Defendant Fork Lifts, Inc. is a corporation organized and existing under the laws of the Commonwealth of Pennsylvania with offices or principal place of business located at 741 Independence Avenue, Mechanicsburg, Cumberland County, Pennsylvania. 5. On April 13, 1998, Plaintiff Deloris J. Dunn suffered serious personal injury while working in her capacity as a material handler at the Carlisle, Pennsylvania facility of AMP, Incorporated: 6. At the time of Mrs. Dunn's injuries, she was operating a machine known as a Blue Giant Walkie Stacker, Serial Number 9730387, Model No. BGS 30-52, hereinafter referred to as the "Product" . 7. Prior to April 13, 1998, Fork Lifts, Inc., acting as a merchant within the ordinary scope of its business, sold and delivered the Product to the employer of Plaintiff Deloris J. Dunn. 8. The Product was designed, manufactured, and introduced into the stream of commerce by Defendant Blue Giant USA and Defendant Blue Giant Canada. 9. Prior to April 13, 1998, Fork Lifts, Inc. had contracted with the employer, AMP, Inc. to provide preventive maintenance for the fork lifts owned and operated by AMP, Inc., including the Product involved in this case. 10. During the early morning hours of April 13, 1998, Mrs. Dunn was operating the Product, utilizing it for its intended uses and purposes and operating it in its intended manner on the factory floor of her employer's premises, in the reverse direction. II. As the result of the aforesaid injuries, Mrs. Dunn has undergone extensive medical care and treatment including split thickness skin grafting; hospital and doctor's visits; extensive physical therapy; and has received physician services, all of which have caused her to incur medical expenses in excess of $10,512.68, which expenses will continue to accrue in the future. 13. As the result of her injuries, Mrs. Dunn was totally disabled from attending to her usual and customary employment duties from April 13, 1998 through August 18, 1998, a period of 17 weeks, resulting in a total gross loss of earnings of$1 0,287.97. Thereafter, Mrs. Dunn was partially disabled from her usual employment through March 30, 1999, and suffered a gross loss of earnings during that time period of$7,183.98. 14. Blue Giant USA Corporation ("USA") and Blue Giant Canada Limited ("Canada") were sister companies sharing common ownership (namely, the Larsen &mily). USA was an , Alabama corporation operating from 204 Industrial Park Drive, Pell City, AL and Canada was a Canadilln corporation operating from 85 Heart Lake Road S., ~rampton, Ontllrio, Canada. 2. USA and Canada executed separate asset sale agreements with entities owned by a common parent - namely Clark Material Handling Company of Lexington, KY ("Clark"). It is my understanding that while Clark bad an existing entity in Canada through which it could acquire Canada's assets, it bad to forin a new entity, Blue Giant Corporation, a Delaware corporation, to acquire the assets of USA. 3. Concurrent with the execution of the asset sale agreements, USA and Canada bad to change their names and cease to use the name Blue Giant. USA was renamed Larsen Properties Corp. nMSCorp'~ and Canada became 177436 Canada Limited. 4. LarsCorp. continues to exist, while 177436 Canada Limited surrendered its cbarter and dissolved.
