I was appointed as a chairman of a panel of arbitrators for this case. I scheduled a hearing.
Upon scheduling the hearing Andrew Norfleet, counsel for the defendant advised that he would file
with the court a motion for a summary judgment.

NOW come Plaintiffs John McCorkel and Tracey Myers McCorkel, by and through their
attorneys, O'Brien, Baric & Scherer, and file the within Complaint and in support thereof, set
forth the following:
1. Plaintiffs are John McCorkel and Tracey Myers McCorkel, husband and wife,
residing at 1434 Zimmerman Road, Carlisle, Pennsylvania, 17013.
2. Defendants are Michael Swartz and Tanya Swartz, husband and wife, residing at
155 East North Street, Apartment B, Carlisle, Pennsylvania,170 13.
3. Defendants entered into a Lease Agreement to lease an apartment owned by
Plaintiffs located at 155 East North Street, Carlisle, PA., 17013, known and numbered Apartment
B. Said Lease Agreement is dated November 26, 1998, a copy of which is attached hereto,
marked as Exhibit "A", and incorporated herein by reference.
4. In October, 1999, Defendants caused damage to the tub kit which subsequently
leaked causing damage to the ceiling in the apartment directly below Defendants' apartment.

5. Plaintiffs received a repair proposal from McQuillen Construction for repair of the
tub and ceiling. Said proposal is attached hereto, marked as Exhibit "B", and incorporated herein.
6. Pursuant to paragraph 7 c of the Lease Agreement, Defendants are responsible for
the cost of repair arising from damage to the leased premises.
7. Plaintiff, John McCorkel, made the repairs necessary at a cost and expense of
$767.68.
8. Plaintiffs filed a Landlord and Tenant Complaint with District Justice Paula P.
Correal, docketed to No. LT-71-00 on 2/22/00 for breach of contract in that Defendants did not
pay for the repairs.
9. On 3/6/00, a hearing was held and judgment was entered in favor of Plaintiffs and
against Defendants for the sum of $942.44. Defendants then made two payments totaling $60.00,
being a $30.00 payment by check dated 3/21/00 and a $30.00 payment by check dated 3/30/00.
Copies of the checks for the payments are attached hereto, marked as Exhibits "C" and "D", and
incorporated herein.
10. On 4/5/00, a Notice of Appeal was filed to Docket No. LT-71-00 in the
Prothonotary's Office, Court of Common Pleas of Cumberland County, Pennsylvania.
11. Pursuant to paragraph 11 of the aforementioned Lease Agreement, Plaintiffs are
entitled to recover attorney's fees accruing in this matter.
12. Plaintiffs are seeking judgment in their favor in the amount of $707.68
13. Defendants have breached the Lease Agreement causing Plaintiffs to incur the
damages as set forth herein above.
14. All conditions preceding to recovery under the Lease Agreement have been
fulfilled.

15. Despite demand therefore, Defendants have failed and refused to pay the sum due
and owing. .
WHEREFORE, Plaintiffs hereby request judgment in their favor for the sum of $707.68
and payment of attorney's fees as are just and reasonable.

LEASE AGREEMENT

referred to as LESSOR).

LESSOR hereby agrees to lease to LESSEE, and LESSEE agrees to lease from
LESSOR, a partially furnished apartment (See Exhibit "Au for furnishings persent-
ly in apartment) located on the
floor of the property and building known
as 155 East North Street, Borough of Carlisle, Pennsylvania, upon the following
terms and conditions, to wit:

LESSOR or his agent prior to, or at the execution of this Agreement, that are not
herein expressed or endorsed hereon; and upon the termination of this lease in
any way, LESSEE will immediately yield up said premises to LESSOR in as good con-
dition as when the same were entered upon by LESSEE, ordinary wear and tear only
excepted, and shall then return all keys to LESSOR.
5. LESSEE shall lease the said permises for. residential purposes for ~
persons only, and for residential purposes only. LESSEE will not allow said
premises to be used for any other purpose that will increase the rate of insurance
thereon, nor for any purpose other than that herein before specified, nor to be

occupied in whole or part by any other persons, and will not sublet the same, nor
any part thereof, nor assign this lease, without, in each case, the written con-
sent of the LESSOR, and will not permit said premises to be used for any unlaw-
ful purpose or purpose that will injure the reputation of said premises of the
building or disturb other tenants or occupants of the building or the neighborhood.
6. LESSEE has deposited with LESSOR the security deposit in the amount of
one month's rent, or ..:lJ,~~qD,OO , for the performance of all covenants and agree-
ments of LESSOR hereunder. LESSOR may apply all or any portion thereof in pay-
ment of any amount due LESSOR from LESSEE, and upon LESSOR'S demand LESSEE shall
in such case during the term of this lease, promptly deposit with LESSOR such addi-
tional amounts as may then be required to bring said security deposit up to the
full amount stated above. Upon termination of this lease and full performance
of all matters and payment of all amounts due by LESSEE, so much of the security
deposit has been applied by LESSOR as compensation for property damage, LESSOR,
when and as required by law, shall provide to LESSEE an itemized statement of such
damage and of the. estimated or actual cost of repairing same. If the building in
which said apartment is located is sold or otherwise transferred, LESSOR may
transfer or assign the security deposit to the purchaser or transferee of the
building, who shall thereafter alone be 1 iable to LESSEE for all LESSOR'S obliga-
tions hereunder, and for the return of said security deposit and other matters
related to the return of said deposit. LESSOR reserves the right to limit LESSEE
to ~ nail holes per wall, per room for the purpose of hanging pictures or
similar items. In the event said limit is exceeded, LESSEE agrees to pay to
LESSOR the amount of TWO DOLLARS ($2.00) per additional hole. LESSOR shall not
permit any holes to be made in any ceiling or in. any part.of trim of said premises.
7. LESSEE for himself and his heirs, executors, administrators and assignee,
agree as follows:
a. to pay the rent herein stated promptly when due without any deductions
whatsoever, and without any obl igation on the part of the LESSOR to make any
demand for the same;
b. to keep the premises in a clean and sanitary condition, and to comply
with all laws, any state, county, or local health and policy requirements with
respect to said premises, and to save LESSOR harmless from all fines, penalties,
and costs for violations or noncompliance by LESSEE with any of said laws, re-
quirements, or regulations and from all liability arising out of any such
violations or noncompliance;
c. that if any damage to the property shall be caused by his acts or neglect,
the LESSEE shall immediately notify LESSOR. LESSEE shall not repair any such
damage. LESSEE will be responsible for the expenses of labor and materials
for damages incurred by LESSEE or his guests or other persons connected with

occupancy of premises. acts or neglect. and should the LESSEE fail or refuse
to pay for such repairs within thirty '(30) days after said repairs are made;
the LESSOR may. at his option. make such repairs or contract to have repairs
made and charge the cost thereof to LESSEE. and LESSEE shall thereupon reim-
burse LESSOR for the total cost of damages so caused; LESSOR will not be re-
sponsible for loss of LESSEE'S personal property placed upon said premises
and insurance for any such personal property shall be LESSEE'S obligation;
d. LESSOR shall not be liable for any loss or damage of or to any property
placed in any store room or any storage. place in the building. such store
room or storage place being furnished gratuitously;
e. to permit LESSOR. or his agent. or any representative or any holder of
a mortgage on the property. or when authorized by LESSOR the employees of any
contractor. utility company. municipal agency or others. free access to the
premises at all reasonable. hours for the purpose of examining the same, or to
make any needed repairs which LESSOR may deem required or necessary; LESSEE
also will allow LESSOR to have placed upon said premised. at any and all
times. notice of "For Sale" and/or "To Rent" and will not interfere with the
same; LESSEE agrees to permit LESSOR or his agent to show the apartment to
other prospective purchasers or tenants when said premises are offered for
sale or rent;
f. to have no animals. birds or pets of any kind on the premises. other
than those expressly permitted in writing by LESSOR;
g. .agrees that no furniture filled or to be filled wholly or partially with
liquids shall be placed in the premises without the written consent of LESSOR.
h. the premises. shall not be used as a "boarding" or "lodging" house. nor
for a school. nor to give instruction in music. dancing or singing. nor shall
any signs be exhibited on or at any windows or any exterior portions of the
premises without the written consent of LESSOR; LESSEE, and those occupying
said premises under LESSEE shall not interfere with the heating apparatus or
with the lights. electricity, water. or other utilities of the building which
are not within the apartment. nor the control of any of the public portions
of the building; use of any master television antenna hookup shall be strict-
ly in accordance with regulations of LESSOR or LESSOR'S agent; LESSEE and
those occupying under LESSEE shall comply with and conform to all reasonable.
rules and regulations that LESSOR or LESSOR'S agent may make for the protec-
tion of the building or the general welfare and comfort of the occupants
thereof. and shall also comply with and conform to all applicable laws and
govermental rules and regulations affecting the premises and the use and
occupancy thereof.
8. If LESSEE shall abandon or vacate the premises. the same may be relet
by L.ESSOR for such rent and upon such terms as LESSOR may see fit and if a suf-
ficient sum shall not thus be realized. after paying the expenses of such relet- .
ting and collecting. to satisfy the rent hereby reserved. LESSEE agrees to sat-
isfy and pay all deficiency.
9. LESSOR will supply cold water to the premises for the use of LESSEE at
all faucets and fixtures provided by L.ESSOR therefor. LESSOR shall not be liable
or responsible to LESSEE for failure to furnish water when such failure shall re-
sult from causes beyond LESSOR'S control. nor during periods when the water system
in the building or any portion thereof are under repair.
10. LESSEE agrees that LESSOR shall be liable for property damage or personal
injury occurring in the leased premises or elsewhere on demised premises only where
such.damage or injury results directly from LESSOR'S negligence.

11. In the event LESSEE shall fatl to comply with any term or condition of
this lease, LESSOR shall have the right to: a) bring a law suit to recover pos-
session of the leased property; b) bring a law suit to recover the entire balance
due of the rent reserved for the full term hereof and any other charges due here~
under together with any and all damages caused by and incurred as a result of
LESSEE'S default including reasonable attorney's fees and court costs; c} to
exercise any and all rights accruing to him under the Pennsylvania Landlord and
Tenant Act, as amended.
12. If any action is instituted by LESSOR to recover possession of the leased
premises, for non-payment of rent, or for any other reason, LESSEE specifically
waive their right to three months notice to quit shall be sufficient.
13. If LESSEE retains possession of the premises or any part thereof after
the termination of the term of this Agreement by lapse or otherwise, LESSOR may
at LESSOR'S option, serve written notice upon LESSEE that such holding over con-
stitutes: a) a renewal of this Lease Agreement for one year, at a rental amount
to be set by LESSOR; or b) a tenancy at sufferance, at a rental of $15.00 per
day for the time LESSEE remains in possession; or c) an unlawful holding over,
allowing LESSOR to pursue an action for eviction against LESSEE.
14. In the event any provision of this lease shall be declared invalid by
any court of the Commonwealth of Pennsylvania, only such provision declared in-
valid shall be null and void and all other provisions not inconsistent therewith
shall remain binding and in full force.
15. Prior to (minimum of thirty days) termination of this Lease Agreement,
LESSEE agrees to give LESSOR notice whether he chooses to renew this Lease
Agreement or if he chooses to vacate demised premise.

have trash removed weekly.
18. LESSEE agrees to remove snow and ice from sidewalks, located in front of,

19. LESSEE is not permitted to use any type of kerosene or space heater in
apartment.

20. LESSEE shall not apply paint, wallpaper or any such substance on any
walls, ceilings, doors or windows of the apartment.
21. LESSEE is not permitted to remove or replace any curtain rods, brackets,
window-shades or brackets. LESSEE agrees to use those supplied for his use.
22. LESSEE agrees that any changes to demised premises warrant the written
consent of LESSOR. Any permitted changes are at LESSEE'S expense. Any such
changes are considered permanent (or permanent fixtures) and shall remain in
apartment after termination of this Lease Agreement and with no expenses or
charges incurred to LESSOR.
23. It is specifically understood by all parties that TRACEY L. MYERS will
act as agent and representative for LESSOR in any and all capacities and for all
purposes of this agreement.
24. Upon termination of this lease agreement LESSEE agrees to have a'll
carpets professionally cleaned by Proclean Chern-Dry carpet cleaners at LESSEE'S
expense and to supply a copy of the paid invoice to LESSOR.

NOW come Plaintiffs John McCorkel and Tracey Myers McCorkel, by and through their
attorneys, O'Brien, Baric & Scherer, and file the within Amended Complaint and in support
thereof, set forth the following:
1. Plaintiffs are John McCorkel and Tracey Myers McCorkel, husband and wife,
residing at 1434 Zimmerman Road, Carlisle, Pennsylvania, 17013.
2. Defendants are Michael Swartz and Tanya Swartz, husband and wife, residing at
155 East North Street, Apartment B, Carlisle, Pennsylvania,17013.
3. Defendants entered into a Lease Agreement to lease an apartment owned by
Plaintiffs located at 155 East North Street, Carlisle, PA., 17013, known and numbered Apartment
B. Said Lease Agreement is dated November 26, 1998, a copy of which is attached hereto,
marked as Exhibit "A", and incorporated herein by reference.
4. In October, 1999, Defendants caused damage to the tub kit which subsequently
leaked causing damage to the ceiling in the apartment directly below Defendants' apartment.

5. Plaintiffs received a repair proposal from McQuillen Construction for repair of the
tub and ceiling. Said proposal is attached hereto, marked as Exhibit "B", and incorporated herein.
6. Pursuant to paragraph 7 c ofthe Lease Agreement, Defendants are responsible for
the cost ofrepair arising from damage to the leased premises.
7. Plaintiff, John McCorkel, made the repairs necessary at a cost and expense of
$767.68.
8. Pursuant to paragraph 11 of the aforementioned Lease Agreement, Plaintiffs are
entitled to recover attorney's fees accruing in this matter.
9. Plaintiffs are seeking judgment in their favor in the amount of$707.68
10. Defendants have breached the Lease Agreement causing Plaintiffs to incur the
damages as set forth herein above.
11. All conditions preceding to recovery under the Lease Agreement have been
fulfilled.
12. Despite demand therefore, Defendants have failed and refused to pay the sum due
and owing.
WHEREFORE, Plaintiffs hereby request judgment in their favor for the sum of $707.68
and payment of attorney's fees as are just and reasonable.

LEASE' AGREEMENT
THIS LEASE AGREEMENT, made this :{t.<>+h day Of,~v~W , 199(,
by and between JOHN W. MCCORKEL, of Cumberland County, Pennsylvania, (hereinafter
referred to as LESSOR).
AND

(hereinafter referred to as LESSEE).
LESSOR hereby agrees to lease to LESSEE, and LESSEE agrees to lease from
LESSOR, a partially furnished apartment (See Exhibit "A" for furnishings persent-
ly in apartment) located on the
floor of the property and building known
as 155 East North Street, Borough of Carlisle, Pennsylvania, upon the following
terms and conditions, to wit:

3. LESSOR shall furnish the apartment as aforesaid and all mentioned items

4. LESSEE has examined and knows the condition of the premises and has
received the Same in good order and repair, except as herein otherwise stated,
and no representations as to the condition or repair thereof have been made by
LESSOR or his agent prior to, or at the execution of this Agreement, that are not
herein expressed or endorsed hereon; and upon the termination of this lease in
any way, LESSEE will immediately yield up said premises to LESSOR in as good con-
dition as when the same were entered upon by LESSEE, ordinary wear and tear only
excepted, and shall then return all keys to LESSOR.
5. LESSEE shall lease the said permises for residential purposes for ~
persons only, and for residential purposes only. LESSEE will not allow said
premises to be used for any other purpose that will increase the rate of insurance
thereon, nor for any purpose other than that herein before specified, nor to be

occupied in whole or part by any othel" 'perso~s, and will not sublet the same, nor
any part thereof, nor assign this lease, without, in each case, the written con-
sent of the LESSOR, and will not permit said premises to be ,used for any unlaw-
ful purpose or purpose that will injure the reputation of said premises of the
building or disturb other tenants or occupants of the building or the neighborhood.
6. LESSEE has deposited with LESSOR the security deposit in the amount of
one month's rent, or ~~-=',qO,oo , for the performance of all covenants and agree-
ments of LESSOR hereunder. LESSOR may apply all or any portion thereof in pay-
ment of any amount due LESSOR from LESSEE, and upon LESSOR I S demand LESSEE shall
in such case during the term of this lease, promptly deposit with LESSOR such addi-
tional amounts as may then be required to bring said security deposit up to the
full amount stated above. Upon termination of this lease and full performance
of all matters and payment of all amounts due by LESSEE, so much of the security
deposit has been applied by LESSOR as compensation for property damage, LESSOR,
when and as required by law, shall provide to LESSEE an itemized statement of such
damage and of the,estimated or actual cost of repairing same. If the building in
which said apartment is located is sold or otherwise transferred, LESSOR may
transfer or assign the security deposit to the purchaser or transferee of the
building, who shall thereafter alone be 1 iable to LESSEE for all LESSOR'S obliga-
tions hereunder, and for the return of said security deposit and other matters
related to the return of said deposit. LESSOR reserves the right to limit LESSEE
to 10 nail holes per wall, per room for the purpose of hanging pictures or
similar items. In the event said limit is exceeded, LESSEE agrees to pay to
LESSOR the amount of TWO DOLLARS ($2.00) per additional hole. LESSOR shall not
permit any holes to be made in any ceiling or in any part'of trim of said premises.
7. LESSEE for himself and his heirs, executors, administrators and assignee,
agree as follows:
a. to pay the rent herein stated promptly when due without any deductions
whatsoever, and without any obl igation on the part of the LESSOR to make any
demand for the same;
b. to keep the premises in a clean and sanitary condition, and to comply
with all laws, any state, county, or local health and policy requirements with
respect to said premises, and to save LESSOR harmless from all fines, penalties,
and costs for violations or noncompliance by LESSEE with any of said laws, re-
quirements, or regulations and from all liability arising out of any such
violations or noncompliance;
c. that if any damage to the property shall be caused by his acts or neglect,
the LESSEE shall immediately notify LESSOR. LESSEE shall not repair any such
damage. LESSEE will be responsible.for the expenses of labor and materia~s
for damages incurred by LESSEE or hlS guests or other persons connected wlth

, occupancy of premises, acts or neglect,' and should the LESSEE fail or refuse
to pay for such repairs within thirty '(30) days after said repairs are made;
the LESSOR may, at his option, make such repairs or contract to have repairs
made and charge the cost thereof to LESSEE, and LESSEE shall thereupon reim-
burse LESSOR for the total cost of damages so caused; LESSOR will not be re-
sponsible for loss of LESSEE'S personal property placed upon said premises
and insurance for any such personal property shall be LESSEE'S obligation;
d. LESSOR shall not be liable for any loss or damage of or to any property
placed in any store room or any storage, place in the building, such store
room or storage place being furnished gratuitously;
e. to permit LESSOR, or his agent, or any representative or any holder of
a mortgage on the property, or when authorized by LESSOR the employees of any
contractor, utility company, municipal agency or others, free access to the
premises at all reasonable hours for the purpose of examining the same, or to
make any needed repairs which LESSOR may deem required or necessary; LESSEE
al so will allow LESSOR to have placed upon said premised, at any and all
times, notice of "for Sale" and/or "To Rent" and will not interfere with the
same; LESSEE agrees to permit LESSOR or his agent to show the apartment to
other prospective purchasers or tenants when said premises are offered for
sale or rent;
f. to have no animals, birds or pets of any kind on the premises, other
than those expressly permitted in writing by LESSOR:
g.agrees that no furniture filled or to be filled wholly or partially with
liquids shall be placed in the premises without the written consent of LESSOR.
h. the premises shall not be used as a "boarding" or "lodging" house, nor
for a school, nor to give instruction in music, dancing or singing, nor shall
any signs be exhibited on or at any ,windows or any exterior portions of the
premi ses wi thout the written consent of LESSOR; LESSEE, and those occupyi ng
said premises under LESSEE shall not interfere with the heating apparatus or
with the lights, electricity, water, or other utilities of the building which
are not within the apartment, 1I0r the control of any of the publ ic portions
of the building; use of any master television antenna hookup shall be strict-
ly in accordance with regulations of LESSOR or LESSOR'S agent; LESSEE and
those occupying under LESSEE shall c:omply with and conform to all reasonable,
rules and regulations that LESSOR or LESSOR'S agent may make for the protec-
tion of the building or the general welfare and comfort of the occupants
thereof, and shall also comply with and conform to all applicable laws and
govermental rules and regulations affecting the premises and the use and
occupancy thereof.
8. If LESSEE shall abandon or vacate the premises, the same may be relet
by LESSOR for such rent and upon such terms as LESSOR may see fit and if a suf-
ficient sum shall not thus be realized, after paying the expenses of such relet- '
ting and collecting, to satisfy the rent hereby reserved, LESSEE agrees to sat-
isfy and pay all deficiency.
9. LESSOR will supply cold water to the premises for the use of LESSEE at
all faucets and fixtures provided by LESSOR therefor. LESSOR shall not be liable
or responsible to LESSEE for failure to furnish water when such failure shall re-
sult from causes beyond LESSOR'S control, nor during periods when the water system
in the building or any portion thereof are under repair.
10. LESSEE agrees that LESSOR shall be liable for property damage or personal
injury occurring in the leased premises or elsewhere on demised premises only where
such 'damage or injury results directly from LESSOR'S negligence.

.11. In the event LESSEE shall fail to comply with any term or condition of
this lease, LESSOR shall have the right to: a) bring a law suit to recover pos-
session of the leased property; b) bring a law suit to recover the entire balance
due of the rent reserved for the full term hereof and any other charges due here-
under together with any and all damages caused by and incurred as a result of
LESSEE'S default including reasonable attorney's fees and court costs; c) to
exercise any and all rights accruing to him under the Pennsylvania Landlord and
Tenant Act, as amended.
12. If any action is instituted by LESSOR to recover possession of the leased
premiseS, for non-payment of rent, or for any other reason, LESSEE specifically
waive their right to three months notice to quit shall be sufficient.
13. If LESSEE retains possession of the premises or any part thereof after
the termination of the term of this Agreement by lapse or otherwise, LESSOR may
at LESSOR'S option, serve written notice upon LESSEE that such holding over con-
stitutes: a) a renewal of this Lease Agreement for one year, at a rental amount
to be set by LESSOR; or b) a tenancy at sufferance, at a rental of $15.00 per
day for the time LESSEE remains in possession; or c) an unlawful holding over,
allowing LESSOR to pursue an action for eviction against LESSEE.
14. In the event any provision of this lease shall be declared invalid by
any court of the Commonwealth of Pennsylvania, only such provision declared in-
valid shall be null and void and all other provisions not inconsistent therewith
shall remain binding and in full force.
15. Prior to (minimum of thirty days) termination of this Lease Agreement,
LESSEE agrees to give LESSOR notice whether he chooses to renew this Lease
Agreement or if he chooses to vacate demised premise.

17. LESSEE agrees to contract a trash collector or to use Borough Bags to
have trash removed weekly.
18. LESSEE agrees to remove snow and ice from sidewalks, located in front of,
behind and on the west side of the said building.
19. LESSEE is not permitted to use any type of kerosene or space heater in
apartment.

"20. LESSEE shall not apply paint,'wallpaper or any such substance on any
walls, ceilings, doors or windows of the apartment.
21. LESSEE is not permitted to remove or replace any curtain rods, brackets,
window-shades or brackets. LESSEE agrees to use those supplied for his use.
22. LESSEE agrees that any changes to demised premises warrant the written
consent of LESSOR. Any permitted changes are at LESSEE'S expense. Any such
changes are considered permanent (or permanent fixtures) and shall remain in
apartment after termination of this Lease Agreement and with no expenses or
charges incurred to LESSOR.
23. It is specifically understood by all parties that TRACEY L. MYERS will
act as agent and representative for LESSOR in any and all capacities and for all
purposes of this agreement.
24. Upon termination of this lease agreement LESSEE agrees to have an
carpets professionally cleaned by Proclean Chern-Dry carpet cleaners at LESSEE'S
expense and to supply a copy of the paid invoice to LESSOR.

it is specifically denied that Defendants are responsible for the cost of repairs pursuant to
Paragraph 7(c) of the Lease Agreement as the Defendants did not damage the property through
their acts or neglect. To the contrary, any damages caused to the Leased Property or to the
apartment below were caused by normal wear and tear occurring to the tub kit installed by
Plaintiffs,

13, Any damage that occurred to the Leased Property was due to reasonable wear
and tear of the tub kit installed by Plainitffs, which, pursuant to Paragraph 4 of the Lease
Agreement is expected and permissible,
14, Plaintiffs failed to provide reasonable inspections and maintenance to the

property leased by Defendants and any damage sustained to the leased property was caused by
negligence on the part of Plaintiffs,
15, Plaintiffs failed to mitigate their damages, Upon discovering the leak in the tub
kit in question, Plaintiffs failed to make repairs in a timely marmer.
16. Any damage that occurred to the ceiling in the apartment directly below the
Leased Property was caused by Plaintiffs' negligent acts. Plaintiffs' lack of attention to the
damaged apartment constitutes negligence on the part of Plaintiffs,
17, Plaintiffs are in breach of the Lease Agreement, Said breach was the cause of
alleged damages.
18. Plaintiffs have breached the Lease Agreement causing Defendants to incur
expenses related to this frivolous action,
WHEREFORE, Defendants hereby request judgment in their favor and request
payment of attorney's fees as are just and reasonable.
