AND NOW, comes the Cumberland County Tax Claim Bureau, by its attorney,
Stephen 0, Tiley, Esquire, Assistant Cumberland County Solicitor, and files this Petition
for Rule for Judicial Sale, of which the following is a statement:
1, Your Petitioner is the County of Cumberland through its Tax Claim
Bureau, a BureClu created by the Real Estate Tax Sale Law. 72 P.S, 95860.101, et sic.
2, Pursuant to 72 P,S. 95860.610, your Petitioner respectfully represents
as follows:
a. Tax claim upon which the property was exposed for sale: 1992
through and including 1998 Cumberland County, Cumberland
County Library and Hampden Township real estate taxes. 1992-93
through and including 1998-99 Cumberland Valley School District real
estate taxes, Total amount of claim, including penalty and interest
as of date of tax sale: $2,420,96,
b. Neither the owner, his, her, their, or its heirs, successors,
assigns, or legal representatives, or any lien creditor, or his, her,
their or its heirs, successors or legal representatives, or any other
person interested, has caused stay of sale, discharge of tax claim
or removal from tax sale,
c. The property was exposed to public sale pursuant to 72 P,S.
95860.601 on: September 27,1999,
d. Before exposing the property to public sale the Bureau fixed
the upset sale price, pursuant to 27 P.S. 95860.605, which upset
price was $2,647.83,

e, Your Petitioner, the Bureau, was unable to obtain a bid at
the public sale sufficient to pay the said upset price,
3. Attached hereto, marked Exhibit "A," and incorporated herein by reference
as if fully set forth herein, is a copy of a title report received from a title searcher
retained by the Bureau together with a reduced copy of the most recent deed for the
subject premises, as of the date of the search. The tax parcel number of the property is
10-17-1037-001, The property is situate in the Township of Hamden, Cumberland
County, Pennsylvania, and does not have a formal address but is described on the
assessment records as 0000 Beech Run Lane, containing two acres, more or less.

Count 1 - Petition for Correction of Order
1. Petitioner is the Cumberland County Tax Claim Bureau (hereinafter called
"Bureau") created under the provisions of the Real Estate Tax Sale Law of the
Commonwealth of Pennsylvania Act of July 7, 1947, P.L.1368, as amended 72
P.S'S5860.101 et seq.
2. This Petition for Correction of Order concerns a parcel of real estate
which was exposed to Judicial Sale of real estate on July 28, 2000, which was tax
parcel number 10-17-1037-001, owned prior to the Judicial Sale, or reputedly owned
prior to the Judicial Sale, by South Central Service Corp., and consisting of property
situate in the Township of Hamden, Cumberland County, Pennsylvania, and known
as 0000 Beach Run Lane.
3. The property was sold on July 28, 2000 by the Cumberland County Tax
Claim Bureau pursuant to what the Bureau believed to be the Court's Order of June 9,
2000, which the Bureau believed ordered and directed that the property be sold to the

highest bidder freed and cleared of all tax and municipal claims, liens, mortgages,
charges and estates, except separately taxed ground rents.
4. This action was initiated by Petition For Rule For Judicial Sale filed on
March 10,2000 to which a Rule to Show Cause was entered on March 15,2000. The
said Rule was returnable on June 9, 2000 at 1 :30 p.m.
5. There were a total of fifteen properties from the 1999 upset tax sale for
which Petitions for Judicial Sale were filed on March 10, 2000. Those fifteen cases
were filed to numbers 2000-1405 through 2000-1419. All 15 cases had the same
Rule Returnable date and time of June 9, 2000 at 1 :30 p.m.
6. At the Rule Returnable date and time each matter was considered
separately, in the order of their file numbers, to wit: beginning with No. 2000-1405 and
ending with No. 2000-1419.
7. At the Rule Returnable date and time, for each of the 15 cases, the
Bureau asked for one of three orders, to wit: (i) A general continuance (if the Bureau
continued to have difficulty obtaining service); (Ii) An order fixing a sale date of July
28, 2000; and (iii) A withdraw of the Petition if the taxes had been paid.
8. At the Rule Returnable date and time Stephen D. Tiley, Assistant
Cumberland County Solicitor, counsel for the Bureau, kept notes of each case and the
requested outcome, which was the outcome ordered in each case. A copy of those
notes is attached hereto as Exhibit "A" and incorporated herein by reference thereto.

9. In each of the 15 cases, at the Rule Returnable date and time, the Court
entered an Order from the bench, which order was thereafter transcribed and signed
by the Court.
10. Unfortunately, not all of the orders were transcribed correctly such that in
some of the 15 cases the outcome requested and ordered from the bench is different
than the ultimate written order which was executed. Unfortunately this error was not
noticed until after the sale date of July 28, 2000. The above captioned matter is one of
the cases where the Bureau believes, and therefore avers, that the ultimate written
order failed to correctly reflect the relief ordered from the bench.
11. Exhibit "B" attached her.eto and incorporated herein by reference thereto
is a summary of the 15 cases, the relief sought and ordered from the bench, the relief
granted in the written orders, and the current status of the matter.
12. A copy of the Court's written order of June 9, 2000 is attached hereto as
Exhibit "C."
13. Petitioner believes and therefore avers that a transcript of the Rule
Returnable Hearing on June 9, 2000 will show that the court actually ordered that the
property be sold on July 28, 2000.
WHEREFORE, Petitioner prays your honorable Court for an order correcting the
June 9, 2000 written Order to show that the property was ordered sold on July 28,
2000.

16. At the said Judicial Sale on July 28,2000 the property of South Central
Service Corp. known as tax parcel number 10-17-1037-001 was sold for $750.00, a
price equal to or in excess of the minimum bid acceptable to the Tax Claim Bureau, to
Thomas J. & Clara M. Hartung of 826 Anthony Drive, Mechanicsburg, PA 17055, who
paid said purchase price to the Tax Claim Bureau at the time of sale.

interest in the real estate, but was comforted to know that the assessed value
according to the year 2000 reassessment was $5,290. Upon learning that the
employee stated that "then he was not interested," or words to that effect.
18. There is no express post-Judicial Sale procedure known to your
Petitioner except for the following portion of 612(a) of the Real Estate Tax Sale Law:
Out of the proceeds of such sale shall be paid the costs set
forth in the upset price at the prior sale, and the additional costs
incurred relative to this sale, including the fee for title search....
The remainder of said proceeds shall be distributed by the office
designated by the county commissioners under section 205.
After the purchaser shall have paid over the purchase price, the
bureau shall make and deliver a deed in the manner herein-
before provided.
72 P.S. s5860.612(a)(footnote omitted). The reference to Section 205 is, of course,
72 P.S. S5860.205. Your Petitioner, however, desires to proceed by a procedure
analogous to the Consolidated Return to Court Procedure set forth in S607 or the
Real Estate Tax Sale Law (72 P.S. S5860.607), however without the requirement of
certified mail, restricted delivery, return receipt requested for the post-sale notice to
the prior owner.
19. Your Petitioner respectfully requests that the Bureau be ordered to send
a copy of this Petition and the Court's Confirmation Nisi to South Central Service Corp.
at its last known address, by regular United States mail, complete upon mailing,
irrespective of any return as undeliverable.
20.. Your Petitioner respectfully requests that the Court's Confirmation Nisi
provide that a consolidated notice regarding properties sold on July 28, 2000 be
published once in The Cumberland Law Journal, The Harrisburg Patriot News, and
The Sentinel within fifteen (15) days of the date of the Confirmation Nisi, and that any
exceptions or objections thereto be filed within forty-five (45) days of the Court's order,

The Real Estate Tax Sale Lawpro-
vides that: "There shail be no re-
demption on any Property after the
sale thereof. and the sale. when con-
firmed shall be deemed to pass a
good and valld titie to the purchaser",
(501(c) of Real Estate Tax Sale Law).
The sale of any property may be
stayed If the OWIler thereof or any
interested party. pays the delinquent
tax amount and costs in full prior to
the time of sale.
CONDITIONS OF SALE
Successful bidders at the Judicial
Sale will be required to provide certi-
fication to the bUreau that he or she
Is not delinquent in paying real es-
tate taxes to any of the taxing dis-
tricts in the county where the prop-
erty 1s located and the successful
bidder has no municipal utility bills
that are more than one year out-
standing. Cerllflcation shall be by
actual receipts of paid real estate
taxes and muniCipal ull!lty bill or by
a notar1zed affidavit that all such
taxes and bills are paid. Affidavits for
certification will be available at the
time and place of sale. Successful
bidders will need photo identification
for notary of the . certification. The
Cumberland County Tax Claim Bu-
reau requires that cert1ftcation be
provided at the time of successful bid
and payment of the purchase price.
The purchaser of any property at
any such sale shall. as soon as the
property is struck down, pay to the

Bureau the entire purchase money.
Payment shall be cash 1n the form of
currency of the United States or
check payable to County of Cumber-
land. In case said amount is not so
paid, the sale shail be voided and
property shall be put up again at the
same sale. Deeds for the premises
will be prepared by the Tax Claim
Bureau and recorded and mailed to
the address given by the buyer at the
sale. Buyers will be required to pay,
in addition to their bid, at the time
the property is struck down to them,.

and the cost of such realty transfer
tax as may be necessary.

at the lime unless a bid Is received
equal to or greater. than the fixed
