STIPULATION AGAINST LIENS
WHEREAS, Stephen O. Fugett and Rita M. Fugett, his wife, the OWNER of the real estate described
below, has or is about to execute a contract with James L. Yarlett, whose principal address is 926 Gobin
Orive, Carlisle, Cumberland County, Pennsylvania, to construct a single family dwelling upon lands situate at
11 Stine Avenue, North Middleton Township, Carlisle, Cumberland County, Pennsylvania, and more
particularly bounded and described on Exhibit "A" attached hereto and made a part hereof; and,
NOW, THEREFORE, this 16th day of February, 2000, before any authority had been given by James
L. Yarlett to commence work on said facilities, or purchase materials for same, in consideration of making of
the above-described Contract with Stephen 0, Fugett and Rita M, Fugett, his wife, Owner, and in further
consideration of One ($1.00) Dollar paid to the general contractor by Stephen O. Fugett and Rita M, Fugett,
his wife, the receipt whereof is hereby acknowledged, it is agreed that no liens or claims shall be filed or
maintained against the Owner's facilities and the land above-described, or upon Stephen 0, Fugett and Rita
M. Fugett, his wife, the Owner, by the general contractor, or any of its subcontractors, or by any of the
materialmen or workmen, or any other person acting through or under them, for or on account of any labor,
or materials purchased, or extra labor or materials purchased for, towards, in or about the erection,
construction, design and improvement of said facilities, under said contract or otherwise, the right to have,
file and maintain such liens or claims against the facilities, the land above-described, and Stephen O. Fugett
and Rita M. Fugett, his wife, the Owner, being hereby expressly waived by the general contractor for itself,
its subcontractors, all materialmen, or workmen and other acting through or under them,
IN WITNESS WHEREOF, each of the parties by their duly authorized representatives have hereunto
executed the Stipulation Against Liens this 16th day of February, 2000.

EXHIBIT "A"
ALL those four 14) certain lots of ground situate in North Middleton Township,
Cumberland County, Pennsylvania, bounded and described as follows, to wit:
BEGINNING at a point in the southern line of Stine Avenue (33) feet wide) at the
western line of Lot No, 9 on Plan No. 2 of Stine Development as recorded in Cumberland
County Plan Book 6, Page 41; thence in a southerly direction by the line of Lot No. 9 a
distance of 132,2 feet to a point; thence by the northern line of a 16 feet wide alley in a
westerly direction a distance of 200 feet to a point; thence in a northerly direction a distance
of 132,2 feet to the southern line of Stine Avenue; thence by the southern line of Stine
Avenue in an easterly direction a distance of 200 feet to the place of BEGINNING.
BEING Lots Nos, 10, 11, 12 and 13 as shown on Plan No, 2 of Stine Development
recorded in Cumberland County Plan Book 6 at Page 41.
RESTRICTIONS for Plans Nos, 1 and 2 of the Stine Development, North Middleton
Township, Cumberland County, Pennsylvania, J. Mac Stine and Peach Belle Stine, Owners,
Plan Book 6, Page 41.
SAID Developments shall be subject to restrictions as set forth on prior deeds of record.
