1. The plaintiff, American Express Centurion Bank (herein
after referred to as Centurion Bank) is a corporation with a place
of business located at 248 Chapman Road, Newark, DE 19702.
2. The defendant is an adult individual with an address of
825 Sandbank Road, Mt. Holly Springs, PA 17065.
3. At the request of the defendant, American Express issued
to the defendant an American Express Optima credit card; and at
all times relevant hereto, the defendant was the holder of said
credit card issued through the credit facilities of American
Express. A true and correct copy of the credit application is
attached hereto, made a part hereof, and marked Exhibit "A."
4. At the request of the defendant, American Express
established and issued in the name of the defendant, an American
Express Optima credit card bearing number 3734 989049 11000,
pursuant to a written contract entitled "Agreement Between Optima
Card Member and American Express Centurion Bank." A true and
correct copy of which is attached hereto, made a part hereof, and
marked Exhibit "B".

5. As of November 24, 1998, the defendant incurred charges
on the account in the sum of $6,357.17, no part of which has been
paid, although duly demanded. A true and correct copy of the
defendant's most recent monthly statement is attached hereto, made
a part hereof, and marked Exhibit ~C."
6. Pursuant to the terms of the card member agreement, the
plaintiff is entitled to interest at the rate of 22.49% per annum
from November 24, 1998 until the day judgment is entered.
7. In accordance with the terms of Exhibit "B," defendant
agreed to pay the plaintiff a fifteen percent (15%) attorney1s fee
if the account was referred to an attorney for collection. The
plaintiff will jointly incur an attorney's fee in the sum of
$950.00.
WHEREFORE, plaintiff, American Express Centurion Bank demands
judgment against the defendant in the sum of $6,357.17 plus
interest at the contract rate from November 24, 1998 plus
attorney's fees of $950.00 and costs of this action.
8. Plaintiff realleges each and every allegation contained
in paragraphs 1 through 7 of this complaint and incorporates them
herein by reference as if the same were set forth at length.
9. The defendant received a monetary benefit of $6,357.17
that was in fact appreciated by the defendant.
10. By virtue of the circumstances surrounding the request
for plaintiff's credit card, the completion of the application and
use of plaintiff's credit facilities, the defendant knowingly and
voluntarily accepted the benefits bestowed.
11. It would be inequitable for this Court to allow the
defendant to retain the benefits of the funds or to be unjustly
enriched at the expense of the plaintiff.
12. In accordance with the law there is interest due at the

WHEREFORE, plaintiff demands judgment against the defendant
in the sum of $6,357.17 plus interest from November 24, 1998 and
costs of this action.
