Plaintiff, Keystone Financial Bank, N.A., by its attorney, William A. Duncan, flies this Complaint in Confession of Judgment. 1. Plaintiff, Keystone Financial Bank, N.A., is a Pennsylvania banking Corporation existing under the laws of the Commonwealth of Pennsylvania, with its principal place ofhusiness located at 1415 Ritner Highway, Carlisle, Cumherland County, Pennsylvania. 2. Defendants are, Richard J. Derr and Lori L. Derr, d/b/a Herr's Hauling, with a last known address of 7 Melwood Lane, Meehanicsburg, Cumberland County, Pennsylvania 17055. 3. On or about January 14, 1997, Defendants Richard J. Derr and Lori L. Derr entered into a Commercial Guarantee in favor ofPlaintift', Keystone Financial Bank, N.A., in the original principal amount of Twenty-four Thousand Eight Hundred Forty and 00/100 ($24,840.00) Dollars. A true and correct copy of the Note, which contains the Warrant of Attorney upon which this judgment is confessed, is attached hereto as Exhibit "A" and is a part hereof. 4. Defendants Richard J. Derr and Lori L. Derr, have defaulted in this obligation under the Guarantee by failing to make their November, Deeember 1999, January, Febrnary and March, 2000 payments of principal and interest due thereunder the terms of said note. 5. Pursuant to the Guarantee, judgment may be entered against Defendants Richard J. Derr and Lori L. Derr, for an monies due without notice or demand. 6. Pursuant to the Guarantee, and by reason of Defendants Richard J. Derr and Lori L. Derr's default, the fonowing amounts are currently due and owing Plaintiff Keystoue Financial Bank, N.A., by Richard J. Derr and Lori L. Derr, Defendants. There has been no assignment of the Guarantee. 8. Judgment has not been entered on the Guarantee in any other jurisdiction. 9. Pursuant to the Guarantee, $ 18,155.45 is currendy due and owing Plaintiff Keystone Financial Bank, N. A. from Defendants, Richard J. Derr and Lori L. Derr, and Defendants, Richard J. Derr and Lori L. Derr, have failed to pay the amount due. WHEREFORE, Plaintiff Keystone Financial Bank, N.A. requestthat judgment be entered in its favor and against Defendants, Richard J. Walsh, and moves this Honorable Court for an Order to Enforce its Opinion and Order of February 16, 2001 regarding the sentence modification in which Act 63 of 2000, 42 Pa, c.s, 97002 and 7003, requiring an ignition interlock device, was found unconstitutional by this Court, No appeal was taken by the Commonwealth from this Order. Although the court may have had jurisdiction to determine the application of Section 7002, it did not have jurisdiction concerning the 42 Pa, C.S, S7003, nor would its decision have any ability to preclude this governmental entity from applying the Interlock Law, Mr. Walsh was informed of the interlock requirement by notice of December 21, 2000, Mr, Walsh never filed a petition concerning this restoration requirement with the Department. On the other hand there would be times when the court would realize that the interlock had to be installed, but the Department would not realize that an interlock should be installed, For that reason, the legislation signed into law by our Governor had two interlock requirements, Courts, when they recognized that the interlock had to be installed, were to order the interlock installation, That is found under Section 7002. On the other hand if the court didn't order the installation of an interlock, but yet there had been a prior DUI offense, the Department was prohibited from restoring the operating privilege of the person for an additional year unless the court certified that an interlock had been installed in each vehicle owned by the driver. This is found in Section 7003, Our records indicate that an interlock device must be placed on Mr, Walsh's vehicles before he can be restored, Mr, Walsh was first informed by letter of December 21, 2000, when the Department mailed his Notice of Suspension, Mr. Walsh failed to ask for any review of this requirement by requesting a timely Departmental Hearing.
