Eisenhower Boulevard, Duncannon, Cumberland County, Pennsylvania, 17020.
3. On September 28, 1999, Plaintiffs Becky S. Moore and Mark Moore were the
owners of a 1993 Oldsmobile Achieva with Pennsylvania Registration Plate No. ARK 7583.
On September 28, 1999, Plaintiff Becky S. Moore was the operator of said vehicle.
4. On September 28, 1999, Defendant Jennifer Ann Dominiani was the operator of
a 1992 Honda Accord, Pennsylvania Registration Plate No. BNN 4787, with the consent and
permission of its owner, David A. Dominiani.
5. On September 28, 1999 at approximately 7:20 p.m., Plaintiff Becky S. Moore
was lawfully operating her vehicle eastbound on Wertzville Road, East Pennsboro Township,
Cumberland County, Pennsylvania, when she lawfully stopped for a green traffic signal and

lawfully entered the intersection of Wertzville Road and Center Street, East Pennsboro
Township, Cumberland County, Pennsylvania.
6. At the aforesaid time and date, Defendant Jennifer Ann Dominiani was
operating a vehicle owned by David A. Dominiani westbound on Wertzville Road, East
Pennsboro Township, Cumberland County, Pennsylvania.
7. At the aforesaid time and date, Defendant Jennifer Ann Dominiani failed to
yield the right-of-way to Plaintiff and unlawfully proceeded through the aforesaid intersection
to make an illegal left turn and collided with Plaintiff's vehicle.
8. The Defendant, Jennifer Ann Dominiani, owed a duty of care to the other
lawful users of the roadways in the Commonwealth of Pennsylvania to operate the vehicle
owned by David A. Dominiani in such a way as not to cause harm or damage to said other
persons and to the Plaintiff Becky S. Moore in particular.
9. The collision occurred solely as a result of the negligence, carelessness and
recklessness of Defendant and was due in no manner to any act, or failure to act, on the part of
the Plaintiff Becky S. Moore.
10. The aforesaid collision was caused solely, directly, proximately and/or
substantially by the negligence of Defendant in the following particulars:
a. failing to yield the right-of-way to Plaintiff's vehicle in violation of
Section 3322 of the Vehicle Code, 75 Pa. C.S.A., !l 3322.
b. operating her vehicle in violation of the laws of this Commonwealth;

c. failing to slow or stop the vehicle she was operating so as to avoid a
collision;
d. failing to Illaintain adequate control of the vehicle she was operating in
order to avoid a collision;
e. failing to keep the vehicle she was operating under proper and adequate
control so as not to expose other users to umeasonable risk of harm; and
f. failing to keep alert and maintain a proper lookout for the presence of
other motor vehicles on the streets and highways.
11. As a direct and proximate result of the collision and the negligent, careless and
reckless conduct of Defendant, Plaintiff Becky S. Moore sustained damages more fully set
forth herein.
12. As a direct and proximate result of the aforesaid collision and the negligence,
carelessness and recklessness of Defendant, Plaintiff Becky S. Moore suffered loss of earnings
in the amount of $195.95, and claim is made therefor.
13. As a direct and proximate result of the aforesaid collision and the negligence,
carelessness and recklessness of Defendant, Plaintiffs vehicle sustained severe damage
resulting in the total loss of the vehicle, valued at $4,9000.00, and claim is Illade therefor.
14. As a direct and proximate result of the aforesaid collision, negligence,
carelessness and recklessness of Defendant, Plaintiffs incurred a loss of $710.08, the cost of
substitute transportation, and claim is made therefor.

15. As a direct and proximate result of the aforesaid collision, negligence,
carelessness and recklessness of Defendant, Plaintiff incurred a loss of $945.00, the cost of
towing expenses and storage fees that occurred as a result of the damage to their vehicle, and
claim is made therefor.
WHEREFORE, Plaintiffs Becky S. Moore and Mark Moore demand judgment against
Defendant Jennifer Ann Dominiaui for the aforesaid damages in the amount of $6,751.03, plus
costs, interest and/or damages for delay as the law may allow. Said damages are within the
limits of cOlllpulsory arbitration in Cumberland County, Pennsylvania.
