Plaintiff is Edward Shelly, an adult individual residing at 304 l5'h Street, New Cumberland, Pennsylvania, 17070 and parent and natural guardian of Rachel Shelly, on whose behalf he brings this action. 2. Defendant is Samuel S. Brinley, Jr., an adult individual with the last known address of 724 Harding Street, New Cumberland, Pennsylvania, 17070. 3. On the aforementioned date, Defendant Brinley had custody and control of a beagle dog that was owned by a friend. 5. Defendant Brinley permitted the dog to sleep in the same bed as Rachel Shelly. 6. In the morning when Rachel Shelly awoke, she was bitten on the lip by the dog. 7. Rachel Shelly suffered an injury to her lip which was repaired with stitches and resulted in a scar of approximately two (2) centimeters. 8. Plaintiff has incurred $391.50 in medical costs as a result of Rachel's injury. 9. Plaintiff has also incurred $45.50 as a cost of initiating this action and will be liable for attorneys' fees in the amount of twenty-five percent (25%) ofthe recovery. 10. The settlement for which Plaintiff seeks approval is in the amount of Six Thousand Dollars ($6,000.00). 11. After the deduction of $391.50 for medical expenses, $45.50 for the initiation of this action, and attorneys' fees in the amount of $1,500.00, a balance of $4,063.00, will remain. 12. The balance remaining will be placed in an interest bearing custodial account, with Edward Shelly serving as trustee of the account. 2 -" -, -- ~~, ~, '.<.",.
