COMPLAINT
The Plaintiff in this action, Doubling Gap Church of God, files this Complaint by and
through its attorney, Richard L. Webber, Jr., Esquire, averring the following:
I, Plaintiff is Doubling Gap Church of God, a nonprofit corporation duly authorized under
the laws of the Commonwealth of Pennsylvania, with registered address at 50 McCrea Road,
Newville, Cumberland County, P A 17241,
2, Defendant is David A. Shetler, t/d/b/a Shetler Roofing, of 13459 Sandy Mount Road,
Orrstown, Franklin County, Pennsylvania 17244.
3, Defendant owns and operates a roofing business under the name "Shetler Roofing".
4. On or about March 2, 1999, Plaintiff and Defendant entered into a verbal agreement
concerning the painting of the roof of Plaintiff s church, Attached hereto labeled as Exhibit I and
incorporated by reference herein is a true copy of a writing prepared by Defendant evidencing the
agreement.
5, The specific services to be performed by Defendant were as follows:
A. Sealing the metal roof with 2 applications of Kool Seal

6. The total compensation to be paid by Plaintiffto Defendant was $ 2,700.00.
7, Defendant painted the roof in March, 1999.
8. Defendant and his employees performed the painting in an unworkmanlike manner as
follows:
A, The appearance is unreasonable and unsatisfactory;
C. There are "hairline" cracks in the roof that would have been sealed if the painting
D, Two coats of paint were applied to the roof on the same day.

job was done properly; and
9. As a result of the poor quality of Defendants work as set forth in paragraph 8 above,
Plaintiff expended $208.00 to prepare the roof for winter.
10. In addition, the roof must be completely repainted, for reasons stated in Paragraph 8
above,
11. The cost to completely repaint the roof is $2,975.00.
12. Plaintiff has fulfilled all of its obligations pursuant to the verbal agreement referenced
in paragraph 4 above, including payment of the agreed upon price,
13. In spite of requests by Plaintiff, Defendant has failed to repaint the roof.
14, On or about March 7, 2000, Plaintiff expended $ 28.35 for filing fees at the Office of
Helen B. Shulenberger, District Justice.

April 25, 2000 by regular, first class U.S. mail pursuant to Pa. RC,P.DJ, No, 1005 D.
