Plaintiffs, Michael and Mary Schrim, are adult individuals who at all times relevant hereto resided at 43 Old Stone House Road, Silver Spring Township, Cumberland County, Pennsylvania, 17013. 2. Defendants are Lewis Speese and Maryann Speese, husband and wife, adult individuals who at all times relevant hereto resided at 24 Brough Road, York Springs, Pennsylvania, 17372. COUNT I-CONTRACT 3. On or about November 18, 1997, Plaintiffs paid Defendants the sum of$5,000.00 as a good faith deposit on the possible purchase of real estate located in Silver Spring Township, Cumberland County, Pennsylvania, owned by Defendants. h,'" "---fi"'_,_~ ~",'7_' _,,~, . The $5,000.00 sum was paid by Plaintiffs to the Defendants with the understanding that said sum would be applied to the purchase of the property if and when the details for the sale of the property could be worked out between the parties and the parties closed on the property sale, otherwise the monies would be refunded to Plaintiffs. 5. During the months following the payment of the $5,000.00, the parties attempted to finalize the terms of sale for the property, but were unable to reach any final and binding agreement primarily due to problems with the IlIlt\1r~of and location of access)o the property as impacted by the Appalachian Trail and as effected by the uncertainty of access over land of third- party landowners surrounding the subject property. 6. In September, 1998, due to the fact that the right-of-way issue remained unresolved and due to the absence of a written Agreement of Sale between the parties, the Plaintiffs asked Defendants for the return of the $5,000.00 payment in accordance with their original understanding in November, 1997, but Defendants failed to return said $5,000.00 payment. 7. On a number of occasions subsequent to September, 1998, Plaintiffs requested the return of their $5,000.00 which Defendants failed to do, which refusal persists to the present time. 8. By reason of the aforesaid understanding of the parties from November 1997, Plaintiffs are entitled to the return of their $5,000.00 payment, along with interest at the legal rate of six percent (6%) from the date of initial demand for the return of said monies in September 1998. 2 :" ~ ." - .. - ',' " ". ~",,-...._-. - - - ,-- . ..-.^..". ~ ~.. ,_"."_~,n~ .". _ <. 9. Iffor any reason the Plaintiffs are unable to prove a contractual basis for recovery of the $5,000.00, Plaintiffs alternatively plead that the Defendants have converted the sum of $5,000.00 paid to them by Plaintiffs by keeping said sum with no legal basis for doing so. 13.
