COMPLAINT NOW, comes Plaintiff, Kenneth W. Marts, by and through his attorneys, O'BRIEN, BARIC & SCHERER, and files the within complaint and, in support thereof, sets forth the following: 1. Plaintiff, Kenneth W. Marts, is an adult individual with a residence address of 1823 Sterretts Gap Avenue, Carlisle, Cumberland County, Pennsylvania. 2. Defendant, Lynford K. Donivan ("Donivan"), is an adult individual with a last known residence address of 116 West Hillcrest Drive, Carlisle, Cumberland County, Pennsylvania. 3. In the early 1990's, Donivan approached Kenneth W. Marts and asked whether Kenneth W. Marts would be interested in providing funds to Donivan which, upon information and belief, Donivan would use in a home construction business operated by Donivan. 4. Donivan agreed to pay Kenneth W. Marts interest and points on the money to be loaned by Kenneth W. Marts to Donivan. 5. On or about November 6, 1995, Kenneth W. Marts provided Donivan with the sum of $60,000,00 and Donivan executed over to Kenneth W, Marts a Demand Note reflecting the loan and the terms of the loan. A true and correct copy of the Demand Note is appended hereto as Exhibit A and is incorporated. II 6. Donivan made certain payments against the Demand Note so that, as ofJanuary 1, 1997, the outstanding balance remaining due and owing was $49,000.00. 7. On or about January I, 1997, the outstanding balance under the Demand Note was re-written by the parties and a new Demand Note was executed by Donivan. A true and correct copy of the new Demand Note ("Second Demand Note") is appended hereto as Exhibit B and is incorporated. 8. On or about January 12, 1997, Kenneth W. Marts provided an additional $41,000.00 to Donivan. Donivan executed a Demand Note for this sum ("Third Demand Note"), a true and correct copy of which is appended hereto as Exhibit C and is incorporated. 9. The outstanding balance due at the time of the Third Demand Note was $91,800.00. 10. From January, 1997 through July, 1999, Donivan made certain payments to Kenneth W. Marts so that, as ofJuly 19, 1999, the principal balance and accrued interest was $84, 880.36. 11. Throughout the history of their dealings, Donivan would generally make payments to Kenneth W. Marts on a quarterly year basis. 12. Since July 19, 1999, Donivan has made no payments to Kenneth W. Marts under the Second Demand Note or the Third Demand Note. 13. Kenneth W. Marts has made demand for payment of the debt. 14. Interest accruing on the Second Demand Note and Third Demand Note since the last payment by Donivan is $5,179.30 calculated to March 31, 2000 with a per diem of$18.60. 15. Both the Second Demand Note and Third Demand Note provide for the recovery of reasonable attorney fees and costs should the notes be turned over for collection. ,I II COUNT 1- BREACH OF CONTRACT KENNETH W. MARTS v. LYNFORD DONIV AN 16. Plaintiff incorporates paragraphs one through fifteen as though set forth at length. 17. Donivan has defaulted under the terms of the Second Demand Note and Third Demand Note. 18. All conditions precedent to recovery have been fulfilled. 19. As a direct and proximate result of Doni van's breach of the Second Demand Note and Third Demand Note, plaintiff has failed to recover the sum of $84,880.36 and interest accrued to March 31,2000 in the amount of$5,179.30. 20. As a direct and proximate result ofDonivan's breach of the Second Demand Note and Third Demand Note, Kenneth W. Marts has been required to seek collection of the amounts due and owing through counsel and has and will be required to pay reasonable attorney fees to pursue collection of the amounts due. WHEREFORE, plaintiff demands judgment in his favor and against defendant for the sum of $90,059.66 plus interest accruing to the date of award at $18.60 per day from March 31,2000, attorney fees and costs and expenses. Plaintiff initiated an action to the above caption on March 17,2000, whereby a Complaint was filed. 2. The Sheriff of Cumberland County attempted to make service on the Defendant at the last known address for Defendant and was unable to make service. A true and correct copy of the Sheriffs return is attached hereto as Exhibit "A" and is incorporated. 5. The address used for Defendant's mailing is believed to be the last known address of the Defendant. Plaintiff, in an attempt to obtain the correct address of the Defendant utilized the internet, contacted individuals with business dealings with Defendant filed a Request for Change of Address or Boxholder Information Needed for Service of Legal Process with the Postal Service (attached hereto an Exhibit B); searched the internet (attached hereto as Exhibit C); and, located name in the local phone book (attached hereto as Exhibit D). Marts, by and through his attorneys, O'BRIEN, :i BARIC & SCHERER, and files the within complaint and, in support thereof, sets forth the following: I, Plaintiff, Kenneth W. Marts, is an adult individual with a residence address of 1823 'i Sterretts Gap Avenue, Carlisle, Cumberland County, Pennsylvania. " I ,I 2. Defendant, Lynford K Donivan ("Donivan"), is an adult individual with a last known residence address of 116 West Hillcrest Drive, Carlisle, Cumberland County, Pennsylvania. 3. In the early 1990's, Donivan approached Kenneth W. Marts and asked whether Kenneth W. Marts would be interested in providing funds to Donivan which, upon information and belief, Donivan would use in a home construction business operated by Donivan. 4. Donivan agreed to pay Kenneth W. Marts interest and points on the money to be loaned by Kenneth W. Marts to Donivan, 5. On or about November 6, 1995, Kenneth W. Marts provided Donivan with the I' i: sum of $60,000,00 and Donivan executed over to Kenneth W, Marts a Demand Note reflecting the loan and the terms of the loan. Donivan made certain payments against the Demand Note so that, as of January 1, 1997, the outstanding balance remaining due and owing was $49,000.00. 7. On or about January I, 1997, the outstanding balance under the Demand Note was I. A true and correct copy of the new Demand Note ("Second Demand Note") i~ appended hereto as Exhibit B and is incorporated. 8. On or about January 12, 1997, Kenneth W. Marts provided an additional $41,000.00 to Donivan. Donivan executed a Demand Note for this sum ("Third Demand Note"), a true and correct copy of which is appended hereto as Exhibit C and is incorporated. 9. The outstanding balance due at the time of the Third Demand Note was $91,800.00. 10. From January, 1997 through July, 1999, Donivan made certain payments to Kenneth W. Marts so that, as ofJuly 19, 1999, the principal balance and accrued interest was $84, 880.36. II. Throughout the history of their dealings, Donivan would generally make payments to Kenneth W. Marts on a quarterly year basis. 12. Since July 19, 1999, Donivan has made no payments to Kenneth W. Marts under the Second Demand Note or the Third Demand Note. 13. Kenneth W. Marts has made demand for payment of the debt. 14. Interest accruing on the Second Demand Note and Third Demand Note since the last payment by Donivan is $5,179.30 calculated to March 31,2000 with a per diem of$18.60. 15. Donivan has defaulted under the terms of the Second Demand Note and Third Demand Note. 18. All conditions precedent to recovery have been fulfilled. 19. As a direct and proximate result of Doni van , s breach of the Second Demand Note and Third Demand Note, plaintiff has failed to recover the sum of $84,880.36 and interest accrued 'I II Ii d ~ i I, j' Ii to March 31,2000 in the amount of$5,179.30. 20.
