Petition of Confirmation of Judicial Sale it is ordered and decreed that said Sale by the
Cumberland County Tax Claim Bureau shall be confirmed absolutely unless any
objections or exceptions to the Sale arefiJed on or before forty-five (45) days from the
date hereof.
The Cumberland County Tax Claim Bureau shall publish a general notice describing
by address the property sold, the name of the prior owner or reputed owner, the fact that
the property was sold at a Judicial Sale held on July 28, 2000, the filing of the within Petition
for Confirmation of Judicial Sale, and providing that the Sale will be confirmed absolutely
and finally unless objections or exceptions to the Sale are filed on or before forty-five (45)
days from the date hereof. Said notice may combine all properties sold on July 28, 2000.
Said notice by the Cumberland County Tax Claim Bureau shall be published in the
Cumberland Law Joumal, The Harrisburg Patriot News and, The Sentinel, within fifteen (15)
days of the date of this Confirmation Nisi. Any objections or exceptions to this
Confirmation Nisi must be filed within forty-five (45) days of the date hereof. The Bureau
shall also mail a copy of this Confirmation Nisi and its accompanying Petition to the party
named below, by regular United States mail, complete upon mailing, irrespective of any
retum as undeliverable.

PETITION FOR CORRECTION OF ORDER
AND FOR
CONFIRMATION OF JUDICIAL SALE
Count 1 - Petition for Correction of Order
1. Petitioner is the Cumberland County Tax Claim Bureau (hereinafter called
"Bureau") created under the provisions of the Real Estate Tax Sale Law of the
Commonwealth of Pennsylvania Act of July 7, 1947, P.L.1368, as amended 72
P.S.35860.101 et seq.
2. This Petition for Correction of Order concerns a parcel of real estate
which was exposed to Judicial Sale of real estate on July 28, 2000, which was tax
parcel number 05-20-1798-327, qwned prior to the Judicial Sale, or reputedly owned
prior to the Judicial Sale, by Hayes and Beverly L. Johnson, and consisting of property
situate in the Borough of Carlisle, Cumberland County, Pennsylvania, and known as
148 North West Street.
3. The property was sold on July 28, 2000 by the Cumberland County Tax
Claim Bureau pursuant to what the Bureau believed to be the Court's Order of June 9,
2000, which the Bureau believed ordered and directed that the property be sold to the

highest bidder freed and cleared of all tax and municipal claims, liens, mortgages,
charges and estates, except separately taxed ground rents.
4. This action was initiated by Petition For Rule For Judicial Sale filed on
March 10,2000 to which a Rule to Show Cause was entered on March 15,2000. The
said Rule was returnable on June 9, 2000 at 1 :30 p.m.
5. There were a total of fifteen properties from the 1999 upset tax sale for
which Petitions for Judicial Sale were filed on March 10, 2000. Those fifteen cases
were filed to numbers 2000-1405 through 2000-1419. All 15 cases had the same
Rule Returnable date and time of June 9, 2000 at 1 :30 p.m.
6. At the Rule Returnable date and time each matter was considered
separately, in the order of their file numbers, to wit: beginning with No. 2000-1405 and
ending with No. 2000-1419.
7. At the Rule Returnable date and time, for each of the 15 cases, the
Bureau asked for one of three orders, to wit: (i) A general continuance (if the Bureau
continued to have difficulty obtaining service); (ii) An order fixing a sale date of July
28, 2000; and (iii) A withdraw of the Petition if the taxes had been paid.
8. At the Rule Returnable date and time Stephen D. Tiley, Assistant
Cumberland County Solicitor, counsel for the Bureau, kept notes of each case and the
requested outcome, which was the outcome ordered in each case. A copy of those
notes is attached hereto as Exhibit "A" and incorporated herein by reference thereto.

9. In each of the 15 cases, at the Rule Returnable date and time, the Court
entered an Order from the bench, which order was thereafter transcribed and signed
by the Court.
10. Unfortunately, not all of the orders were transcribed correctly such that in
some of the 15 cases the outcome requested and ordered from the bench is different
than the ultimate written order which was executed. Unfortunately this error was not
noticed until after the sale date of July 28, 2000. The above captioned matter is one of
the cases where the Bureau believes, and therefore avers, that the ultimate written
order failed to correctly reflect the relief ordered from the bench.
11. Exhibit "B" attached hereto and incorporated herein by reference thereto
is a summary of the 15 cases, the relief sought and ordered from the bench, the relief
granted in the written orders, and the current status of the matter.
12. A copy of the Court's written order of June 9, 2000 is attached hereto as
Exhibit "C."
13. Petitioner believes and therefore avers that a transcript of the Rule
Returnable Hearing on June 9, 2000 will show that the court actually ordered that the
property be sold on July 28, 2000.
WHEREFORE, Petitioner prays your honorable Court for an order correcting the
June 9, 2000 written Order to show that the property was ordered sold on July 28,
2000.

Count 2 - Petition for Confirmation of Judicial Sale
14. The averments of paragraphs 1 through 13 of this Petition are
incorporated herein by reference thereto as if fully set forth herein.
15. Advertisement of the sale which Petitioner believes, and therefore avers,
was ordered on June 9, 2000, was made by one insertion in three newspapers of
general circulation in Cumberland County and one insertion in the Cumberland Law
Journal, all of which at least thirty (30) days prior to the sale dale. Proofs of such
publication are attached hereto, marked Exhibit "D", and incorporated herein by
reference thereto.
16. At the said Judicial Sale on July 28,2000 the property of Hayes & Beverly
L. Johnson known as tax parcel number 05-20-1798-327 was sold for $950.00, a
price equal to or in excess of the minimum bid acceptable to the Tax Claim Bureau, to
David C. Sheibley of 67 West North Street, Carlisle, PA 17013, who paid said
purchase price to the Tax Claim Bureau at the time of sale.
17. After the sale, on August 4, 2000, Hayes & Beverly L. Johnson were
mailed a notice that the property had been sold, to its last known address, as
evidenced by the copies of Notice and receipt for mailing attached hereto, marked
Exhibit "E" incorporated herein by reference hereto. The envelopes were sent by
United States mail, return receipt requested, however no return receipt was received.
18. There is no express post-Judicial Sale procedure known to your
Petitioner except for the following portion of 612( a) of the Real Estate Tax Sale Law:
Out of the proceeds of such sale shall be paid the costs set
forth in the upset price at the prior sale, and the additional costs

incurred relative to this sale, including the fee for title search....
The remainder of said proceeds shall be distributed by the office
designated by the county commissioners under section 205.
After the purchaser shall have paid over the purchase price, the
bureau shall make and deliver a deed in the manner herein-
before provided.
72 P.S. 35860.612(a)(footnote omitted). The reference to Section 205 is, of course,
72 P.S. 95860.205. Your Petitioner, however, desires to proceed by a procedure
analogous to the Consolidated Return to Court Procedure set forth in 3607 or the
Real Estate Tax Sale Law (72 P.S. 35860.607), however without the requirement of
certified mail, restricted delivery, return receipt requested for the post-sale notice to
the prior owner.
19. Your Petitioner respectfully requests that the Bureau be ordered to send
a copy of this Petition and the Court's Confirmation Nisi to Hayes & Beverly L.
Johnson at their last known address, by regular United States mail, complete upon
mailing, irrespective of any return as undeliverable.
20. Your Petitioner respectfully requests that the Court's Confirmation Nisi
provide that a consolidated notice regarding properties sold on July 28, 2000 be
published once in The Cumberland Law Journal, The Harrisburg Patriot News, and
The Sentinel within fifteen (15) days of the date of the Confirmation Nisi, and that any
exceptions or objections thereto be filed within forty-five (45) days of the Court's order.
WHEREFORE the Bureau respectfully requests your Honorable Court to enter a

I, Jacob Heisey, Tax Administration Supervisor, acknowledges that I have the
authority to execute the foregoing Petition for Correction of Order and for Confirmation
of Sale on behalf of the Cumberland County Tax Claim Bureau and certify that the
foregoing Petition is true and correct based partly upon personal knowledge and the
remainder upon information and belief and upon information which has been
gathered by counsel in the preparation of the said Petition. The language of this
Petition is that of counsel and not my own. I have read the document and to the extent
that the Petition is based upon information which I have given to my counsel, it is true

ORDER OF COURT
AND NOW, this 9th day of June, 2000, upon
consideration of the petition for rule for judicial sale, filed at
number 2000-1418 Civil Term with respect to tax parcel number
05-20-1798-327, and pursuant to a motion of Petitioner's counsel,
Stephen D. Tiley, Esquire, in open court, indicating that the
taxes have been paid with respect to this property, and requesting
dismissal of the petition, the motion is granted, the rule to show
cause issued on March 15, 2000 is discharged, and the petition for
rule for judicial sale is deemed w~thdrawn.

AND NOW, comes the Cumberland County Tax Claim Bureau, by its attorney,
Stephen D. Tiley, Esquire, Assistant Cumberland County Solicitor, and files this Petition
for Rule for Judicial Sale, of which the following is a statement:
1. Your Petitioner is the County of Cumberland through its Tax Claim
Bureau, a Bureau created by the Real Estate Tax Sale Law. 72 P.S. ~5860.1 01, at sic.
2. Pursuant to 72 P.S. ~5860.61 0, your Petitioner respectfully represents
as follows:
a. Tax claim upon which the property was exposed for sale: 1985
through and including 1998 Cumberland County, Cumberland
County Library and Carlisle Borough real estate taxes. 1984-85
through and including 1998-99 Carlisle Area School District real
estate taxes. Total amount of claim, including penalty and interest
as of date of tax sale: $8,331.27.
b. Neither the owner, his, her, their, or its heirs, successors,
assigns, or legal representatives, or any lien creditor, or his, her,
their or its heirs, successors or legal representatives, or any other
person interested, has caused stay of sale, discharge of tax claim
or removal from tax sale.
c. The property was exposed to public sale pursuant to 72 P.S.
~5860.601 on: September 27, 1999.
d. Before exposing the property to public sale the Bureau fixed
the upset sale price, pursuant to 27 P.S. ~5860.605, which upset
price was $8,751.54.

e. Your Petitioner, the Bureau, was unable to obtain a bid at
the public sale sufficient to pay the said upset price.
3. Attached hereto, marked Exhibit "A," and incorporated herein by reference
as if fully set forth herein, is a copy of a title report received from a title searcher
retained by the Bureau together with a reduced copy of the most recent deed for the
subject premises, as of the date of the search. The tax parcel number of the property is
05-20-1798-327. The property is situate in the Borough of Carlisle, Cumberland
County, Pennsylvania, and is known as 148 North West Street.
4. The names and addresses of all parties holding tax and municipal claims,
