PETITION FOR RULE FOR JUDICIAL SALE
AND NOW, comes the Cumberland County Tax Claim Bureau, by its attorney,
Stephen D. Tiley, Esquire, Assistant Cumberland County Solicitor, and files this Petition
for Rule for Judicial Sale, of which the following is a statement:
1. Your Petitioner is the County of Cumberland through its Tax Claim
Bureau, a Bureau created by the Real Estate Tax Sale Law. 72 P.S. g5860.1 01, et sic.
2. Pursuant to 72 P.S. g5860.610, your Petitioner respectfully represents
as follows:
a. Tax claim upon which the property was exposed for sale: 1994
Carlisle Borough, 1995 through and including 1998 Cumberland
County, Cumberland County Library and Carlisle Borough real
estate taxes. 1994-95 through and including 1998-99 Carlisle
Area School District real estate taxes. Total amount of claim,
including penalty and interest as of date of tax sale: $2,992.81.
b. Neither the owner, his, her, their, or its heirs, successors,
assigns, or legal representatives, or any lien creditor, or his, her,
their or its heirs, successors or legal representatives, or any other
person interested, has caused stay of sale, discharge of tax claim
or removal from tax sale.
c. The property was exposed to public sale pursuant to 72 P.S.
S5860.6010n: September 27,1999.
d. Before exposing the property to public sale the Bureau fixed
the upset sale price, pursuant to 27 P.S. g5860.605, which upset
price was $3,476.34.

e. Your Petitioner, the Bureau, was unable to obtain a bid at
the public sale sufficient to pay the said upset price.
3. Attached hereto, marked Exhibit "A," and incorporated herein by reference
as if fully set forth herein, is a copy of a title report received from a title searcher
retained by the Bureau together with a reduced copy of the most recent deed for the
subject premises, as well as a copy of the front page of an installment agreement for the
property. The tax parcel number of the property is 05-20-1798-057. The property is
situate in the Borough of Carlisle, Cumberland County, Pennsylvania, and is known as
331 North West Street.
4. The names and addresses of all parties holding tax and municipal claims,
liens, mortgages, ground rents, charges and estates against the property are as follows:

The Cumberland County Tax Claim Bureau shall publish a general notice describing
by address the property sold, the name of the prior owner or reputed owner, the fact that
the property was sold at a Judicial Sale held on July 28,2000, the filing of the within Petition
for Confirmation of Judicial Sale, and providing that the Sale will be confirmed absolutely
and finally unless objections or exceptions to the Sale are filed on or before forty-five (45)
days from the date hereof. Said notice may combine all properties sold on July 28, 2000,
Said notice by the Cumberland County Tax Claim Bureau shall be published in the
Cumberland Law Journal, The Harrisburg Patriot News and, The Sentinel, within fifteen (15)
days of the date of this Confirmation Nisi. Any objections or exceptions to this
Confirmation Nisi must be filed within forty-five (45) days of the date hereof. The Bureau
shall also mail a copy of this Confirmation Nisi and its accompanying Petition to the parties
named below, by regular United States mail, complete upon mailing, irrespective of any

PETITION FOR CONFIRMATION OF JUDICIAL SALE
1. Petitioner is the Cumberland County Tax Claim Bureau (hereinafter called
"Bureau") created under the provisions of the Real Estate Tax Sale Law of the
Commonwealth of Pennsylvania Act of July 7, 1947, P.L.1368, as amended 72
P,S,95860,101 et seq,
2. This Petition for Confirmation of Judicial Sale concerns a parcel of real
estate which was successfully sold at a Judicial Sale of real estate on July 28, 2000,
which is tax parcel number 05-20-1798-057, owned prior to the Judicial Sale, or
reputedly owned prior to the Judicial Sale, by Walter and Lindora A. Johnson, or
Rachel M. Wilkinson, alkJa Rachel M. Godbolt, and consisting of the property situate in
the Borough of Carlisle, Cumberland County, Pennsylvania, and is known as 331
North West Street. The property was sold on July 28, 2000 by the Cumberland County
Tax Claim Bureau pursuant to the Court's Order of June 9, 2000 ordering and
directing that the property be sold to the highest bidder freed and cleared of all tax and
municipal claims, liens, mortgages, charges and estates, except separately taxed
ground rents.
3. Advertisement of such sale was made by one insertion in three
newspapers of general circulation in Cumberland County and one insertion in the
Petition for Confirmation of Judicial Sale (Parcel No. 05.20-1798.057)

Cumberland Law Journal, all of which at least thirty (30) days prior to the sale dale,
Proofs of such pUblication are attached hereto, marked Exhibit "A", and incorporated
herein by reference thereto.
4. At the said Judicial Sale on July 28, 2000 the property of Walter and
Lindora a. Johnson, or Rachel M. Wilkinson, a/kla Rachel M. Godbolt known as tax
parcel number 05-20-1798-057 was sold for $3,000.00, a price equal to or in excess
of the minimum bid acceptable to the Tax Claim Bureau, to David C, Sheibley of 67
West North Street, Carlisle, PA 17013, who paid said purchase price to the Tax Claim
Bureau at the time of sale,
5. After the sale, on August 4, 2000, Lindora A. Johnson, Racheal Godbolt
and Walter Johnson were mailed a notice that the property had been sold, to their last
known address, as evidenced by the copies of Notice and receipt for mailing attached
hereto, marked Exhibit "B" incorporated herein by reference hereto. The envelopes
were sent by United States mail, return receipt requested. Return receipts were
received for Lindora A Johnson and Racheal Godbolt only,
6. There is no express post-Judicial Sale procedure known to your
Petitioner except for the following portion of 612(a) of the Real Estate Tax Sale Law:
Out of the proceeds of such sale shall be paid the costs set
forth in the upset price at the prior sale, and the additional costs
incurred relative to this sale, including the fee for title search....
The remainder of said proceeds shall be distributed by the office
designated by the county commissioners under section 205.
After the purchaser shall have paid over the purchase price, the
bureau shall make and deliver a deed in the manner herein-
before provided.

certified mail, restricted delivery, return receipt requested for the post-sale notice to
the prior owner.
7, Your Petitioner respectfully requests that the Bureau be ordered to send
a copy of this Petition and the Court's Confirmation Nisi to Undora A. Johnson,
Racheal Godbolt and Walter Johnson at their last known address, by regular United
States mail, complete upon mailing, irrespective of any return as undeliverable.
8. Your Petitioner respectfully requests that the Court's Confirmation Nisi
provide that a consolidated notice regarding properties sold on July 28, 2000 be
published once in The Cumberland Law Journal, The Harrisburg Patriot News, and
The Sentinel within fifteen (15) days of the date of the Confirmation Nisi, and that any
exceptions or objections thereto be filed within forty-five (45) days of the Court's order.
WHEREFORE the Bureau respectfully requests your Honorable Court to enter a
Confirmation Nisi in accordance with this Petition.

AND NOW, comes the Cumberland County Tax Claim Bureau, by its attorney,
Stephen D. Tiley, Esquire, Assistant Cumberland County Solicitor, and files this Petition
for Rule for Judicial Sale, of which the following is a statement:
1, Your Petitioner is the County of Cumberland through its Tax Claim
Bureau, a Bureau created by the Real Estate Tax Sale Law. 72 P.S. 95860.101, et sic,
2. Pursuant to 72 P.S. 95860,610, your Petitioner respectfully represents
as follows:
a, Tax claim upon which the property was exposed for sale: 1994
Carlisle Borough, 1995 through and including 1998 Cumberland
County, Cumberland County Library and Carlisle Borough real
estate taxes, 1994-95 through and including 1998-99 Carlisle
Area School District real estate taxes, Total amount of claim,
including penalty and interest as of date of tax sale: $2,992,81.
b. Neither the owner, his, her, their,or its heirs, successors,
assigns, or legal representatives, or any lien creditor, or his, her,
their or its heirs, successors or legal representatives, or any other
person interested, has caused stay of sale, discharge of tax claim
or removal from tax sale.
c. The property was exposed to public sale pursuant to 72 P.S.
95860.601 on: September 27,1999.
d. Before exposing the property to public sale the Bureau fixed
the upset sale price, pursuant to 27 P.S. 95860,605, which upset
price was $3,476,34,
