MORRISON, INC.
WHEREAS, Frank M. Frey, III and Jane W. Frey, his wife, of Carlisle, Cumberland
County, Pennsylvania 17013, have executed a contract with Morrison, Inc., of Duncannon,
Perry County, Pennsylvania 17020, for the erection of a residential dwelling upon a tract of land
situate in Middlesex Township, Cumberland County, Pennsylvania, more particularly described
in the deed of Merle H. Myers, Jr. and Marlene L. Myers, his wife, to Frank M. Frey, III and
Jane W. Frey, his wife, dated February 18, 1971 and recorded in the Office of the Recorder of
Deeds for Cumberland County, Pennsylvania in Deed Book "Y", Volume 23, Page 997 and
being known 3410 Spring Road, Carlisle, Cumberland County, Pennsylvania 17013.
NOW, February '7...1-2000, at the time of and immediately before the execution of the
principal contract, and before any authority has been given by the said Owners to the said
Contractor to commence work on said building, or to purchase materials for the same in
consideration of the making of the said contract with the said Contractor and the further
consideration of the sum of One and no/100 ($1.00) Dollar to Contractor paid by said Owners, it
is agreed that no lien shall be filed against the building by the contractor, or any subcontractor,
nor by any of the material men or workmen or any other person for any labor or materials
purchased or extra labor or materials purchased for the erection of said building, the right to file
such liens being expressly waived.
