AND NOW, this
day of November, 2000, comes the Cumberland County
Tax Claim Bureau, by its attorney, Stephen D. Tiley, Esquire, Assistant Cumberland
County Solicitor, and files this Motion for Service Pursuant to Special Order of Court by
Publication and Regular Mail Pursuant to Pa.R.C.P. 430, of which the following is a
statement:
1. On or about March 10, 2000 your Petitioner, the Cumberland County Tax
Claim Bureau, filed a Petition for Rule for Judicial Sale of the property of Stephen N.
Marquis and Mary E. Marquis, known as Cumberland County tax parcel number 38-
17-1023-014A, to the above captioned term and number.
2. On March 15, 2000 your Honor issued a Rule to Show Cause returnable
June 9, 2000. On June 9, 2000, at the request of the Bureau, the Court entered an
order continuing the matter generally.
3. Service was not able to be made upon the prior reputed owners Stephen

records, to wit; 40 West Willow Terrace Drive, Mechanicsburg, Pennsylvania 17055.
The Sheriff's return shows that: "Deft. no longer resides at address stated, left no
forwarding with the post office."
4. Movant made efforts to locate Stephen N. Marquis and Mary E. Marquis
as described in the affidavit of Jacob L. Heisey attached hereto, marked Exhibit "A,"
and incorporated herein by reference thereto as if fully set forth herein.
5. Movant requests your Honorable Court to enter an Order for Service by
ordinary mail upon Stephen N. Marquis and Mary E. Marquis at their last known
address as disclosed by the public records, irrespective of whether the said envelope
is returned undeliverable.
6. Section 611 of the Real Estate Tax Sale Law (72 P.S. 35860.611)
provides, inter alia.: "The sheriff shall attach to his return, the return receipts, and if
the person named in the rule has refused to accept the registered mail or cannot be
found at his last known address, shall attach evidence thereof. This shall constitute
sufficient service under this act." (footnote omitted.)
7. Notwithstanding Section 611 of the Real Estate Tax Sale Law, Movant
also requests an Order for Service by pUblication pursuant to Pa. R.C.P. 430 pursuant
to the advertisement attached hereto as Exhibit "8."
8. Movant requests a new rule returnable date at least 45 days after the

date of the Court's Rule and an Order directing service by publication, at least fifteen
(15) days prior to that rule returnable date pursuant to the advertisement attached
hereto as Exhibit "A."
WHEREFORE, Movant prays Your Honorable Court for an Order as follows:
(i) That a new Rule be issued with a rule returnable date set
at least forty-five (45) days after the date of the Court's Rule to Show
Cause.
(ii) That service of the Rule to Show Cause upon Stephen N.
Marquis and Mary E. Marquis be made by publication of the
advertisement attached hereto as Exhibit "B" once in the Cumberland
Law Journal and once in The Sentinel of Carlisle, Pennsylvania, at
least 15 days prior to the rule returnable date, and;
(iii) That service upon Stephen N. Marquis and Mary E.
Marquis also be made by mailing of a certified copy of the Rule by
ordinary United States mail to it at its last address as disclosed by the
public records, and that such service be complete upon mailing,
regardless of whether or not the envelope is returned undeliverable.

my principle place of business at the Old Cumberland County Courthouse, Carlisle,
Cumberland County, Pennsylvania, do hereby swear and affirm as follows:
1. The only address set forth in the Cumberland County Assessment
records and in the records of the Cumberland County Tax Claim Bureau for Stephen N.
and Mary E. Marquis is 40 W. Willow Terrace Drive, Mechanicsburg, PA 17055.
2. I reviewed the records of the Cumberland County Occupation Assessment
Office as of May 17, 2000 and found no listing for Stephen N. or Mary E. Marquis.
3. I performed a marriage license computer search of the records of the
Cumberland County Register of Wills Office from approximately 1994 to May 17, 2000
and found no record for Stephen N. or Mary E. Marquis.

AND NOW, comes the Cumberland County Tax Claim Bureau, by its attorney,
Stephen D. Tiley, Esquire, Assistant Cumberland County Solicitor, and files this Petition
for Rule for Judicial Sale, of which the following is a statement:
1. Your Petitioner is the County of Cumberland through its Tax Claim
Bureau, a Bureau created by the Real Estate Tax Sale Law. 72 P.S. 35860.101, et sic.
2. Pursuant to 72 P.S. 35860.610, your Petitioner respectfully represents
as follows:
a. Tax claim upon which the property was exposed for sale: 1984
through and including 1998 Cumberland County, Cumberland
County Library and Silver Spring Township real estate taxes. 1984-85
through and including 1998-99 Cumberland Valley School District rea.l
estate taxes. Total amount of claim, including penalty and interest
as of date of tax sale: $2,292.53.
b. Neither the owner, his, her, their, or its heirs, successors,
assigns, or legal representatives, or any lien creditor, or his, her,
their or its heirs, successors or legal representatives, or any other
person interested, has caused stay of sale, discharge of tax claim
or removal from tax sale.
c. The property was exposed to public sale pursuant to 72 P.S.
35860.601 on: September 27, 1999.
d. Before exposing the property to public sale the Bureau fixed
the upset sale price, pursuant to 27 P.S. 35860.605, which upset
price was $2,368.93.

the public sale sufficient to pay the said upset price.
3. Attached hereto, marked Exhibit "A," and incorporated herein by reference
as if fully set forth herein, is a copy of a title report received from a title searcher
retained by the Bureau together with a reduced copy of the most recent deed for the
subject premises, as of the date of the search. The tax parcel number of the property is
38-17-1023-014A. The property is situate in the Township of Silver Spring, Cumberland
County, Pennsylvania, and does not have a formal address but is described on the
assessment records as 0000 Old Willow Mill Road, unnumbered lot, Plan Book 3, Page
13.
4. The names and addresses of all parties holding tax and municipal claims,
liens, mortgages, ground rents, charges and estates against the property are as follows:

AND NOW, comes the Cumberland County Tax Claim Bureau, by its attorney,
Stephen D. Tiley, Esquire, Assistant Cumberland County SoliCitor, and files this Petition
for Rule for Judicial Sale, of which the following is a statement:
1. Your Petitioner is the County of Cumberland through its Tax Claim
Bureau, a Bureau created by the Real Estate Tax Sale Law. 72 P.S. 95860.101, et sic.
2. Pursuant to 72 P.S. 35860.610, your Petitioner respectfully represents
as follows:
a. Tax claim upon which the property was exposed for sale: 1984
through and including 1998 Cumberland County, Cumberland
County Library and Silver Spring Township real estate taxes. 1984-85
through and including 1998-99 Cumberland Valley School District real
estate taxes. Total amount of claim, including penalty and interest
as of date of tax sale: $2,292.53.
b. Neither the owner, his, her, their, or its heirs, successors,
assigns, or legal representatives, or any lien creditor, or his, her,
their or its heirs, successors or legal representatives, or any other
person interested, has caused stay of sale, discharge of tax claim
or removal from tax sale.
c. The property was exposed to public sale pursuant to 72 P.S.
35860.601 on: September 27,1999.
d. Before exposing the property to public sale the Bureau fixed
the upset sale price, pursuant to 27 P.S. 35860.605, which upset
price was $2,368.93.

e. Your Petitioner, the Bureau, was unable to obtain a bid at
the public sale sufficient to pay the said upset price.
3. Attached hereto, marked Exhibit "A," and incorporated herein by reference
as if fully set, forth herein, is a copy of a title report received from a title searcher
retained by the Bureau together with a reduced copy of the most recent deed for the
subject premises, as of the date of the search. The tax parcel number of the property is
38-17-1023-014A. The property is situate in the Township of Silver Spring, Cumberland
County, Pennsylvania, and does not have a formal address but is described on the
assessment records as 0000 Old Willow Mill Road, unnumbered lot, Plan Book 3, Page
13.
4. The names and addresses of all parties holding tax and municipal claims,
liens, mortgages, ground rents, charges and estates against the property are as follows:

Advertisement of such sale need only be advertised by one (1) insertion in two
(2) newspapers of general circulation in Cumberland County, and by one (1) insertion
in the Cumberland County Journal. Such advertisement shall appear at least thirty
(30) days prior to the sale date and need not include a list and description of the lands
to be sold, but need only include the purpose, the time, the place and the terms of
such sale, with a reference to the prior advertisement (72 P.S. 9 5860.612).
