STIPULATION AGAINST LIENS
WHEREAS, BRIAN D. KINT and CAREY S. KINT, of 6115 MacArthur Drive,
Harrisburg, Pennsylvania, is about to execute contemporaneously herewith, a contract with
WHEATLAND CUSTOM HOMES, INC. of 447 Granite Run Drive, Lancaster, Pennsylvania
for the erection of a dwelling upon a lot of land situate as follows:
ALL THAT CERTAIN parcel of land situate in Hampden Township, Cumberland
County, Commonwealth of Pennsylvania, more particularly bounded and described to wit:
BEGINNING at a point on the western right-of-way line of Abington Way, at the
common front property corner of Lot No. 302 and Lot No. 303 as shown on the hereinafter
mentioned plan of lots; thence along said right-of-way by a curve to the left having a radius
of 175.00 feet an arc distance of 144.02 feet to a concrete monument; thence along the same
South 34 degrees 13 minutes 23 seconds East, a distance of 48.33 feet to a point; thence along
the same by a curve to the right having a radius of 25 feet an arc distance of 17.14 feet to a
point at the southeast corner of Lot No. 304; thence along the line of Lot No. 304 North 84
degrees 56 minutes 53 seconds West, a distance of 51.65 feet to a point; thence along the
same North 53 degrees 12 minutes 38 seconds West, a distance of 294.51 feet to a point;
thence North 37 degrees 29 minutes 18 seconds East, a distance of 64.39 feet to a point at the
northwest corner of Lot No. 302; thence along Lot No. 302 South 78 degrees 40 minutes 40
seconds East, a distance of 194.63 feet to a point, the Place of BEGINNING.
THE ABOVE-DESCRIBED TRACT BEING KNOWN AS Lot No. 303 of the Final
Subdivision Plan of Hampden Hearth - Phase IV-B recorded in the Cumberland County
Courthouse in Plan Book 79, Page 107. The above described tract containing 29,627.94
square feet, more or less.

THE ABOVE DESCRIBED-TRACT BEING SUBJECT TO various easements of
record as indicated on the above-referenced Subdivision Plan.
UNDER AND SUBJECT to an unnamed stream, a 60-foot drainage easement
centered on existing unnamed stream and a 1 DO-year flood limit, all of which run along the
eastern portion of said lot.
NOW, the 1. t~ day of April, 2000, at the time of and immediately before
the execution of the principal contract, and before any authority has been given by the said
BRIAN D. KINT and CAREY S. KINT, to the said WHEATLAND CUSTOM HOMES, INC. to
commence work on the said building, or purchase materials for the same in consideration of
the making of the said contract with WHEA TLAND CUSTOM HOMES, INC. and the further
consideration of One Dollar, to WHEATLAND CUSTOM HOMES, INC. paid by BRIAN D.
KINT and CAREY S. KINT, it is agreed that no lien shall be filed against the building by the
contractor, or any sub-contractor, nor by any of the material men or workmen or any other.
person for any labor, or materials purchased, or extra labor or materials purchased for the
erection of said building, the right to file such liens being expressly waived.
WITNESS, our hand and seals the day and year aforesaid.
