and agreed to erect and
constmct a custom built home on that certain lot of ground situate at Lot No.7, Lisburn Meadows.
North, Monro Township, Cumberland County, Pennsylvania, more fully described in Exhibit "A"
attached hereto and made a part hereof.
NOW THEREFORE, WITNESSETH: That the said Contractor, for and in consideration of
the sum of ($1.00) Dollar to Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the agreement aforesaid, for themselves
and their subcontractors, and all parties acting through or under them, covenant and agree that no
mechanic's liens or claims shall be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on account of any work done or materials
furnished by them or any of them under said contract or otherwise, for, towards, in, or about the
erection and constmction of the said buildings on the lot above described, and the said Contractor,
for themselves, their subcontractors and others under them hereby expressly waive and relinquish
the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any
of them, and agree that this instrument, waiving the right oflien, shall be an independent covenant.

BEGINNING at a point along Meadow Lane (50 foot wide right-of-way) at the dividing line of Lot
No.5 and Lot No.7 of aforementioned Plan; thence along said Meadow Lane South 89 degrees 03
minutes 33 seconds West 261.04 feet to a point at the dividing line between Lot No.7 and Lot No.
9 of said Plan; thence along said dividing line North 00 degrees 56 minutes 27 seconds East 75.00
feet to a point; thence continuing along said dividing line North 09 degrees 49 minutes 25 seconds
West 371.85 feet to a point at the dividing line between Lot No. 7 and Lot No. 9; thence North 60
degrees 20 minutes 22 seconds East 241.85 feet to a concrete monument; thence South 27 degrees
57 minutes 20 seconds East 234.15 feet to a concrete monument on the dividing line between Lot
No.5 and Lot No.7; thence along said dividing line South 00 degrees 56 minutes 27 seconds East
350.00 feet to a point on the right-of-way line of Meadow Lane, the point and place of BEGINNING.
CONTAINING 139,618 square feet or 3.21 acres.
