TAYLOR, : NO. 00 - ;q/-3 CIVIL TERM Defendant: IN CUSTODY STIPULATION AND AGREEMENT THIS STIPULATION AND AGREEMENT entered into this 1ft'" day of March, 2000, by and between MICHAEL L. TAYLOR (hereinafter referred to as "Father") and KARRIANN L. CALAMAN (hereinafter referred to as "Mother"). NOW THIS AGREEMENT WITNESSETH THAT: WHEREAS, the parties are the natural parents of a minor child, namely, Dakoda L. Taylor (age 1, born July 9, 1998); and WHEREAS, the parties wish to enter into an agreement relative to the custody and partial custody of the child. NOW, THEREFORE, in consideration of the mutual covenants, promises and agreements as hereinafter set forth and intending to be legally bound, the parties hereto agree as follows: 1. The parties shall have joint legal custody of the child, which shall include, but not be limited to the mutual sharing of information and decisions with regard to medical care, education and religious instruction. ,'..) The Mother shall have primary physical custody of the child, subject to periods of partial or temporary physical custody and visitation with the Father as follows: A. Every other weekend from Friday evening through Sunday evening; B. On Tuesday and Thursday evenings on one week, and Tuesday evenings the next week and alternating every other week thereafter; C. The parties shall share time with the child on holidays on a mutually agreeable basis, it being the intention of the parties to spend equal time with the child as much as reasonably possible. The Father shall always have the child on Father's Day and the Mother shall always have the child on Mother's Day. The parties shall each have time with the child on his birthday; and D. On such other times as the parties may mutually agree from time to time, each recognizing that some flexibility may be necessary in order to accommodate work schedules and other changes in circumstances and their mutual desire to spend significant time with each of their children. 3. Neither party shall reside with the child outside of the Commonwealth of Pennsylvania without first securing the consent of the other party or further order of this Court. Whenever either parent takes the child away from their respective primary residences on vacation, they shall provide a means for the other parent to contact them in an emergency. 4. Both parties agree that each party shall have reasonable telephone contact with the child while the child is in the other party's custody and that the child will be permitted to call the noncustodial parent as desired while he is in the custody of the other parent. <,' "'"" """C'""'_"'''''~'',"'~q,c"",:'":'''''"",c"""""",,,,,P,,,", "",",,'''',,''7'', ' 'co. The parties will keep each other advised immediately relative to any emergencies concerning the child and shall further take any necessary steps to ensure that the health, welfare and well being of the child is protected. 6. The parties shall do nothing that may estrange the child from the other parent or injure the opinion of the child as to the other parent or which may hamper the free and natural development of the child's love or affection for the other parent. 7. Father shall pay to Mother the sum of $65.00 every week for the support of the child, effective March 31,2000. Said amount shall be payable directly to the Mother, rather than through the Domestic Relations Section, so long as the Father remains current in his payments. If the Father becomes more than thirty (30) days delinquent in these payments, then the Mother shall be entitled to request the Cumberland County Domestic Relations Section enter an attachment of the Father's wages to secure such payment. The Mother shall pay the expenses of third party childcare while she is working. The parties will attempt to use each other for other childcare or babysitting needs whenever possible. The parties will share all L1nreimbursed medical expenses for the child, including eye and dental care, with the Father paying 56% and the Mother paying 44% of said expenses. All amounts payable hereunder are subject to change based upon changed circumstances in accordance with the law and rule of Court. 8. Any modification or waiver of any of the provisions of this agreement shall be effective only if made in writing and only if executed with the same formality of this agreement. 9. The parties agree that in making this agreement there has been no fraud, concealment, overreaching, coercion or other unfair dealing on the part of the other. 10. The parties desire that this agreement be made an order of Court through the Court of Common Pleas of Cumberland County, and further acknowledge thatthe ,- ' ' ,., ~~'1"'~r=~. -~..
