WHEREAS, GEOFFREY O. MINTER and LAURA L. MINTER of 149 Pleasant Grove Road,
Mechanicsburg, Pennsylvania, is about to execute contemporaneously herewith, a contract, with
SECHRIST CONSTRUCTION of 701 lenna Court, Mechanicsburg, Pennsylvania, for the erection of a
building upon premises commonly known as LOT 3 DARLA ROAD, Borough of MECHANICSBURG,
CUMBERLAND County, Pennsylvania, as set forth in the deed dated f"eb. \'& \ Q.aaD , recorded
at Deed Book ,QILP , Page L\oa , in the Recorder's Office for CUMBERLAND County,
Pennsylvania, as more specifically described in Exhibit "A" which is incorporated herein and attached
hereto.
NOW, March 8, 2000, at the time of and immediately before the execution of the principal
contract, and before any authority has been given by the said Owner to the said Contractor to commence
work on the said building, or purchase materials for the same in consideration of the making of the said
contract with Contractor and the further consideration of One Dollar ($1.00), to Contractor paid by Owner,
it is agreed that no lien shall be filed against the building by the Contractor, or any subcontractor, nor by
any of the materialmen or workmen or any other person for any labor, or materials purchased, or extra
labor or materials purchased for the erection of said building, the right to file such liens being expressly
waived.

ALL that certain lot of unimproved land situated in the Second Ward in the
Borough of Mechanics burg, County of Cumberland and Commonwealth of
Pennsylvania, more particularly bounded and described as follows:
BEGINNING at a point on the southern side of DarIa Road on the lot
(south)side of a proposed sidewalk at the dividing line between Lots Nos. 3 and 2 as
shown on the hereinafter mentioned plan oflots; thence along said dividing line
between Lots Nos. 3 and 2, South 25 degrees 9 minutes East, a distance of 108.55
feet to a concrete monument at lands now or formerly of Ellen Hess Smith and
Joseph H. Hess; thence along said latter lands, South 64 degrees 51 minutes West,
a distance of 100 feet to a point at the dividing line between Lot 3 and Lot A as
shown on the hereinafter mentioned plan of lots; thence along said dividing line
between Lots 3 and A, North 25 degrees, 9 minutes West, a distance of 109.16 feet
to a point on the lot (south) side of a proposed sidewalk on the southern side of
DarIa Road; thence along said side of proposed sidewalk, the following two (2)
courses and distances: (a) North 65 degrees 26 minutes 20 seconds East, a distance
of 56.04 feet to a point; and (b) North 64 degrees 51 minutes East, a distance of
43.96 feet to a point on the same at the dividing line between Lots Nos. 3 and 2 as
shown on the hereinafter mentioned plan oflots, the place of BEGINNING.
BEING Lot No.3 as shown on a plan oflots entitled "PreliminaryIFinal
Subdivision Plan for Heritage Acres" dated April 14, 1999 (last revised July 20,
1999) and recorded in the Office ofthe Recorder of Deeds in and for Cumberland
County, Pennsylvania, in Plan Book 79, Page 143.
