The Plaintiff is K & A Environmental Contractors, Inc., a Pennsylvania corporation with its principal place of business at R.D. # 1, Box 1790, Mohnton, Berks County, Pennsylvania, 19540. 2. Defendant TGR Corporation is believed to be a New Jersey corporation with its principal place of business at 22 Troy Lane, Lincoln Park, New Jersey 07035. 3. Beginning in June of 1998 and ending in April of 1999, the Plaintiff was a subcontractor for TGR Corporation which was the general contractor for construction work being performed at Cedar Cliff High School in Cumberland County. 4. On the 26th day of May, 1998, the Plaintiff and Defendant entered into a subcontract agreernent, a copy of which is attached to and made a part of this Complaint as Exhibit A. 00168688.1 - ~~ , ~~,_i 5. Pursull1lt to the instructions ofTGR, the Plaintiff performed asbestos abatement construction work at Cedar Cliff High School. 6. The Plaintiff was paid for some ofits invoices by the Defendll1lt, but the final invoice for $11,939.90 was not paid by the Defendant. A copy of the final invoice is attached to and made a part ofthis Complaint as Exhibit B. 7. Numerous requests of the Defendant have been made by the Plaintiff for payment of the monies due, but all such inquiries have been ignored. COUNT I BREACH OF CONTRACT 8. The Plaintiff incorporates paragraphs I through 7 into Count 1. 9. By failing to pay the arnounts due in return for the work that the Plaintiff performed, the Defendant breached its agreernent to pay for the Plaintiffs services. WHEREFORE, the Plaintiff requests that judgment be entered in its favor lI1ld against the Defendll1lt for $11,939.90, together with interest frorn April 30, 1999, plus costs of suit. COUNT II CONTRACTOR AND SUBCONTRACTOR PAYMENT ACT 10. The Plaintiff incorporates paragraphs I through 9 into Count II. II. The Plaintiff is a subcontractor and the Defendll1lt is a contractor as defined by the Pennsylvania Contractor and Subcontractor Payment Act, 73 Pa. Stat. The Defendant failed to pay the Plaintiff in accordance with the terms of its contract, and as such is obligated to pay interest on the overdue amount at the rate of 1 % per month pursuant to 73 Pa. Stat. Ann. ~505( d) and ~507( d). 13. Because there has been no withholding of payment by the general contractor in good faith, the Defendant is liable to the Plaintiff for a penalty in the amount of 1 % per month of the amount of the overdue invoice. As of the date of this Complaint, that amount totals ten months at the rate of $119.40 per month, for a total of $1,193.99. 14. Pursuant to 73 Pa. Stat. Ann. ~512(b), the Defendant is liable to the Plaintiff for its reasonable attorneys fees and expenses. WHEREFORE, the Plaintiff requests a judgment be entered in its favor and against the Defendant in the amount of$11,939.90, together with a penalty in the amount of $1,193.99, together with a penalty of 1 % of the total amount due per month from April 2000 forward, together with reasonable attorneys fees, costs and reasonable expenses of suit.
