Zimmerman, Sr. Defendant, Respondent NO. 2000- I<6d.D CIVIL TERM PETITION FOR SPECIAL RELIEF PURSUANT TO Pa.R.C.P. 1915.13 AND NOW, this 23'd day of March, 2000, Joy Zimmerman, Mother, by and through her counsel, the Family Law Clinic, petitions the court to grant temporary sole legal and sole physical custody of the children, Charles and Tina Zimmerman, to issue a writ of ne exeat directing Timothy Zimmerman, Sr., Father, not to leave the Commonwealth of Pennsylvania with the children, to schedule an emergency hearing on this matter, and to direct the Sheriff to immediately serve today's order on Respondent, and avers in support thereof as follows: 1. The children are life long residents of Cumberland County, Pennsylvania. 2. The children have resided with Mother all of their lives. 3, Since December 1999, Father has left Pennsylvania three times to live in California with his girlfriend, Sue Oster. 4. Each time Father has stayed in California for a duration of two to three weeks before returning to Pennsylvania. 5. Father does not inform Mother or the children of his plans to go to California, his whereabouts in California, or his plans to return to Pennsylvania. 6. Mother received a phone call on the morning of March 23,2000, from Sue Oster, '-' 0'__'-, <'.l,'>'!'. ".,'\_' A, ",",' ,-, father's girlfriend in California. Sue Oster informed Mother that Father is driving back Pennsylvania, and is planning on taking the children to California. 7, Mother expects father to arrive in Cumberland County on or about March 24, 2000.
