COMPLAINT
The Plaintiff, KINER'S AUTO SALON, by its attorneys, KNUPP, KODAK & IMBLUM, P.c., brings this action of Assumpsit
againstthe Defendantto recover the sum ofTWEL VE THOUSAND, EIGHT HUNDRED THIRTY -ONE DOLLARS AND NINETEEN
CENTS ($12,83 I. 19), along with interest thereon from June 30, 2002, upon a cause of action of which the followi"g is a statement:
I. The Plaintiff, KINER'S AUTO SALON, is a corporation orga"ized and existing under the laws of the Commonwealth
of Pennsylvania, having its principal office and place of business at 1276 Armstrong Valley Road, Halifax, Pennsylvania 17032.
2. The Defendant, BRADLEY C. McALLISTER, an adult individual, is trading and doing business as B. C. McALLISTER
PAVING and has an office and place of business at 5140 Erbs Bridge Road, Mechanicsburg, Cumberland County, Pennsylvania 17055.
3, On the dates, in the amounts, and for the prices set forth in a true and correct copy of the Plaintiffs Invoices hereto
attached, marked as Exhibit "A" and made a part hereof, Plaintiff performed labor and provided services of the kind and description set
forth on said Exhibit to the total amount ofTen Thousand, Four Hundred Ninety-Five Dollars and Fifty Cents ($] 0,495,50).
4, The prices charged for said labor performed and services provided were just and reasonable, were the legal and market
prices therefor and were the prices which the Defendant promised and agreed to pay Plaintiff therefor.

5, Due to Defendant's default in payment of said amount due and owing as aforesaid, interest has been added to said account
in the total amount of Three Thousand, One Hundred Fourteen Dollars and Twenty-Five Cents ($3,114.25), as shown on Plaintilrs
Statement of Account, attached hereto, marked as Exhibit "B" and made a part hereof.
6. The Defendant paid to Plaintiff on account of the aforementioned charges certain sums of money as more particularly
set forth on Exhibit "B" attached hereto and made a part hereof, in the total amount of Seven Hundred Seventy-Eight Dollars and Fifty-Six
Cents ($778.56).
7. The balance due and owing by Defendant to Plaintiff is the sum of Twelve Thousand, Eight Hundred Thirty-One Dollars
and Ninereen Cents ($12,831.19), as appears by the Statement of Account hereto attached, made a part hereof and marked as Exhibit "B".
8. Plaintiff has frequently demanded payment from Defendant of said amount due and owing as aforesaid, but Defendant
has refused and neglected and still refuses and neglects to pay said amount of any part thereof.
WHEREFORE, Plaintiff brings this suit to recover from Defendant the sum of TWELVE THOUSAND, EIGHT HUNDRED
THIRTY -ONE DOLLARS AND NINETEEN CENTS ($12,831.19), together with interest thereon from June 30, 2002.

PRELIMINARY OBJECTION IN THE NATURE OF A MOTION TO
DISMISS FOR LACK OF CAPACITY TO SUE
Defendant, Bradley C. McAllister, by Preliminary Objections to the Complaint
of Plaintiff, respectfully represents as follows:
1. The Complaint at paragraph 1 alleges that Plaintiff is a corporation
organized and existing under the laws of the Commonwealth of Pennsylvania having its
principal office and place of business at 1276 Armstrong Valley Road, Halifax, PA 17032.
2. It is believed and therefore averred that Kiner's Auto Salon is not a
corporation but is a sole proprietorship owned by Lester L. Kiner.
3. The invoices attached to the Complaint at Exhibit "A" confIrm the
designated business name of Plaintiff as "Kiner's Auto Salon".
4. Plaintiffhas not properly filed and registered a fictitious name for "Kiner's
Auto Salon" as required by Section 302 of the Fictitious Name Act, 54 Pa. C.S.A. ~301 et
seq.
5. The Fictitious Name Act at Section 331,54 Pa. C.S.A. ~331 prohibits the

initiation of suit unless the plaintiff has properly filed a fictitious name as required by that
Fictitious Name Act.
6. This court is without jurisdiction to hear the matter in that the Plaintiff is
not incorporated nor is it properly registered under the Fictitious Name Act and is therefore
not the proper party before the court.
7. Plaintiff lacks standing to bring the within action because they are not
incorporated and lack capacity to sue because they are not properly registered with the
Commonwealth of Pennsylvania as required by the Fictitious Name Registration Act.
WHEREFORE, Defendant prays your Honorable Court for an Order
dismissing Plaintiff s Complaint.

Petitioner, the Law Office of Etzweiler & Associates, n:quests this Court to permit
them to withdraw as counsel for Bradley C. McAllister, individually and trading as B. C.
McAllister Paving, and, in support thereof, aver the following:
1. Bradley C. McAllister, individually and trading as B. C. McAllister Paving,
retained Petitioner to represent him in the above-captioned case.
2. On August 1, 2001, Bradley C. McAllister paid to Petitioner the sum of$500.00
which was deposited into Petitioner's escrow account as a retainer.
3. Petitioner prepared various documents and correspondence in connection with the
above-captioned matter on behalf of Bradley C. McAllister, individually and trading as B.
C. McAllister Paving.
4. On July 19,2004, Petitioner sent Bradley C. McAllister a statement for services
rendered covering the period from July 14, 2001, through February 6, 2004 with a balance

due in the amount of $1,534.50 reflecting a credit for the initial deposit in the amount of
$500,00. A true and correct copy of the statement of July 19,2004, is attached hereto as
Exhibit "A" and incorporated herein by reference.
5. On July 22, 2004, Petitioner sent to Bradley C. McAllister an engagement letter
requesting an additional retainer in the amount of $1,500.00 in order for Petitioner to
continue to represent him along with a cover letter, with copies of said letters being attached
hereto as Exhibit "B" and incorporated herein by reference.
6. As of this date Bradley C. McAllister has not made any of the payments as
requested by Petitioner.
7. This case involves complicated legal and factual issues and the future
representation of Bradley C. McAllister in connection herewith will require Petitioner to
expend substantial time, effort and money.
8. Bradley C. McAllister's lack of cooperation, as well as his failure to pay an
interim statement for services rendered and the additional retaiiner as requested creates an
undue hardship on Petitioner with respect to representing Bradliey C. McAllister further in
this litigation and conducting Petitioner's law practice.
9. Petitioner will cooperate fully with any attom(:y who agrees to represent
Bradley C. McAllister in these proceedings, ifany.
10. No hearings or trials have been scheduled in this matter, so substitute counsel

would have adequate time to review and become familiar with the file.
II. Petitioner has given a copy of this Petition to Bradley C. McAllister and
advised him that he will no longer be represented by counsel ifthis Petition is granted. A

August 19, 2004, is attached hereto as Exhibit "C" and incorporated herein by reference.
12. Petitioner has contacted Plaintiffs counsel, Robert D. Kodak, Esquire, who

Dear Mr, McAllister:
You have asked us to represent you in connection with the action against Lester L.
Kiner tla Kiner's Auto Salon, and we are pleased to do so.
It is our practice to confirm in writing the identity of any client whom we represent,
the nature of our undertaking on behalf of that client and our billing and payment
arrangements with respect to our legal services.
Our statements for professional services in this matter will be substantially based
upon the hourly rates for those lawyers and other office personnel who perform services
on your behalf. Our lawyer's current hourly rates are $150.00 for services other than
court or hearings, and $200.00 for court, hearings and depositions and similar
proceedings. For some work performed by paralegals or experienced secretarial staff, the
hourly rate is $60.00. Our hourly rates may be adjusted, but you will be notified in
advance for any adjustment. In preparing our statements for legal services, we will use
our hourly rates in effect when such services were rendered.
Keeping record of time involved in a case is rather difficult, especially when the
attorney is involved in numerous matters in one day. We have our time records on 10
minute intervals. Frequently, when we receive a telephone call, it does involve some

additional time in retrieving and reviewing the file, so in most cases we will try to keep
time records on a 10 minute interval.
You will also be billed for disbursements and other charges relating to our
professional services. Such charges may include, without :limitation, filing fees, long-

It is our practice to render statements for professional services and related charges
on a regular basis. We will expect payment to be made when the statement is received,
without regard to the consummation of any proposed transal;tion or the outcome of any
matter. In the event that our statements are not timely paid, we reserve the right to
suspend services until satisfactory payment arrangements are made, or if necessary, to
terminate such services. Our clients, of course, may terminate our services at any time.
We have requested an advance payment of $1,500.00, and receipt of that amount
is hereby acknowledged. Statements for professional services and related charges, based
upon our standard billing practices as described in this lettt:r, will be presented to you
periodically. Your advance payment or payments will be applied to any outstanding
balances that may be due at the time our engagement is concluded or our services are
terminated. If there is an over payment, we will refund such amount to you. If there is
any balance due at the time of concluding our representation, we would expect payment
within thirty (30) days of mailing such statement. If any bill is not paid within thirty (30)
days of mailing same, interest will be added at the rate of 1-1/2 % per month for any month
or portion thereof that the bill remains unpaid.

would expect to send you copies of significant papers prepared or received by me. If you
have any questions about our services or about the status of our engagement, please feel

provided, but rather there was an agreement entered between the partie

owned by Lester L. Kiner.
IS. Lester L. Kiner, formerly and/or currently, owned businesses known a,
Kiner's Excavating and S & K Builders.
16. In 2000 and 2001 Defendant provided paving services to both Kiner's
Excavating and S & K Builders, and invoiced those companies in exce s of
thirty-six thousand dollars ($36,000.00).
17. Defendant Bradley C. McAllister and Lester L. Kiner entered into a v bal
agreement whereby in exchange for Plaintiff's work on Defendant's ve ides,
Bradley C. McAllister would deduct monies owed for services perfon ed by
Kiner's Auto Salon from the invoices for work perfonned by Defenda t fl1r
Kiner's Excavating and S & K Buildcrs.
18. ]n 2002 near the time of filing this pending action, Lester L. Kiner file I
Bankruptcy on behalf of Kiner's Excavating, Inc. and S & K Builders.
] 9. B.C. McAllister Paving was named as a creditor in the Bankruptcy fili g and
a Proof of Claim was submitted by the Defendant in the total amount ( f
twenty-eight thousand two hundred thirty-five dollars ($28,235.00). true
