Rule shall be made to all parties listed at paragraphs four and five of the within Petition
in the manner provided by Section 611 of the Real Estate Tax Sale Law.

AND NOW, comes the Cumberland County Tax Claim Bureau, by its attorney,
Stephen D. Tiley, Esquire, Assistant Cumberland County Solicitor, and files this Petition
for Rule for Judicial Sale, of which the following is a statement:

1. Your Petitioner is the County of Cumberland through its Tax Claim
Bureau, a Bureau created by the Real Estate Tax Sale Law. 72 P.S. 35860.101, et sic.
2. Pursuant to 72 P.S. 35860.610, your Petitioner respectfully represents
as follows:
a. Tax claim upon which the property was exposed for sale: 1982
through and including 1998 Cumberland County, Cumberland
County Library and North Middleton Township real estate taxes.
1981-82 through and including 1998-99 Carlisle Area School District
real estate taxes. Total amount of claim, including penalty and interest
as of date of tax sale: $2,182.78.
b. , Neither the owner, his, her, their, or its heirs, successors,
assigns, or legal representatives, or any lien creditor, or his, her,
their or its heirs, successors or legal representatives, or any other
person interested, has caused stay of sale, discharge of tax claim
or removal from tax sale.
c. The property was exposed to public sale pursuant to 72 P.S.
35860.601 on: September 27, 1999.
d. Before exposing the property to public sale the Bureau fixed
the upset sale price, pursuant to 27 P.S. 35860.605, which upset
price was $2,255.61.

Your Petitioner, the Bureau, was unable to obtain a bid at
the public sale sufficienUo pay the said upset price.
3. Attached hereto, marked Exhibit "A," and incorporated herein by reference
as if fully set forth herein, is a copy of a title report received from a title searcher
retained by the Bureau together with a reduced copy of the most recent deed for the
subject premises, as of the date of the search. The tax parcel number of the property is
29-14-0868-125. The property is situate in the Township of North Middleton,
Cumberland County, Pennsylvania, and does not have a formal address but it described
on the assessment records as 0000 Rear Faith Circle, and may contain 4.22 acres,
more or less.
4. The names and addresses of all parties holding tax and municipal claims,
liens, mortgages, ground rents, charges and estates against the property are as follows:

Delinquent taxes payable through March 31, 2000: $2,252.86
(Includes taxes through 1999 County, Library and Township now
returned to Tax Claim Bureau.)

1999-00 Carlisle Area School District taxes payable at penalty
in the amount of $61.75.
5. The last known address of the owner of the property as set forth in
the assessment records of Cumberland County is: % John Perri, 158 Faith Circle
Carlisle, Pennsylvania 17013.

WHEREFORE, Your Petitioner prays your Honorable Court to grant a rule upon
all interested parties, including those listed at paragraphs four and five of the within'
Petition, to show cause why a decree should not be made that the property be sold,
freed and cleared of tax and municipal claims, liens, mortgages, charges and estates,
except separately taxed ground rents, pursuant to Section 612 of the Real Estate Tax
Sale Law. 72 P.S. g5860.612(a).

PURSUANT TO SPECIAL ORDER OF COURT

AND NOW, this
day of November, 2000, comes the Cumberland County
Tax Claim Bureau, by its attorney, Stephen D. Tiley, Esquire, Assistant Cumberland
County Solicitor, and files this Motion for Service Pursuant to Special Order of Court by
Publication and Regular Mail Pursuant to Pa.R.C.P. 430, of which the following is a
statement:
1. On or about March 10, 2000 your Petitioner, the Cumberland County Tax
Claim Bureau, filed a Petition for Rule for Judicial Sale of the property of Kingsbrook
Civic Association, known as Cumberland County tax parcel number 29-14-0868-125,
to the above captioned term and number.
2. On March 15, 2000 your Honor issued a Rule to Show Cause returnable
June 9, 2000. On June 9, 2000, at the request of the Bureau, the Court entered an
order continuing the matter generally.
3. Service was not able to be made upon the prior reputed owner

Kingsbrook Civic Association at its last known address as disclosed by the public
records, to wit: clo John Perri, 158 Faith Circle, Carlisle, PA 17013. The Sheriff's
return indicates: "Kingsbrook Civic Assoc. is now defunct, John Perri does not live at
address stated, no fwdg."
4. Movant made efforts to locate the Kingsbrook Civic Association as
described in the affidavit of Jacob L Heisey attached hereto, marked Exhibit "A," and
incorporated herein by reference thereto as if fully set forth herein.
5. Movant requests your Honorable Court to enter an Order for Service by
ordinary mail upon Kingsbrook Civic Association at its last known address as
disclosed by the public records, irrespective of whether the said envelope is returned
undeliverable.
6. Section 611 of the Real Estate Tax Sale Law (72 P.S. S5860.611)
provides, inter alia.: "The sheriff shall attach to his return, the return receipts, and if
the person named in the rule has refused to accept the registered mail or cannot be
found at his last known address, shall attach evidence thereof. This shall constitute
sufficient service under this act." (footnote omitted.)
7. Notwithstanding Section 611 of the Real Estate Tax Sale Law, Movant
also requests an Order for Service by publication pursuant to Pa. RCP. 430 pursuant
to the advertisement attached hereto as Exhibit "8."
8. Movant requests a new rule returnable date at least 45 days after the

date of the Court's Rule and an Order directing service by publication, at least fifteen
(15) days prior to that rule returnable date pursuant to the advertisement attached
hereto as Exhibit "A"
WHEREFORE, Movant prays Your Honorable Court for an Order as follows:
(i) That a new Rule be issued with a rule returnable date set
at least forty-five (45) days after the date of the Court's Rule to Show
Cause.
(ii) That service of the Rule to Show Cause upon Kingsbrook
Civic Association be made by publication of the advertisement attached
hereto as Exhibit "B" once in the Cumberland Law Journal and once in
The Sentinel of Carlisle, Pennsylvania, at least 15 days prior to the rule
returnable date, and;
(iii) That service upon Kingsbrook Civic Association also be
made by mailing of a certified copy of the Rule by ordinary United
States mail to it at its last address as disclosed by the public records,
and that such service be complete upon mailing, regardless of
whether or not the envelope is returned undeliverable.

my principle place of business at the Old Cumberland County Courthouse, Carlisle,
Cumberland County, Pennsylvania, do hereby swear and affirm as follows:
1. The only address set forth in the Cumberland County Assessment
records and in the records of the Cumberland County Tax Claim Bureau for Kingsbrook
Civic Association is c/o John Perri, 158 Faith Circle, Carlisle, PA 17013.
2. I reviewed the records of the Cumberland County Occupation Assessment
Office as of May 17, 2000 and found no listing for John Perri.
3. I performed a marriage license computer search of the records of the
Cumberland County Register of Wills Office from approximately 1994 to May 17, 2000
and found no record for John Perri.
4. I have researched the current Harrisburg area and Cumberland
Countywide telephone directories and found no entry for John Perri or Kingsbrook Civic
Association.
5. I have reviewed the current deed recorded in the Cumberland County
Recorder of Deeds Office and found no other address listing for John Perri or
Kingsbrook Civic Association.
6. I have questioned a few of the adjoining property owners and was
informed that Kingsbrook Civic Association is currently non-existent.

AND NOW, comes the Cumberland County Tax Claim Bureau, by its attorney,
Stephen D. Tiley, Esquire, Assistant Cumberland County Solicitor, and files this Petition
for Rule for Judicial Sale, of which the following is a statement:
1. Your Petitioner is the County of Cumberland through its Tax Claim
Bureau, a Bureau created by the Real Estate Tax Sale Law. 72 P.S. ~5860.101, et sic.
2. Pursuant to 72 P.S. ~5860.61 0, your Petitioner respectfully represents
as follows:
a. Tax claim upon which the property was exposed for sale: 1982
through and including 1998 Cumberland County, Cumberland
County Library and North Middleton Township real estate taxes.
1981-82 through and including 1998-99 Carlisle Area School District
real estate taxes. Total amount of claim, including penalty and interest
as of date of tax sale: $2,182.78.
b. Neither the owner, his, her, their, or its heirs, successors,
assigns, or legal representatives, or any lien creditor, or his, her,
their or its heirs, successors or legal representatives, or any other
person interested, has caused stay of sale, discharge of tax claim
or removal from tax sale.
c. The property was exposed to public sale pursuant to 72 P .5.
S5860.601 on: September 27,1999.
d. Before exposing the property to public sale the Bureau fixed
the upset sale price, pursuant to 27 P.S. 95860.605, which upset
price was $2,255.61.

e. Your Petitioner, the Bureau, was unable to obtain a bid at
the public sale sufficient to pay the said upset price.
3. Attached hereto, marked Exhibit "A," and incorporated herein by reference
as if fully set forth herein, is a copy of a title report received from a title searcher
retained by the Bureau together with a reduced copy of the most recent deed for the
subject premises, as of the date of the search. The tax parcel number of the property is
29-14-0868-125. The property is situate in the Township of North Middleton,
Cumberland County, Pennsylvania, and does not have a formal address but it described
on the assessment records as 0000 Rear Faith Circle, and may contain 4.22 acres,
more or less.
4. The names and addresses of all parties holding tax and municipal claims,
liens, mortgages, ground rents, charges and estates against the property are as follows:
