Stipulation Against Liens
THIS AGREEMENT made the

LEON E. WINTERMYER, rNC., a corporation, with offices at
220 Yocumtown Road, Etters, PA 17319,
hereinafter referred to as Contractor,
AND
SECHRrST DEVELOPMENT CORP., a corporation, with offices
at 804 DarIa Road, Mechanicsburg, PA 17055,
, hereinafter refert~d to ~
Owner, whereby theformer undertook and aweed to ~ construct a road or street with all ancillary
facilities known as "DarIa Road"
on that certain lot of grounis#uate ii~':'
the Borough of Mechanicsburg, Cumberland County, Pennsylvania, being more parti~ular1y
described on a certain subdivsion plan of lots entitled "Pre1iminaryjFina1'Su)>clivsion'
Plan for Heritage Acres" dated April 14, 1999 (last revised July 20, 1999) and; ,
recorded in the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania
in Plan Book 79, Page 143 (said plan also showing the location of "DarIa Road"), and
being a portion of that certain larger premises which Sechrist Development Corp.
acquired from John M Knaub by deed dated April 29, 1999, and recorded in said Recorder's
Office in Deed Book 198, Page 423.
NOW THEREFORlj:, THIS AGREEMENT WITNESSETH: That the said ContractorJor and in consideration of
the sum of($1.oo) Dollar to it in hand paid by Owner, the receipt whereofis hereby
acknowledged. and the further consideration mentioned in the agreement 'afqresaid, for themselves and their
subcontractors, and all parties acting through or under them, covenant and agree that no mechanic's liens or claims
shall be filed or maintained by them or any of them against the said buildings and the lot af graund appurtenant
thereto for or on account of any work done or materials furnished by them or any "of th-~rri under said contract or
otherwise, for, towards, in, or about the erection and construction of the said buildings on the lot above described,
and the said Contractor, for themselves, their subcontractors and others under them hereby expressly waive and
relinquish the right to have, file. and maintain any mechanic's liens or claims against the said buildings or any of
them, and agree that this instrument, waiving the right of lien, shall be an independent covenant.
