No appeal was taken by the Commonwealth from this Order, Mr, Walsh requests an Order of

RE: Robert 1. Walsh
Operator's No, 20883264
Dear Mr, Navitsky:
Reference is made to your letter of October 31, 2001, concerning the above
referenced operator. Reference is also made to my letter of October 24, 2001.
Apparently, you did not understand my letter. The Legislature not only required
the court to order the installation of interlock, but it also ordered this Department not to
restore a person's operating privilege unless it receives certification that the same had been
installed, Although the court may have had jurisdiction to determine the application of
Section 7002, it did not have jurisdiction concerning the 42 Pa, C.S, ~7003, nor would its
decision have any ability to preclude this governmental entity from applying the Interlock
Law. Mr. Walsh was informed of the interlock requirement by notice of December 21,
2000, Mr, Walsh never filed a petition concerning this restoration requirement with the
Department. Having waived his right to contest the issue of the interlock Mr, Walsh is
certainly not entitled to participate in any class action litigation.
Sincerely,
~/f

Dear Mr, Navitsky:
Your letter of October 18, 2001, addressed to the attention of the Bureau of Driver
Licensing, has been referred to the Legal Bureau for reply.
When the Legislature first considered the Interlock Bill, it heeded the advice of this
office that, much like ARD suspensions, there were courts that would not follow the
mandate of the Legislature and for some reason or other would not impose the
requirement under 42 Pa C.S, 97002, There would be times when the court would not
realize that there had been a prior offense or the court might misinterpret the law, On the
other hand there would be times when the court would realize that the interlock had to be
installed, but the Department would not realize that an interlock should be installed, For
that reason, the legislation signed into law by our Governor had two interlock
requirements, Courts, when they recognized that the interlock had to be installed, were to
order the interlock installation. That is found under Section 7002, On the other hand if the
court didn't order the installation of an interlock, but yet there had been a prior DUI
offense, the Department was prohibited from restoring the operating privilege of the
person for an additional year unless the court certified that an interlock had been installed
in each vehicle owned by the driver, This is found in Section 7003,
Our records indicate that an interlock device must be placed on Mr. Walsh's
vehicles before he can be restored, Mr. Walsh was first informed by letter of December 21,
2000, when the Department mailed his Notice of Suspension. Mr, Walsh failed to ask for
any review of this requirement by requesting a timely Departmental Hearing,
Mr, Walsh will be required to provide certification from the court that Ignition

Dear Mr. Navitsky:
Reference is made to your letter of October 31, 2001, concerning the above
referenced operator, Reference is also made to my letter of October 24, 2001,
Apparently, you did not understand my letter. The Legislature not only required
the court to order the installation of interlock, but it also ordered this Department not to
restore a person's operating privilege unless it receives certification that the same had been
installed, Although the court may have had jurisdiction to determine the application of
Section 7002, it did not have jurisdiction concerning the 42 Pa. C.S, ~7003, nor would its
decision have any ability to preclude this governmental entity from applying the Interlock
Law, Mr, Walsh was informed of the interlock requirement by notice of December 21,
2000, Mr, Walsh never filed a petition concerning this restoration requirement with the
Department. Having waived his right to contest the issue of the interlock Mr, Walsh is
certainly not entitled to participate in any class action litigation,
Sincerely,

Apparently, you did not understand my letter. The Legislature not only required
the court to order the installation of interlock, but it also ordered this Department not to
restore a person's operating privilege unless it receives certification that the same had been
installed. Although the court may have had jurisdiction to determine the application of
Section 7002, it did not have jurisdiction concerning the 42 Pa, C.S, S7003, nor would its
decision have any ability to preclude this governmental entity from applying the Interlock
Law, Mr. Walsh was informed of the interlock requirement by notice of December 21,
2000, Mr, Walsh never filed a petition concerning this restoration requirement with the
Department. Having waived his right to contest the issue of the interlock Mr. Walsh is
certainly not entitled to participate in any class action litigation.
Sincerely,
~./ /cZ'

Dear Mr. Cramer:
Thank you for your letter of October 24, 2001. I am sure you have read the
Opinions and Orders issued by the Court of Common Pleas of Cumberland County from
Judge Hess and Bayley, Act 63 of 2000; specifically 42 Pa, C.S. 97002 and 7003, were
found to be unconstitutional. I am enclosing a copy of same in the event you have not.
Pennsylvania has no ignition interlock law, No appeals were taken from the decisions
finding it uneonstitutional. The Department must restore Mr. Walsh's driving privileges
on December 10, 200 I without delay or reservation,
I trust that the Department will obey the law and not subject itself to class action
litigation,
With best personal regards, I remain,

RE: Robert L. Walsh
Operator's No, 20883264
Dear Mr. Navitsky:
Your letter of October 18, 2001, addressed to the attention of the Bureau of Driver
Licensing, has been referred to the Legal Bureau for reply,
When the Legislature first considered the Interlock Bill, it heeded the advice of this
office that, much like ARD suspensions, there were courts that would not follow the
mandate of the Legislature and for some reason or other would not impose the
requirement under 42 Pa C.S, 97002, There would be times when the court would not
realize that there had been a prior offense or the court might misinterpret the law. On the
other hand there would be times when the court would realize that the interlock had to be
installed, but the Department would not realize that an interlock should be installed, For
that reason, the legislation signed into law by our Governor had two interlock
requirements, Courts, when they recognized that the interlock had to be installed, were to
order the interlock installation, That is found under Section 7002. On the other hand if the
court didn't order the installation of an interlock, but yet there had been a prior DUI
offense, the Department was prohibited from restoring the operating privilege of the
person for an additional year unless the court certified that an interlock had been installed
in each vehicle owned by the driver. This is found in Section 7003,
Our records indicate that an interlock device must be placed on Mr, Walsh's
vehicles before he can be restored, Mr, Walsh was first informed by letter of December 21,
2000, when the Department mailed his Notice of Suspension, Mr. Walsh failed to ask for
any review of this requirement by requesting a timely Departmental Hearing.
Mr, Walsh will be required to provide certification from the court that Ignition
