On September 16, 1999, Amoretta Vaccaro, the plaintiff's
Daughter was driving his car, a 1997 PIJ'D1Outh Breeze, North on
Bridge Street in New Cumberland past the defendant's parked
vehicle, a 1995 Chevrolet Sl.o truck. Without regard for safety or
right of way, and in violation of Pennsylvania Vehicle Code,
Chapter 37, Miscellaneous Provisions, Paragraph 37.05, "Opening and
Closing Vehicle Doors", the defendant opened his door into the
side of the plaintiff's vehicle causing extensive damage along the
length of the right side of the car. New Cumberland Police
Accident Report NUmber 99-84 was filed.
Several days later, after riling a claim against the
defendant's insurance cOJl!Pany, the plaintiff received a letter

from Progressive Insurance COD!Pany informing him that the
defendant's insurance po~icy had been cance~ed on May 7, 1999,
five months before the accident. The p~aintiff was at the time in
vio~4tion of Pennsy~vania Vehic~e Code, Chapter 17, Paragraph
1786, "Required Financia~ Responsibi~i ty" .
As a di:J;:ect resul.t of the defenA"'"t's neg~igence, the
p~aintiff' s 1997 P~l'JlIOuth Breeze was damaged a~ong the ~engt:h of
the right side of the car, in the sum of $2799.83. The p~aintiff is
requesting reimbursement $500.00 of his own costs for repair.
Due to the damage to the p~aintiff's car, the p~aintiff ~ost
the use of the car in affairs and business for five days during
which time the p~aintiff rented a cOD!Parab~e vehic~e at a cost of
$144.95.
Due to the ~ack of Financia~ Responsibi~it:y of the defendant,
the p~aintiff has a~so incurred court and administrative costs of
$81.75.
The p~aintiff asks judgment for $726.70 and civi~ fines for
vio~4tion of the above stated vio~ation of Pennsy~vania Vehic~e
Code.
