CIVIL ACTION - MORTGAGE FORECLOSURE
THIS IS AN ATTEMPT TO COLLECT A DEBT ANY INFORMATION OBTAINED
WILL BE USED FOR THAT PURPOSE
1, Plaintiff is GMAC Mortgage Corporation, formerly known
as GMAC Mortgage Corporation of PA, successor by merger with
GMAC Mortgage Corporation of Iowa, a corporation organized and
existing under the laws of the Commonwealth of pennsylvania with
corporate offices located at 500 Enterprise Road, Harsham, PA
19044.
2. Defendants, Peggy D. Felix, now known as Peggy D,
Swensson is the mortgagor and Peggy D. Felix, now known as Peggy
D. Swensson and Stephen F. Swensson are the real owners of

premises 115 Cherry Grove Road, Shippensburg, PA 17257,
hereinafter described, whose last known address is the same as
above.
3. Plaintiff brings this action in mortgage foreclosure
against defendants, mortgagor and real owners, to foreclose a
certain indenture of mortgage made, executed and delivered by
Peggy D. Felix now known as Peggy D. Swensson the above named
defendant, mortgagor and real owner to Parent Federal Savings on
August 8, 1992 which mortgage is recorded in the Office for
Recording of Deeds of Cumberland County in Mortgage Book 1087,
page 500, secured on premises 115 Cherry Grove Road,
Shippensburg, PA 17257 a true and correct description of which
is attached hereto as Exhibit I.
4. On January 31, 1995, Parent Federal Savings assigned
the said mortgage to Weyerhauser Mortgage Corporation, by
written assignment which is recorded in the Office for the
Recording of Deeds of Cumberland County in Miscellaneous Book
496, page 673.
5, On May 16, 1996, Weyerhauser Mortgage Corporation,
assigned the said mortgage to Capstead, Inc. by written
assignment which is recorded in the Office for the Recording of
Deeds of Cumberland County in Miscellaneous Book 523, page 125.

6. On May 28, 1999, Capstead, Inc. assigned the said
mortgage to GMAC Mortgage Corporation, the plaintiff herein, by
written assignment which is recorded in the Office for the
Recording of Deeds of Cumberland County in Miscellaneous Book
614, page 346.
7. Plaintiff alleges each and every term, condition and
covenant in the aforesaid mortgage, and hereby incorporates them
herein by reference thereto.
8. Title to the said mortgaged premises is vested in
Stephen D. Swensson and Peggy D. Felix now known as Peggy D.
Swensson by deed from Stephen D. Swensson a~d Peggy D. Felix now
known as Peggy D. Swensson dated June 6, 1994 and recorded in
the Office for the Recording of Deeds of Cumberland County in
Deed Book 108, page 109.
9. The aforesaid mortgage is in default in that the
defendants, mortgagors and real owners have failed to make
payment of the monthly installments of principal and interest in
accordance with the terms of the mortgage, for the month of
April 1, 1998 and each month thereafter, up to and including the
present time.
10. Under the terms of the aforesaid mortgage, upon
default of payments set forth in the mortgage documents, the
entire principal balance and all interest due thereon are
collectible forthwith.

9. Plaintiff sent to defendants, mortgagors and real
owners a combined Notice and Warning of Intention to Foreclose
and Notices of Homeowners' Emergency Mortgage Assistance Act of
1983 advising them of their rights under the statute (copies
attached as Exhibit II), To date defendants have neither made
payment nor indicated that they have taken any steps to avail
themselves of the financial assistance made available through
this legislation within the time established by this statute.
WHEREFORE, plaintiff demands judgment for $66,570.51, plus
per diem interest at $13.17 from 3/10/2000 to the date of
judgment plus monthly late charges of $23.20 from 2/15/2000 to
the date of judgment plus monthly inspections of $15.00 from
3/01/2000 to the date of judgment and escrow advances of $101.77
