WHEREAS, ROBIN J. GINTER of 60 Sugar Maple Drive, Etters, Pennsylvania, is about to
execute contemporaneously herewith, a contract, with HETRICK CONSTRUCTION of 766 Magaro Road,
Enola, Pennsylvania, for the erection of a building upon premises commonly known as 1405
ELDINDEAN TERRACE, Township HAMPDEN, CUMBERLAND County, Pennsylvania, as set forth
in the deed dated , recorded at Deed Book , Page , in the
Recorder's Office for CUMBERLAND County, Pennsylvania, as more specifically described in Exhibit
"A" which is incorporated herein and attached hereto.
NOW, March 15, 2000, at the time of and immediately before the execution of the principal
contract, and before any authority has been given by the said Owner to the said Contractor to commence
work on the said building, or purchase materials for the same in consideration of the making of the said
contract with Contractor and the further consideration of One Dollar ($1.00), to Contractor paid by Owner,
it is agreed that no lien shall be filed against the building by the Contractor, or any subcontractor, nor by
any of the materialmen or workmen or any other person for any labor, or materials purchased, or extra
labor or materials purchased for the erection of said building, the right to file such liens being expressly
waived.
WITNESS, our hands and seals the day and year aforesaid.

ALL THAT CERTAIN tract or parcel of land situated in Hampden Township, Cumberland
County, Commonwealth of Pennsylvania, more particularly bounded and described as follows, to wit:
BEGINNING at a point on the eastern right-of-way line of Jerusalem Road, said point also being
the southeastern comer of Lot No. 28, as shown on the final'Phase III Subdivision Plan of Turnberry;
thence along the eastern property line .of Lot No. 28, North 30 degrees 20 minutes 14 seconds East, a
distance of 192,68 feet to a point on the southern right-of-way line of Eldindean Terrace, a 50 foot wide
street, said point also being the northeastern comer of Lot No. 28; thence along the southern right-of-way
line of Eldindean Terrace, by a CUrve to the rights with a radius of 225,00 feet, an arc length of 15.74
feet, said arc being subtended by a chord bearing South 61 degrees 50 minutes 01 seconds East, a distance
of 15.74 feet to a point on the southern right-of-way line of Eldindean Terrace; thence continuing along
the southern right-of-way line of Eldindean Terrace, South 63 degrees 40 minutes 17 seconds East, a
distance of 64.00 feet to a point on the southern right-of-way line of Eldindean Terrace, said point also
being the northwestern comer of Lot No. 26; thence along the western line of Lot No. 26, South 26
degrees 19 minutes 43 seconds West, a distance of 219,00 feet to a point on the eastern right-of-way line
of Jerusalem Road; thence along the eastern right-of-way line of Jerusalem Road, North 47 degrees 19
minutes 13 seconds West, a distance of 97.13 feet to a point on the eastern right-of-way line of Jerusalem
Road, said point being the point and. place of BEGINNING.
SUBJECT to one half of a 25 foot drainage easement on the eastern property line, Additionally,
wetlands are present on the hereinbefore described lot, as shown on the referenced plan of subdivision.
Wetland area was delineated under the Laws in effect at the time of plan recording and is subject to
restrictions. Lot owners shall be aware that these restrictions may be subject to future Regulatory changes
which could impact the use of this wetland and/or adjacent areas. The Department of Environmental
Resources, Division ~f Rivers and Wetland Conservation, should be contacted for restrictions,
clarification or any possible update.
SAID lot contains 17,852,03 square feet or 0.409826 acres,
BEING Lot No. 'J:1 as shown on the Final Subdivision Plan of Turnberry, Phase tII, recorded in
Plan Book 67, Page 29.
UNDER AND SUBJECT, NEVERTHELESS, to all easements, restrictions, encumbrances and
other matters of record or that which a physical inspection or survey of the premises would reveal.
