Consolidated Properties vs. Marc Harbin
Dear Sir or Madam:
This is our complaint as required for the appeal.
OnOctober 15, 1999 Marc Harbin gave Consolidated Properties his Intent to
Vacate in writing.
As per the lease agreement dated Apri123, 1999, tenants are required to give
landlord a 60 day written notice of their Intent to Vacate, Which means Mr,
Harbin is responsible for the rent from October 15, 1999 to December 14,
1999 the end of the notice period. We were instructed by Mr. Harbin to use
his Security Deposit for Rent from October 15 to November 14,1999, We
did not receive payment for the rent from November 15 to December
14,1999, The amount of Rent due to Consolidated Properties is $595.00
Also out1inet\in the lease, Liquidated Damages for breaking the lease is
equal to two months rent, which I incorrectly charged because of an addition
error. We charged $1170 instead of$1190. This balance has remained
unpaid. The amount of Liquidated Damages due to Consolidated
Properties is $1170.00.
Total amount d, ue to Consolidated Properties is $1765.00.

APPELLEE COMPLAlNT
1. Consolidated Properties received a letter dated October 15, 1999 containing Mr.
Harbin's Intent to Vacate in writing.
2. Lease agreement dated April 23, 1999 required Mr. Harbin to give Consolidated
Properties a 60 day written notice of his Intent to Vacate the apartment.
3. Per lease agreement, Mr. Harbin is responsible for rent from October 15, 1999 to
December 14, 1999, the end of the notice period.
4, In Mr. Harbin's letter dated October 15, 1999, Mr, Harbin instructed Consolidated
Properties to use his Security Deposit towards his rent due from October 15 to
November 14, 1999.
5. Payment was not received for rent from November 15 to December 14, 2000,
6, Per lease agreement, Liquidated Damages for breaking the lease equals two months
rent. $1170.00
7. Liquidated Damages remains unpaid.
8. Total amount due to Consolidated Properties is $1765,00
9. Consolidated Properties received Judgement from District Court 09-1-02 on March 7,
2000 in the amount of$1055,50,
