THIS AGREEMENT made this 4~ day of April, 2000
by and belween sechrist Construction, . Inc.
hereinafter called the Contractor.
AND James B. McGaffin, Jr. and sally L. McGaffin Husband and Wife
hereinafter calleclthe Owner.
WITNESSETH THAT:

AND WHEREAS, the Contractor has covenanted and agreed therein to enter into an additional agreement
with the Owner stipulating tilat no lien or liens of any kind shall be filed against the above building or the
appurtenances thereto,
NOW. THIS AGREEMENT WITNESSETH. that the Contractor, for and In consideration of the awarding to him
oIlhe said contract as for the sum of ONE DOLLAR ($1,00) to him in hand paid by the Owner. the receipt of
which is hereby acknowledged, promises and agrees that no Mechanic's Lien or liens shall be flied against
tne aforesaid buildinQ or the appurtenances thereto by sny subcontractor, subcontractors. materialmen,
mechanics. iaborers or anyone for materials furnished, work done or services rendered of any kind
whatsoever, for or about, or on account 01 the aforesaid building or on the credit thereof.

EXHIBIT "A"
ALL THAT CERTAIN lot of land situated in the Second Ward of in
the Borough of Mechanicsburg, county of cumberland, and
Commonwealth of Pennsylvania, more particularly bounded and
described as follows:
BEGINNING at a point on the southern side of DarIa Road on the
lot side of a proposed sidewalk at the dividing line between Lots 6
and 5 as shown on the hereinafter mentioned plan of lots; thence
along said dividing line between Lots Nos. 6 and 5, South 25
degrees 9 minutes East, a distance of 112.13 feet to a point at
lands now or formerly of Ellen Hess Smith and Joseph H. Hess;
thence along said latter lands, South 64 degrees 51 minutes West, a
distance of 259.42 feet to a point at the dividing line between
Lots Nos. 6 and 7 as shown on the hereinafter mentioned plan of
lots; thence along said dividing line between Lots Nos. 6 and 7,
North 24 degrees, 44 minutes 5 seconds East, a distance of 222.04
feet to a point on the lot side of a proposed sidewalk on the south
side of DarIa Road; thence along said side of proposed sidewalk on
the south side of DarIa Road, on a curve to the left having a
radius of 150 feet (with a chord bearing of North 83 degrees 53
minutes 41 seconds East), an arc distance of 96.46 feet to a point
on the same at the dividing line between Lots Nos. 6 and 5 as shown
on the hereinafter mentioned plan of lots, the place of BEGINNING.
BEING Lot No. 6 as shown on a plan of lots entitled
"Preliminary/Final Subdivision Plan for Heritage Acres" dated April
14, 1999, (last'r,evised July 20, 1999) and recorded in the Office
of the Recorder of Deeds in and for Cumberland County,
Pennsylvania, in 'Plan Book 79, Page 143.
UNDER AND SUBJECT, nevertheless to conditions, restrictions,
reservations and., rights Of way of prior record.
BEING THE SAME PREMISES which Sechrist Development corp.,
a/k/a Sechrist Development Corporation, by its deed dated January
5, 2000, and recorded in the Office of the Recorder of Deeds of
Cumberland County in Deed Book 214, Page 567, granted and conveyed
unto James B. McGaffin, Jr. and Sally L. McGaffin, Mortgagors herein.
