Cathy Haskins, a Defendant, is an adult individual with an address at 1705 Elm Street, New Cumberland, Cumberland County, Pennsylvania 17070. Defendant, Daniel Haskins, purchased department store items from Plaintiff and charged them to his credit account with Plaintiff. Attached hereto is the credit application, marked Exhibit A and made part hereof. Defendants' delinquent balance as of June 28, 2002 is $2266.44. Pursuant to 23 Pa C.S.A. Section 4102, both Defendants are liable for necessaries purchased by one of them. Because of Defendants failure to pay' the account off and in accordance with Defendants credit agreement, a copy of which is attached hereto, marked Exhibit B and made part hereof, an attorney commission of $339.96 is also due for a total of $2606.40. Defendants have failed and refused to bring their account current. Defendants are not members of the Armed Forces of the United States of America, nor engaged in any way which would bring them within the Soldiers and Sailors Relief Act of 1940, as amended.
